PURSUANT to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Dell Development Company proposes to develop Nyayo View Suits entailing two twin apartments comprising of two separate detached apartments of fifteen levels each with a total of 312 units; comprising of basement, ground floor, mezzanine and upper floors. The residential apartments shall contain studios, 1 and 2 bedrooms per floor, retail shops, associated facilities and amenities. The proposed project will be located on plot L.R. No. 37/256/1 Nairobi West Area, Lang’ata Sub-county, Nairobi City County. Environmental Impact Possible Mitigation Excessive noise and vibration • Ensure that noise and vibration levels emanating from machinery, vehicles and noisy construction activities (e.g. excavation) are kept at a minimum for the safety, health and protection of workers within the vicinity of high noise levels and nearby communities and commercial premises. • Provide appropriate PPE to all staff and visitors. • Stick to the provisions of EMCA (Noise and Vibration) Regulations, 2009. Air/dust pollution • Post signs that limit vehicles speed onto unpaved roads and over disturbed soils; • Cover stockpiles of sand, soil and similar materials or surround them with wind breaks. • Use of dump method to mitigate on dust by sprinkling water on areas to be excavated. • Enclosing the structures under construction with dust proof nets especially along the residential boundaries. 26th August, 2022 THE KENYA GAZETTE Environmental Impact Possible Mitigation • Using efficient machines with low emission technologies for the ones that burn fossil fuels. Wastewater management • All waste water from the construction sites shall be stored according to the containment measures to mitigate on soil and underground contamination. • All harmful effluents shall be discharged into the existing sewerage system in the area and in accordance with EMCA (Water Quality) Regulations, 2006. • Ensure separation of grey water from kitchens from black water. Solid wastes • Provisions of waste segregation bins and sound waste practices like recycling and appropriate disposal at approved disposal shall be strictly enforced. • The contractor is expected to develop a construction waste management plan that results in end-of-Project rates for salvage/recycling of 80% (by weight) of construction and demolition waste. • All wastes from the apartments shall be collected and disposed of by a NEMA registered waste handler. • Adhere to EMCA (Waste Management) Regulations, 2006. Occupational/construct -ion health related risks • Restricting access to active construction sites, including establishment of security perimeter and placing adequate safety signboards to divert community and passengers away from the construction sites. • Use of screens/nets to avoid flying debris, ensure good housekeeping at the construction sites. • All workers should be provided with appropriate PPE and adequately trained on the use of PPEs which they should wear at all times while at the work/construction site. • Register the site as a construction site as per OSHA, 2007 requirements. Traffic and road safety • Contractor shall avoid peak hours for transport of the construction materials. • Traffic warning signs shall be provided at the access roads to warn road users of heavy vehicles during transportation of construction material and equipment. • Designate traffic marshal to control vehicle movement in and out. This should be done in conjunction with relevant authorities. • Construction vehicles should not park on the road shoulders. The contactor to provide adequate parking within the construction site for vehicles delivering materials. Socio-economic • Economic empowerment to personnel’s who will be employed during the inception, design, construction and operation of the proposed development.
