The proposed grant is in pursuance of the recommendations of the Eicctricity Regulatory Board under section 9 of the Act. The proposed licence shall authorize and entitle the licensee to generate electric power at, and supply thereof from the licensed power generating station to be known as Kipevu II Diesel Power Plant, situate in Mombasa, within L.R. No. MN/VI/4086/Mombasa, and comprising units, equipment, connection facilities and metering equipment procured, constructed, installed, owned, maintained and operated by the licensee. The net electrical output generated by the licensed power generating station shall be delivered to the Kenya Power and Lighting Company Limited, under the terms and condi- tions of a power purchase agreement dated 28th January, 2000, made between the Kenya Power and Lighting Company Limited, and the licensee and approved by the Board.
