THE ENERGY ACT
ESTABLISHMENT
IT IS notified for the general information of the public that the
Cabinet Secretary for Energy has appointed a Taskforce on the
Implementation of the Energy Act, 2019 comprising of—

1. The terms of reference of the Taskforce shall be to—
(a) co-ordinate in consultation with the Cabinet Secretary on the transition and distribution of roles and functions between the Ministry of Energy, Energy Entities and
County Governments;
(b) co-ordinate and advise in consultation with relevant
Government Agencies on the establishment of the new
Energy Entities as stipulated in the Energy Act;
(c) co-ordinate and advise in consultation with relevant
Government Agencies on the establishment of the Advisory
Committees as stipulated in the Energy Act;
(d) identify the immediate, short-term, medium-term and long- term actions for implementation under the Energy Act;
(e) advice on potential areas of conflict in the transition of roles between the Ministry of Energy, Energy Entities and
County Governments and make recommendations on possible solutions;
(f) make any necessary recommendations relevant in advancing the implementation of the Energy Act; and
(g) undertake any task on the implementation of the Energy
Act that may be assigned by the Cabinet Secretary.
2. In the performance of its functions, the Taskforce —
(a) shall hold such number of meetings in the places and at such times as the Task Force shall consider necessary for the proper discharge of its functions;
•
(b) shall solicit, receive and consider views of the members of the public, experts and interested groups and promote constructive stakeholder involvement;
(c) may identify and co-opt any person(s) who possess relevant expertise, skills or experience which it considers necessary and proper to achieve its objective;
(d) may require production, by any relevant person, of any relevant information and document necessary for the implementation and execution of its mandate;

(e) may create committees or sub-committees to expedite the discharge of its tasks;
(f) shall have all powers necessary or expedient for the proper execution of its functions, including the power to regulate its own procedures; and
(g) shall submit to the Cabinet Secretary quarterly reports and a final report at the end of its term.
3. The Taskforce' is appointed for a period of one (1) year with effect from the Lst July, 2019 or for such longer period as the Cabinet
Secretary may, by notice in the Gazette, prescribe.
4. The costs incurred by the Taskforce and the Secretariat of the
Taskforce shall be drawn from the Ministry of Energy and Energy
Sector Entities.
5. The Secretariat of the Taskforce%hall be based at the Ministry of Energy, Kawi House, P. 0. Box 30582-00100, Nairobi.
