THE LAND REGISTRATION ACT

REGISTRATION

WHEREAS Kenya Railways Staff Retirement Benefits Scheme, of P.O. Box 46796–00100 Nairobi in the Republic of Kenya, is the registered proprietor of all that piece of Land Known as L. R. No. 1/437 (Original Number 1/432/3), situate in the City of Nairobi in the Nairobi Area, by virtue of a Certificate of Title registered as IR. 15363/1, and whereas the Deputy Registrar of the High Court of Kenya vide Nairobi Case No. E593 of 2021 consolidated with Application No E627 of 2021 has executed a transfer in favor of Flexus Estates Limited, and whereas the land register in respect thereof is lost/destroyed and efforts made to locate the said land register have failed, and whereas Flexus Estates Limited has obtained a Court Order in the Chief Magistrate Court at Nairobi in Application E073 of 2022 directing the land registrar to reconstruct the register, and whereas Flexus Estates Limited has indemnified against all actions and claims that may be made after reconstruction of the land register, notice is given that after the expiry of the sixty (60) days from the date hereof, the land register shall be reconstructed as provided under section 33 (5) of the Act, provided that no objection has been received within that period.
