pursuant to Article 174 of the constitution of Kenya, 2010. It is located within the south rift valley region and its headquarters is located at Bomet Town. It extends between longitude 35° 05' West and 35° 35' East; latitude 1° 03' south and 0° 29° North and has a high altitude of 1,962m. It borders Narok County to the South, Nakuru County to the North-East, Kericho County to the North, Nyamira County to the West. It covers a total Of 2,037.4ke. The County is a source of major rivers such as Mara and Itare which flow into Lake Victoria. Administratively, Bomet County is divided into 5 Sub-Counties namely Bomet Central, Bomet East, Chepalungu, Konoin and Sotik. They are also demarcated as constituencies under the Independent Electoral and Boundaries Commission. The sub-counties are further delimited into 25 wards, 66 locations and 176 sub-locations. 1.2 The Structure of the County Government The county government is comprised of the county Executive and the County Assembly. The Governor and the Hon. Speaker heads the Executive and the County Assembly, respectively. The county Executive has ten departments headed by the county executive committee members and respective Chief Officers who are the accounting officers. 1.3 Introduction Section 5 of the assumption of the Office of Governor Act, 2019 established the assumption of the office of governor committee tasked with, among other functions, within one month of the affairs of the committee, submit the same to the county assembly and published the report in the gazette in accordance with section 18 of the Act. (The assumption of office of the governor Act, 2019) 1.4 Composition of The Committee section 5 (1) and (2) of the Act, establishes and sets out an ad hoc committee comprised as follows— MR/4248486 2nd December, 2022 the County Secretary who shall be the chairperson; the officer in charge of legal matters in the county; the Chief Officer in the department responsible for matters relating to county public service; the Chief Officer in the department responsible for matters relating to information and communication; the Chief Officer in the department responsible for matters relating to finance; the Chief Officer in the department responsible for matters relating to culture and social service; a representative of the ministry responsible for matters related to devolution; the County Commissioner; a representative of the National Intelligent Service at the county level; a representative of the National Police Service at the county level; the Clerk of the county assembly; a representative of the Judiciary at the county level; and (m) two persons, one man and one woman nominated by the Governor elect. Section 5 (3) of the Act states that the Chief Officer in the department responsible for matters relating to county public service shall be the secretary of the committee. In addition, 5 (4) of the act states that the members referred to him subsection 2 (h) and (i) shall be the member serving as members of the county policing authority established under the National Police Service Act. Section 5 (5) of the Act, the members referred in sub section 2 (1) shall be nominated upon the declaration of the final result of the election of the governor. Section 7 (1) and (2) give the committee powers to establish such sub committees as may be necessary and may co-opt into sub-committee person(s) whose knowledge and skills are necessary for the effective functioning of the committee. Pursuant to section 5 (10), the time of office of a committee established under this section shall lapse upon the submission of the report of the committee to the county assembly in accordance with section 18 (2) of the Act. 1.5 Functions and Powers of Assumption of Office of the Governor Committee. Section 6 (1) (a-h) of the Act, stipulate the function of the committee as follows— facilitate the handing over process by the outgoing governor to the governor elect. ensure and coordinate provision of security services to the governor elect. (c) put in place the necessary facilities and deploy the necessary personnel for the governor elect upon assumption of office. co-ordinate the briefing of the governor—elect by the relevant county public officers including submission of the following information— an up to date assets register; an up to date register of liabilities; a complete list of all bank account and reconciled balances; a report of staff establishment per department; a comprehensive report on the county entities or corporations and agencies containing information outlined in (1) to (iv); a report of all ongoing projects including donor funded projects; (vii) An up to date report on all pending legal cases; and (viii) County source of funding. (e) facilitate communication between the outgoing governor and the governor -elect; prepare a programme and organize for the swearing in ceremony; (f) prepare the oath and the certificate of inauguration; and (8) carry out any other activity necessary for the performance of its function under this act and perform any other function assigned to it under any other written law. Further, section (2) and (3) gives powers to the Committee necessary for the execution of its functions under the Act and any other written law. In addition, all the information to be provided during the briefing referred to under section 6 (1) (d) shall be submitted by this committee in the form set out in the Second schedule and shall be information for the period of up thirty days before the date of the general elections. 2.0 Activities of the Committee The Act required the Chairperson of the committee to convene the first meeting thirty days (9th July, 2022) before the date of the General Election (9th August, 2022). Subsequently, this committee had its first meeting on 7th July, 2022 when quorum was met. In its first meeting and in compliance with section 20(4) of the Act, every member of the committee signed confidentiality agreement. The Committee developed its work schedule including the establishment of sub- committee and co-option of persons in accordance with section 7 (1, (2) of the Act. The Committee established the following sub committees: (a) Budget and Finance (b) Co-ordination, Security and Logistics (c) Communication and Publicity (d) Legal 2.1 Co-ordination, Security and Logistics Sub Committee The sub-committee ensured provision of adequate security to the Governor elect and the Deputy Governor-elect upon declaration of results by independent Electoral and Boundaries Commission (IEBC). The team identified and mobilized security personnel for specific roles before, during and after the swearing in ceremony. These included traffic/crowd control, general security and coverage parade by county inspectorate service. The sub- committee also guided the main committee on necessary security preparation to be undertaken. The sub-committee also co-ordinated logistical arrangements relating to sourcing of venue, necessary protocols, entertainment, mobilization sensitization, reception and general organization of the swearing-in ceremony. The sub-committee engaged National and County Government administrative officers and other staffs to provide general support to the committee. It guided the committee on identification of appropriate venue, layout accreditation of invited guest and sitting arrangements. 2.2 Legal Sub-Committee The sub-committee in liaison with the judiciary ensured that the swearing- in ceremony was conducted in accordance with the law and that all county symbols county flag.
