PROPOSED ACQUISITION

IN EXERCISE of the powers conferred by section 42 (1) of the Competition Act, 2010, the Competition Authority of Kenya excludes the proposed acquisition of indirect control of Ole Naishu (2000) Limited by Kobe Guardians Limited as trustee of the Ole Naishu Trust from the provisions of Part IV of the Act due to the following reasons— (a) the merger will not affect competition negatively; and (b) the combined value of the assets, which was higher than turnover, for the preceding year, ended 31st May, 2021, was KSh. 877, 404,895.00 and therefore the transaction meets the thresholds for exclusion as provided in the Competition (General) Rules, 2019.
