THE URBAN AREAS AND CITIES ACT
(No. 13 of 2011)
APPROVAL
IN EXERCISE of the powers conferred by sections 20 and 21 of the Urban Areas and Cities Act; Pursuant to the provision of Section
49 of the County Governments Act; and pursuant to the powers and functions of the Municipality Board under chapter 3.2 of the Rumuruti
Municipality Charter, the Rumuruti Municipality Board vide its Board meeting held on 7th August, 2020, made the following resolutions under Minute No. 3/7/8/2020:
1. That it shall immediately repossess all land that was illegally or irregularly acquired including but not limited to land allotted to persons who subsequently never fulfilled the express conditions of the allotment letters including filing an acceptance and paying the requisite fee within the stipulated timelines. This also includes persons holding leases but have never fulfilled the express conditions of the lease. All such persons should take judicial notice of this gazette notice.
NB/ The Government will take possession of any building constructed on public land.
2. That it shall, in collaboration with the County Executive
Member for Land and Infrastructure, ensure that all constructions within the municipality are done as per the approval given within the provisions of the Physical and Land Use Planning Act. The Board shall seek to be involved in the approval process of all applications for approvals for developments within Rumuruti Municipality.
That all development done or currently being done without requisite approvals as per the provisions of the Physical and Land Use
Planning Act should be brought down by the County Executive
Committee Member for Lands and Infrastructure. Additionally, all development currently being done within Rumuruti Municipality without requisite approvals as per the provisions of the Physical and

Land Use Planning Act should immediately be stopped by the developers to avoid potential losses.
3. That the Rumuruti Municipality Board shall pursue the County
Executive Committee Member for lands with a view of ensuring that all applications for development approvals within Rumuruti
Municipality are responded to within time so as to encourage healthy development.
4. All future land allocation exercises shall follow the existing land allocation procedures including public participation; equity;
equality; sufficient communication; and, fair administration. The board wishes to clarify that no land allocation exercise has been undertaken so far within Rumuruti Municipality since its conferment of special municipality status by His Excellency the Governor.
5. Citizens are encouraged to file any existing land disputes with the Municipal Manager, Rumuruti Municipality.
