PROPOSED ACQUISITION

IN EXERCISE of the powers conferred by section 42 (1) of the Competition Act, 2010, the Competition Authority of Kenya excludes the proposed acquisition of one hundred percent (100%) shareholding in Delta Automobile Limited by Nairobi Business Ventures PLC from the provisions of Part IV of the Act due to the following reasons— (a) the merger will not affect competition negatively; and (b) the combined asset value, which is higher than the turnover for the preceding year, 2020, was KSh. 724, 369, 593 and therefore, the transaction meets the thresholds for exclusion as provided in the Competition (General) Rules, 2019.
