THE LAND REGISTRATION ACT

REGISTRATION

WHEREAS Joanes Ndiku Mbithi (deceased), is registered as proprietor of that piece of land containing 3.0 hectares or thereabout, known as Kithimani/Kithimani ‘A’/877, situate in the district of Machakos, and whereas the Principal Magistrates Court in Succession Cause No. 56 of 2019, has issued grant of letters of administration to Syombua Ndiku (ID/1676685), and whereas the said Syombua Ndiku has executed an application to be registered as proprietor by transmission of L.R.A. 39 in respect to the said piece of land, and whereas the land title deed issued in respect of the said piece of land has been missing or lost, and whereas all efforts made to recover the said land title deed for the said piece of land have failed, notice is given that after the expiration of thirty (30) days from the date hereof, I intend to dispense with the production of the said land title deed and proceed with the registration of L.R.A. 39 in the name of Syombua Ndiku (ID/1676685), and upon such registration the land title deed issued earlier to the said Joanes Ndiku Mbithi (deceased), shall be deemed to be cancelled and of no effect.
