under the Disposal of Uncollected Goods Act, (Cap. 38) of the laws of Kenya, to Fatco Limited, P.O. Box 103291– 00100, Nairobi, that within three (3) months from the date of service of this notice upon you, being on or after Monday, the 7th September 2023, our client shall proceed to sell the Machine Motor Grader GD850A, bearing serial number 11462, (“the goods”) owned by you and delivered to them for inspection and differential repairs but no go- ahead has been given to complete the repair since 2014. A notice to take delivery of the goods was duly published in the Daily Nation on Wednesday, the 18th January, 2023 and in the Kenya Gazette on Friday, the 27th January, 2023. The goods are currently lying at the premises of Panafrican Equipment (Kenya) Limited, at Mombasa Road /1.4km South of Likoni Road, Nairobi, P.O. Box 44927–00100, Nairobi, Kenya. The amount payable to our client as at 24th April, 2023, is Kenya Shillings three hundred and thirty-five thousand, seven hundred and four (KSh. 335,704.00) being all accrued repairs, storage/handling charges, and any other incidental costs and Kenya Shillings eighty six thousand, eight hundred and eighty only (KSh. 86, 880.00) being the costs of giving you notice. Take notice that if you do not comply with the obligation to pay the outstanding amount and take delivery of the goods within the time stipulated herein, our client shall proceed to sell the goods pursuant to the provisions of section 7 of the Disposal of Uncollected Goods Act, (Cap. 38) of the laws of Kenya.
