IT IS notified for the general information of the public that the Cabinet Secretary for Agriculture, Livestock, Fisheries and Co- operatives, pursuant to the provisions of section 8 of the Statutory Instruments Act, 2013, has prepared a Regulatory Impact Assessment on the impacts and likely impacts on the community of the proposed Regulations that is intended for the operationalization of the Fisheries Management and Development Act, No. 35 of 2016. The proposed Regulations is the Marine Fisheries (Access and Development) Regulations, 2022. The proposed Regulations have been made in accordance with section 208 of the Fisheries Management and Development Act, 2016, and their main objective is to provide a framework to ensure sustainable use of the Kenya marine resources. Specifically, the Regulations are intended to — (a) define the modalities and criteria for allowing access to Kenya's marine resources; (b) enable realization of economic benefits from marine resources to the country; (c) provide levies for promoting development of artisanal fishers; (d) establish mechanism for management and cch,:;ervation of marine fisheries: and (e) strengthen monitoring control and surveillance and unregulated fishing within Kenya's marine waters. Any person who is likely to be affected by the proposed Regulations may submit a written memorandum on the proposed Regulations within fourteen (14) days from the date of this notice.
