GAZETTE NOTICE NO. 8404

PURSUANT to the provisions of section 25 of the Competition Act, 2010 (“the Act”), the Competition Authority of Kenya (“the Authority”) notifies the public that Kenya Airways Plc (KQ) and Precision Air Services Plc (PW) have applied to the Authority for exemption from certain provisions of the Act with regard to potential restrictive trade practices of their Joint Venture agreement, for a period of not less than six (6) years. In particular, the KQ-PW Joint Venture is seeking to be exempted with respect to the following; (a) engagement in a free-flow, reciprocal code-sharing agreement on the routes under the Joint Venture agreement; (b) alignment and co-ordination of network management activities with respect to the joint venture including, terms of routes, schedules, capacity and designation; (c) alignment and co-ordination of pricing of ticket fares on the joint venture routes; (d) alignment and co-ordination of management of any and all revenues attributable to the performance of the joint venture by any Party, including without limit, setting up of joint revenue management systems and joint revenue analysis systems; and (e) setting up of joint marketing and sales activities with respect to the joint venture. The above conduct, if not exempted, will qualify as contraventions of the Act, hence the application for exemption. All interested parties are required to submit written representations, if any, with regard to this application within thirty (30) days of the publication of this notice.
