GAZETTE NOTICE NO. 6588

WHEREAS water and sanitation services isAa function devolved to and exclusively reserved for county governments pursuant to Article 186 as read together with the Second Part of the Fourth schedule to the Constitution; Section 6 (5) of the County Governments Act empowers the county government to establish or contract any person, company, body or firm it desires for the efficient delivery of its services or undertaking its functions. Murang'a County Government enacted Murang'a County Water and Sanitation Services Act, 2018 which interalia, established Murang'a County Water and Sewerage Services Corporation as the sole legal entity mandated to provide water and sanitation services within Murang'a County. Under section 50 as read with the second schedule to the said Act, the following devolved county water services providers ceased to exist as corporate entities and were constituted as branches of the County Water Corporation; 1. Murang'a Water and Sanitation Company Limited 2. Murang'a South Water and Sanitation Company Limited 3. Gatanga Water and Sanitation Company Limited 4. Kahuti Water and Sanitation Company Limited 5. Gatamathi Water and Sanitation Company Limited 6. Fort Aqua In order to ensure a smooth transition of all employees of the said water services providers to the County Corporation's payroll, the Managing Directors and Heads of Management of the said water services providers are directed to forthwith hand over all their employees and payroll records to the Ag. Chief Executive Officer of the Corporation by the 31st July, 2019 pursuant to section 51 of the said Act. It is further directed that all employees of the above water services providers should report to the Ag. Chief Executive Officer of the Corporation situated at the County Headquarters, Murang'a and furnish all their identification and employment details and obtain their formal letters of appointment by 31st July, 2019. Take notice that in default of compliance, the employee will be deemed to have forfeited his/her job and will be treated as having resigned from employment.
