GAZETTE NOTICE NO. 11739

NOTICE is given that pursuant to the powers conferred by section 30 of the County Governments Act, the realization of Article 174 and 175 of the Constitution of Kenya and all other enabling laws, I, Abdullswamad Sheriff Nassir, Governor of the County of Mombasa, do establish and appoint a Taskforce on the State of Finances of the County Government of Mombasa. And further direct that, any other executive efforts into similar lines of enquiry are hereby subsumed into the Taskforce on the State of Finances of the County Government of Mombasa and stand dissolved. The Taskforce on the State of Finances of the County Government of Mombasa shall be constituted as follows: Mahmoud Noor — Chairperson Members: Representative, Kenya National Chamber of Commerce and Industry, Mombasa Chapter Representative, Law Society of Kenya – Mombasa Chapter Representative, Institution of Certified Public Accountants of Kenya Representative, Kenya Revenue Authority Representative, Civil Society Ali Ahmed, Business Community County Secretary Chief Officer, Finance County Attorney Secretariat, Office of the Governor Terms of Reference of the Taskforce The Terms of Reference of the Taskforce on the State of Finances of the County Government of Mombasa shall be to: 1. Engage stakeholders including but not limited to the general public, National public financial institutions, National regulatory authorities, the Mombasa business community among others towards: (a) Reviewing the architecture of county revenue to— (i) optimize institutional organization and governance of revenue administration; (ii) identify and optimize various revenue streams available to the County Government including own source revenue; (iii) improve efficiency in revenue collection and reduce and prevent revenue leakage; (iv) recommend the sustainability of revenue resources; and (v) evaluate the policies and legislation governing county levies with a view to seeking out opportunities to reduce the tax burden on the citizens of Mombasa. (b) Review the patterns of expenditure of the County Government of Mombasa to— (i) recommend expenditure rationalization and a pathway to the financial stability of Mombasa; (ii) develop recommendations to prepare the County Government of Mombasa for shadow rating and the issuance of county borrowing by the year 2024. (c) Audit the assets of the County Government of Mombasa to review and catalog all the movable and immovable assets of the County Government of Mombasa and recommend appropriate measures to dispose of immovable assets; 30th September, 2022 THE KENYA GAZETTE (d) Audit the liabilities of the County Government of Mombasa to recommend an appropriate arrangement of paying verified pending bills that is open, equitable, accountable and practical in consideration of all polycentric factors; and 2. Pending the report of the Taskforce, in the interim, there shall be established a Rapid Results Initiative under the Department of Finance, supervised by the Taskforce. This Rapid Results Initiative shall don county uniform in the course of its duties for ease of identification by the General Public. 3. Conduct any other matter ancillary to or in furtherance of any of the foregoing Terms of Reference; and 4. The Taskforce may co-opt any other persons as may be required to assist it in the discharge of its functions. 5. The Taskforce shall prepare and submit its report to the Governor of Mombasa County together with its recommendations within sixty (60) days from the date of its appointment.
