IT IS notified for the general information of the publtc that pursuant to Article 38 (2) and (3) (a), (b) and Article 10 of the
Constitution of Kenya, 2010, the Cabinet Secretary for Foreign Affars and International Trade has established "The Task Force on the

(b) establish the extent to which Kenyans hving abroad can progressively participate in General Elections and Referenda;

(d) advise on modalities for sensitizing Kenyans living abroad on
Voting; and
(e) advise on any other mafter incidental to the above mandate that is not covered herein.
3. In the performance of its functicns the Task Force:
(a) shall report to the Cabinet Secretary for Foreign Affairs and
International Trade;
(D) shall hold such number of meetrngs rn such places and at such times as it shall consider necessary for the prudent drscharge of its functions;
(c) may cause to be carried out such studres or research as may be relevant to its mandate;
(d) shall have all the powers necessary or expedient for the proper execution of its functions, including the power to regulate its own procedure;
(e) may co-opt otler members rt may deem necessary for the discharge of its mandate; and
(f shall be entitled to appropnate allowances.
4. The Task Force shall carry out its mandate and submit lts report within 3 months from the date hereof.
The Secretanat of the Task Force shall be based at the Minrstry of
Foreign Affairs and International Trade.

APPoINTMENT
IT IS notified for the general informatlon of the public that following Cabinet directive on the 26th November, 2014, for the review and development of a policy and legal framework to regulate and manage child adoptions in Kenya, the Cabrnet Secretary for
Labour, Social Security and Services establishes and appornts an

Terms of referince of the Committee:
The mandate of the Committee is to-
(a) develop simplified guidelines for the revrew of resrdent and inter-country adoption applications that had been inihated, before the lssuance of the moratonum on both resrdent and inter country adoptions;
(b) review and make decisions on all applications for resident and inter country adoptions that had been initiated before the issuance of the moratonum;
(c) recommend for mvestlgatrons and prosecution of any person(s) or agencies found to have been involved rn illegal practices in adoption:
(d) regulate and provide quality assurance of adoption activrties dunng the transitional penod; to develop standard practice gurdehnes so as to streamllne the adoptron practrce and ensure quahty assurance;
(a) oversee or undertakethe review of legal and policy framework of adoption practice in the country; and
(J) revrcw the structures and mechanisms of implementation of chrld adoption in Kenya, including those related to adoption such as family tracing and reunrficatron, lnstltutlonal care, foster care, guardranshrp and krnshrp care.
Deliverubks
(a) the committee shall dcvelop gurdelines for revrew of pending resident and international adoption applications initiated before the moratorium was issued;
(b) the Transition Expert Committee ls expected to use the developed guidelines to glve dlrectlon and address or handle the resrdent and intematronal adoption applicahons that had been inrttated before the moratorium rvas rssued but not finahzed by the courts.
(c.) the drrection will be, among others:
(r) review of all the declaration reports and documentatlon for the children placed in intemational and resrdent adoption:
(ll.) tracrng of famrhes fbr chrldren who have been placed rn international adoption and resident adoptron;
(ru) allow the finalization of cases whereby placement of children happens only after family tracing has been exhausted arrd only lf lt is in the best interest of the child or:
(lv) wlthdraw chrldren rvho had been placed rn rnternatlonal or resident adoptron only if it is in their best rnterest;
(v) identified children (rvho had rnrtrally been placed in resident or intemahonal adoption and whose families have been traced) are referred for psychosocral support;
(vl) dlscontinue or cancel internatronal adophon applications that had not been placed with children, (vlr) ldentlfy appllcahons that have not followed the necessary steps for rntemational or resrdent adoptron and make recommendations for legal actlon to be taken against all parties rnvolved rn the rregular processi
(viri) make relevant decrsrons and interventlons or actions in the best lnterest of chrldren through family tracing and reunrfication and other alternative famrly care placement such as guardianshrp, kinship care and foster care;
(d, the commrttee shall bnng out the gaps that are identified rn the adoption process and also rdentify intewentions that can help support family preservatlon by strengthening other forms of altemative family care such as foster care, kinship cme and guardranship;
(e) the committee shall grve recommendatrons for penalty or actron to be taken on persons or agencies found to have beeu rnvolved rn rllegal adoptron practlces which may rnclude
1al term, fines, cancellatron of reglstrafion for prachtroners (i.e.
adoption societies, CCIs, law firms, judges rn person)
(fl the committee shall recommend for a professronally structured government bodv to co-ordinate adoption activities;
(g) drstinction and clarrfrcatron of roles and responsibrlities of adoptron societies, CCIs, lal frms (if necessary), court, regrstrar, chrldren's office or department as well as adoptrve parents (regarding legal self-representatron rn court);
(ft) the committee shall give recommendatlons on pohcy, legal framework and structures and mechpnism of implementation of chrld adoption in Kenya within the chrld right framework.

Reporting
(a)the committee shall report to the Cabinet Secretary for labour and social security and Services; and
(D)shall regularly advise and keep the Cabinet Secretary apprised on the progress.
Mode ofoperation:
In performance of its mandate, the committee shall regulate its own procedure.
Duration:
The duration of the comminee shall be a renewable term of three
(3) years with effect from publication date of this notice.
Secretariat:
The secretariat operation office shall be as assigned by the Cabinet
Secretary and will be composed of the following minimum members of staff:

Costs:

Adoption Committee is revoked.

In the performance of its functions, the Steering Commtttee may-
(a) co-opl not more than three persons who possess the relevant expertise, skill and experience which it considers necessary and proper;
(b) cary out or commission such studies or research as may inform the Cabinet Secretary on the Decision;
(c) solicit, receive and consider vrews from menrbers of the public and other interest groups; and
(d) cor,dtct any other activities required for the effective discharge of its mandate.
The Steering Commtttee shall regulate tts own procedure.
The Steenng Commrttee shall remain tn office for a period of one year with effect from lst March, 2015 or for such longer period as the Cabinet Secretary may prescnbe by notice inthe Gazelle.
The Steering Committee shall-
(a) every three months, prepare and submlt to the Cabinet
Secretary reports ofits progress;
@) propose rnterim recommendations to flr: Cabinet Secrctary within six months of rts appoinfrnent; and
(c) submit a final report and make final recommendations to the
Cabinet Secretary within one year of its appointment.
