BOARD ORGANIZATION AND ,MANAGEMENT 1.1 Introduction The Samburu County Public Service Board is established under Article 235 of the Kenya Constitution 2010 and section 57 of the County Governments Act, No. 17 of 2012. The Board is a body corporate with perpetual succession capable of suing and being sued. Specifically, section 59 provides the functions and powers of the Board as follows— (a) establish and abolish offices in the County Public Service of Samburu; (b) appoint persons to hold or act in offices of the County Public Service including the Boards of cities, and urban areas within •the county and to confirm appointments; (c) exercise disciplinary control over, -and remove, persons holding or acting in those offices as provided for under the County Governments Act, No. 17 of 2012; (d) prepare regular reports for submission to the County Assembly of Samburu on the execution of the functions of the Board; (e) promote in the County Public Service the values and principles referred to in Articles 10 and 232 of the Constitution of Kenya (2010); (f) evaluate and report to the County Assembly on the extent to which the values and principles referred to in Articles 10 and 232 are complied with in the County Public Service; (g) facilitate the development of coherent, integrated human resource planning and budgeting for personnel emoluments in Samburu County; (h) advise the County Government on human resource management and development; (i) advise the County Government on the implementation and monitoring of the national performance management Systemi in the County; and 0) make recommendations to the Salaries and Remuneration Commission, on behalf of the County government, on the remuneration, pensions, and gratuities for the County Public Service employees. County Public Service Board Position within the County Government Of Samburu The CPSB is an entity within the County Government of Samburu. Its structural relationships with other entities are illustrated in Figure Figure I : Organogram of Samburu County Public Service Board 1.4 Proposed Establishment in the Board Secretariat The staff requirements for the Board secretariat are given in table below. As can be seen in the table, the Secretariat is not adequately staffed. This is mainly due to the limited budget provision for the Board. ACTIVITIES OF THE BOARD DURING THE YEAR 2018 During the year under review the Board had planned to undertake the following activities as per the Boards mandates. (i) Establish and abolish offices The Board is expected to; Analyze county function areas in line with schedules four and five of the Constitution, other laws and organization of the government. Prepare and review county Organogram and submit to the county assembly for approval. Determine and prepare ideal county staff establishment for county departments. Participate in the county staff headcount exercise. • Undertake skill audit and staff rationalizing. • Determine staff gaps and advise county government or abolishing of offices. (ii) Exercise disciplinary control • Receive and analyze reports from the County Human Resource Management Advisory Committee (CHRMAC) and make recommendations. • Receive and determine appeals from county staff. (iii) Undertake monitoring and reporting • Prepare quarterly reports on the execution of the functions of the Board. • Prepare annual report on operations of the Board to .the County Assembly. • Receive and analyze feedback reports from the County Assembly. • Responding to audit queries to the oversight bodies such as the County Assembly, KENAO, Senate, EACC etc. • Prepare a report to the National Cohesion and Integration Commission on compliance with constitutional requirement, promotion and training. (iv) Values and principles • Prepare Information, Education and Communication (IEC) materials on values and principles. • Adopt, customize and implement the public service code of conduct. • Train TOTs on values and principles. • Sensitize public officers and the county government effective measures to promote the values and principles. • Develop and recommend to the County Government effective measures to promote the National Values and Principles. • Advise the count}, govermnent in the formulation and implementation of programmes intended to inculcate in public officers the duty to uphold the values and principles. • Assess compliance with the values and principles and report to the County Assembly. • Establish and maintain a complaints and complements resolution system. (v) Establish performance management system • Investigate and determine the violation of values and principles by any person or public body and recommend necessary action to the relevant lawful authority. • Administer declaration of income, assets and liabilities on behalf of PSC and EACC. • Sensitize county public service on declaration of income, assets and liabilities. • Design systems for good governance with other public institutions. • Publish and publicize values and principles report in the County Gazette. • Prepare a work plan on promotion of values and principles. • Prepare a report on realization of national values and principles of good governance to the Office of the President. Undertake research on HR best practices. Prepare succession management plans and advise the county government. Map and document relevant treaties and conventions on good governance nationally and internationally relevant to the county public service. Acquainting the Board on relevant treaties and conventions for the county. • Create and manage a database of all county staff. • Sensitize staff on Performance Appraisal System (PAS). • Undertake a Training Needs Assessment (TNA) and implement feasible recommendations. • Undertake oversight surveys to determine clientele, employee and work environment satisfaction levels. • Develop and implement a service charter for the Board. • Analyze personnel emoluments and advise the county government on optimal levels of wage bill. • Oversee the development and implementation of a performance management plane for the county public service by the executive committee. Oversee the implementation of CARPS's feasible recommendations. • Make recommendations to the salaries and remuneration commission on the remuneration, pensions and gratuities for the county public service employees. (vii) Administration support services • Develop and review. Board's Organogram. • Establish positions identified in the Boards' Organogram. • Recruit arid re-train secretariat staff. • Hold a bonding session between the Board and the County Executive. • Hold formal and informal meetings with County Assembly's relevant committees to sensitize members on Board's mandates and functions. • Prepare budget to match the resources with programmes/activities and monitor its implementation. • Develop and maintain a web portal for the Board. • Automate boards record keeping through Document Management System • Networking the CPSB Offices to ensure internet connectivity for effective service delivery. 2.1 Accomplished Board's Activities 2.1.1 Recruitment During the period under revie\v, the Board advertised, shortlisted, and conducted interviews for various vacant positions as requested by Chief Officers of the departments. The Board strived to make appointments in accordance with the constitutional and the County Government Act, No. 17 of 2012 requirements taking into account the distribution among all the sub-counties and wards, gender, youth, minority, marginalized persons, PWDs and people from outside the'county. The Board advertised for 33 posts, received 1041 applications and issued appointment letters to 43 new staff for various departments. The summaries of completed recruitments are givers in Tables 2.1 and 2.2. Recruitment of 42 health staff and 1 deputy county attorney is on-going. A total of 92 out of those appointed are from Samburu Central, 28 from Samburu North and 17 from Samburu East. The county public service board appointed 18 people from outside Samburu County. Appointees from outside Samburu County comprises of persons from Laikipia, Kisii and Machakos counties among others. 2.1.2 Staff Promotions The Board assisted by Chief Officers and Human Resource department, reviewed and analyzed requests for promotions and approved as follows:- Department No. Sports and Youth Affairs 1 Total 1 Only one request for promotion was approved in the previous year. 2.1.3 Confirmation of Appointment During the year under review the Board confirmed staffs that were due for confirmation. The total number of staff confirmed per department is as follows:- (a) Health Services 3 Total 2.1.4 Re-designation There were no any re-designations clone by the county public service board in the previous year. 2.15 Regularization The Governor and the Deputy Governor appointed staff in their offices which were then• regularized by the County Public Service Board during the year. In the year 2018, two staff were regularized. 2.1.6 Service Charter The board proposed a service charter to enhance effective service delivery. 2.1.7 Training and Development The Board attended various courses, workshops, seminars, for capacity building as indicated in Table 2.3. The Board ensured that the staff of the County Government completed the wealth declaration forms as provided for by the Act. The Board has recently gazetted the Procedures for the Administration of Declaration of Incomes, Assets and Liabilities as required by law. The Board endeavours to train all staff on National Values and Principles referred to in Articles 10 and 232 of the Constitution of Kenya (2010). 3. INSTITUTIONALIZATION OF NATIONAL VALUES AND PRINCIPLES OF GOOD GOVERNANCE AND OF PUBLIC SERVICE 3.1 Institutionalization of National Values and Principles As stipulated in Article 59 (1) (e) of the CGA, 2012, the CPSB is mandated to promote in the county public service, the values and principles referred to in Articles 10 and 232 (Kenya Constitution 2010). Section 59 (1) (f) of the County Governments Act, No. 17 of 2012 mandates the Board to carry out evaluation on the extent to which the values and principles have been complied within the county public service. Thus, the Board planned to undertake this noble task in the year (2018). As stipulated in section 104 (4) of the County Governments Act, No. 17 of 2012 the Board is required to incorporate Non-State Actors in planning processes for activities in which the public is expected to participate. The board through the support of the ministry of devolution made available policy documents among them, on the promotion of values and principles of public service. These documents will be documents will be distributed across the county departments and sub counties to help in Informing, Educating and Communicating Values and Principles of the public service for inculcation within the public service. 3.3 Impacts of Relationship between the Board and Stakeholders on the National Values and Principles The National Values and Principles are meant to have attitude change in the way we transact business with public and other institutions the board work with. Lack of them means there will always be breakdown of communication and coordination and as a result it will affect efficient service delivery. The recipients on the end suffer either directly or indirectly. 3.3.1 CPSB and the Executive The Board's functions and Powers as stipulated in Sec 59 of CGA, 2012, have a direct bearing in the way the Members are expected to transact business with the Executive arm of the County Government. The board has been enjoying a cordial relationship with county executive and immense consultations which enhanced smooth running of the two arms. When need arises for recruitment the board receives indents from the respective department requesting personnel's to fill required positions as dictated by budget and department establishments, and upon recruitment the board shares appointment of successful candidates with department to induct and post accordingly. 3.3.2 Public Service Instability of the public officers has been noted with concerns. This is due to pending promotions and disciplinary cases. The board recommends strengthening of Human resource department and the county advisory committee staff issues such as promotions, resignations, and discipline etc. to be enhanced. The board has taken an initiative on staff training on values and principles of governance and public service. The board should contemplate on regular training on these values and principles of governance and public service annually. 3.3.3 County Assembly There has been good relationship with the County Assembly since inception of the board, especially with the respective concern committees. The board has smoothly cooperated with the assembly on various matters of service delivery to the public and staff in accordance to the provisions 4, 5th July, 2019 provided by the law.. The board has interacted effectively with labor, budget, and health committees to clarify, issues arising from the respective departments. Financial Independence of the board is an integral factor in service delivery and its smooth operations rather than keep on relying on treasury for funds disbursements. Issues of mispostings on board's vote book to fund other department leaving board with insufficient funds to operate, was noted with deepest concerns. 3.3.4 The Members of the Public • The public has not fully understood the mandates and functions of the county public service board apart from recruitments, therefore there is a need for Civic education, to sensitize the public on the functions of the board and educate on values and principles of governance and public service as enshrined in article 10 and 232 of the Constitution of Kenya 2010 4. CHALLENGES IN FINANCING THE COUNTY PUBLIC SERVICE BOARD'S MANDATES 4.1 Introduction County Public Service Boards are created by the law. They are then given a host of mandatory duties and responsibilities which they have to accomplish. Among these responsibilities are implementation of Articles 10 and 232 of the Constitution of Kenya on National Values and Principles in the county government. This is designed to be done through preparation of training materials on topical issues and thereafter carrying out civic education to the county public service and the public. The importance of carrying out of this civic education on National Values and Principles cannot be over emphasized. It is a legal requirement that the county public service boards should, report to the county assembly at the end of every calendar year the extent to which this has been undertaken during the year. At the same time, this report should be submitted to the Office of the President which feeds into the Presidential Speech to Parliament sometime in April of every year on the extent to which National Values and Principles has been carried out in the counties and nationally. This analogy of one mandatory duty and responsibility among the many that the county public service board is supposed to undertake just demonstrates the importance of such undertakings in the county and nationally. The County Governments Act, No. 17 of 2012 provides a host of numerous duties and responsibilities that county public service boards are expected to perform. Samburu County Public Service Board has however not undertaken most of such duties and responsibilities in the year under review. The county public service board and the all other departments of the county executive faced numerous financial challenges due to irregular flow of funds from the National Exchequer. This derailed efforts to carry out some of the mandatory duties and responsibilities. The county public service board however, carried out some of its responsibilities among them recruitment of staff as per department requests, staff prqmotion, administering declaration of incomes, assets and liabilities and gazetting the procedures for administration of the same. 42 Activities the Board had planned to undertake in the Year 2018 The Board has a strategic plan whose activities are derived from the expected duties and responsibilities per the Constitution and the County • Governments Act. These modest activities were then designed to be undertaken in. chronological order during each fiscal year. Some of these activities are supposed to be done each year. The planned Board activities are presented in Table 4.1. The table is an extract of activities that were expected to be undertaken during 2018. The county assembly was involved during its preparation and made valuable contributions. OUTLOOK FOR THE INCOMING COUNTY PUBLIC SERVICE BOARD The new Board should have it easy settling down as it will find most of the structures in place such as:- (a) The new Board will find an established Office in place. (b) A number of Secretarial Staff in place (Secretariat not fully established). (c) The incoming Board will have to complete the Strategic Plan 20184022 to enable have a clear road map for implementation of its activities. (d) The incoming Board will be able to carry out functions not carried out by the outgoing Board eithei due to time constraints or lack of resources. (e) The incoming Board should continue with the good existing relationship with the Executive and County Assembly established by the outgoing Board. (f) The incoming Board will have an advantage since two Members of the outgoing Board will be part of the incbming Board. 5.1 Success Story of the Outgoing CPSB •members The Board is established under Article 235 of the Constitution and consists of Chairperson, Secretary and six other members appointed by the Governor with approVal of the County Assembly. In order to appreciated the achievements made by the oiitgoing Board Members it is important to understand the power, functions and mandate of the Board as contained in sections 57 to 86 of the tounty Governments Act, No 1/ of 2012. The outgoing Members came into Office on 4th June, 2013. Since then the Board has endeavoured to fulfil its mandate as contained in the Act. 5.1.1 Board's Achievement since June 2013 Major success story was starting an Office from zero as there was nothing to call, an Office. Initially the CPSB Members were housed at the ECDE Hall but after a short stay moved tothe old County Council Offices near the. County. Education Office which lacked in most basic items such as toilets/washrooms.and water. The Board thereforedecided to rent a house (former KCB Managers House) belonging to Mr, Harun Lesirma for a period of two years awaiting completion of the new CPSB Offices which were completed by mid 2018. Towards the end of 2018 All Board Members, Secretariat and other Board Staff moved into their new offices located between the IEBC and the Department of Water Offices in Maralal. Another success story was the Speed at which the Board came up with the criteria for recruitment process noting that the County Government was relatively new and needed some personnel lo be in the Office at the earliest possible for them to start functioning. These included the Chief Officers, Ward Administrators and ECDE teachers which were urgently required in place. The CPSB also established fairly fast cordial working relationship with both the Executive as well as the County Assembly. This was not only crucial but Critical as so much recruitment was going on hence the need for goodwill from all the parties. . Recruitment of 400 ECDE teachers was a big success story being one of the single largest hiring by the County Government. It should be noted that the Samburu County Public Service Board was among the first to recruit 400 teachers before the High Court halted further recruitment. Recruitment of ECDE teachers involved many players/interest groups and aboVe all ensuring fair distribution in all Wards. 5.1.2 Other Success Story Include:- (a) Recruitment for Health Department in the 1st County Government is (b) Giving Advisory to the Executive whenever need arises (c) At National level, the CPSB Members have participated either as group or individually at County Public Service Boards National Consultative Forum (CPSBNCF) in which their contributions have been immense. CPSBNCF is an umbrella body that brings together all the 47 County Public Service Boards and 5.2 Transition Issues During the Boards Planning Workshop held in Nakuru in September of 2018, various transitions issues were discussed among them:- (a) Advisory to the Governor to start recruitment process of the new Board in good time (b) The outgoing Board to induct the incoming one and (c) Outgoing Board to hand over to the new Board all the reports of work accomplished and pending before leaving the Office.
