Maina on 22nd March, 2022 for directions of originating motion 18th March, 2022 brought by counsel for the applicant under section 81 and 82 of the Proceeds of Crime and Anti–Money Laundering Act and Order 51 Rule 1 of the Civil Procedure Rules and all other enabling provisions of the law and upon reading the supporting affidavit of No. 62652 Cpl. Isaac Nakitale and annexures thereof: – Exparte IT IS HEREBY ORDERED: 1. THAT this application dated 18th March, 2022 be and is hereby certified urgent. 25th March, 2022 THE KENYA GAZETTE 2. THAT preservation orders be and are hereby issued prohibiting the Respondent and the Interested Party and/or their employees, agents, servants, representatives or any other persons acting on their behalf from selling, transferring, or disposing off or any other dealing in any other manner with motor vehicle registration number KBU 130N, Toyota Ractis, registered in the name of Auto Direct Limited. 3. THAT an order be and is hereby issued directing the Respondent and/or the Interested Party to surrender the original logbook of the motor vehicle specified in Order 2 above to the Applicant within 7 days herein. 4. THAT the motor vehicle specified in Order 2 above be and is hereby surrendered to the custody of the applicant with immediate effect. 5. THAT an order be and is hereby issued directing the Director General of the National Transport and Safety authority to register a caveat against the records of the motor vehicle specified in order 2 above. 6. THAT the orders shall be for a period of (90) days as provided in Section 84 of (POCAMLA). 7. THAT the shall be served upon the Respondent within 7 days of today’s date. 8.
