Box 29, Omboga in the Republic of Kenya, is registered as proprietor of that piece of land containing 4.8 hectares or thereabout, known as parcel No. South Karachuonyo/Kamenya/381,. situate in the district of Rachuonyo, and whereas the senior resident magistrate’s court at Homa Bay, in civil suit No. 22 of 1996, has ordered the district land registrar to declare the title deed issued to the registered proprietor as lost and seek its gazettement, and whereas Ezekiel Oloo Goga, of P.O. Box 29, Omboga, the plaintiff in this case, is entitled to be registered as owner of.a portion of the said piece of land (South Karachuonyo/Kamenya/381), and whereas he wants the mutation instrument registered so that he can get his number separated, and whereas he filed the said suit against Andrea Oling Ajowi, whom the plaintiff in this suit purchased land from, notice is given that after the expiration of thirty (30) days from the date hereof provided no valid objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with the registration of the said mutation instrument and issue a land title deed to the said Ezekiel.
