GAZETTE NOTICE NO. 2794

PURSUANT to the provisions of section 18 (5) (a) of the Competition Act, 2010 (“the Act”) and in exercise of the powers conferred by section 18 (1) (a) of the Act, the Competition Authority of Kenya intends to carry out a study into the Online Food Delivery and Groceries Platforms in Kenya. The market inquiry will seek to uncover how food delivery and groceries platforms work in practice and suggest regulatory and policy options for competition and consumer protection enforcement. The inquiry will more specifically seek to— (a) identify players and services involved in the food delivery and groceries platforms business model in Kenya and examine the relationships between the platforms and the users with focus to the competition parameters (market power and conduct) and concerns amongst the players; (b) assess the role of data in operating multi-sided online platforms, customer acquisition, retention as well as data portability, e-payment services and their importance in relation to the food delivery and groceries platforms business model; (c) better understand the consumer protection concerns with a view to providing redress mechanisms available for consumers when shopping through online market places; and 3rd March, 2023 THE KENYA GAZETTE (d) assess the relevance of the existing regulatory framework and its applicability in the digital markets, to guide better policy making. In conducting the study, the Competition Authority of Kenya shall— (a) hold such number of meetings and Key Informant Interviews (KIIs) in such places at such times as it may consider necessary for the proper discharge of its functions; and (b) may receive views from all stakeholders through oral and/or written submissions from any person with relevant information. Members of the public with relevant information may also submit oral or written submissions to the Secretariat within twenty-one (21) days of publication of this Notice.
