Interviews were held from 2nd to 9th May, 2018. Recruitment in the Department of Water Services The department was in dire need of additional casual staff following the recent completion of new water schemes in Mang’ong’o. Chekombero. Bumbo-Shamakhokho and Gidagadi. The shortage of human resource at the water schemes had led to immense loss of tools and equipment. Forty nine officers were engaged on a three months’ non- renewable contract with effect from 1st December, 2018 as the department prepares to advertise the jobs and fill them competitively. Recruitment in the Department of Agriculture, Livestock, Fisheries and Co-operatives The department had engaged seven officers since 1st October, 2018 because of the critical nature of the services that would not have been interrupted after their contracts were terminated pending the filling of vacant positions. The purpose of the policy is to ensure that management of internship programmers in such organizations is appropriate and in line with best practices found elsewhere in the world. Article 10 (2) of the Constitution provides the National Values and Principles of Governance as follows: (a) Patriotism, national unity, sharing and devolution of power, the rule of law, democracy and participation of the people. (b) Human dignity, equity, social justice, inclusiveness, equality, human rights, non-discrimination and protection of the marginalized. (c) Good governance, integrity, transparency and accountability. (d) Sustainable development. Article 232 of the Constitution further provides for the principles that inform public service which include; (a) High standards of professional ethics. (b) Efficient. (c) Effective and economic use of resources. (d) Responsive, prompt, effective, impartial and equitable provision of services. (e) Accountability for administrative acts. (f) Transparency and provision to the public of timely, accurate information; fair competition and merit-based appointments and promotions. (g) Public participation in policy making processes. (h) Representation of diverse communities. (i) Affording adequate and equal opportunities for appointment, training and advancement at all levels of public service of men and women the members of all ethnic groups and persons with disabilities. These principles are binding on all State organs, State officers, public officers and all persons whenever any of them applies in public policy decisions. The County Public Service Board is mandated to ensure the implementation of these values and principles in the county public service. This is a follow up on a similar workshop which was conducted during 2016/2017 Financial Year. (a) The Board is scheduled to conduct the public awareness and sensitization program on 10th to 14th January, 2019 for the two documents meant to guide promotion of Values and Principles in the County. These documents are; (i) Curriculum for Public Awareness and Participation. (ii) County Public Service Board Training Manual. (b) The Board is also scheduled to conduct training on the Principles and Values early 2019 to the Cabinet Executive Committee Members, Governor’s advisors, chief of staff, chief officers and the County Director of Human Resource. The Board awaits communication on the same from the office of H.E. the Governor through the office of the County Secretary. (c) On 13th to 15th June, 2018 the Board organized a workshop for the Secretariat which was themed,” Familiarization with the County Public Service Board mandate and what it entails to be a public servant.” One of the topics handled was adherence to the values and principles of governance and public service as espoused in Articles 10 and 232 of the Constitution of Kenya, 2010. On several occasions, the Board requested for reports on changes made on the payroll but the request had been denied as many times. On 27th September, 2018, the Chairperson, The Secretary and a member of the Board, made an impromptu visit to the payroll department and found that the principles of governance had been violated. Two individuals that had not gone through the officially authorized process were to be added on the payroll. However, the authorization and letters of appointment had been done by the County Secretary. The Board sought an explanation from the County Secretary who has since been interdicted by the Governor on this account. The matter is before The Employment and Labour Relations Court Kisumu, as petition No. 72 of 2018. The Board has advised the Department of Public Service and Co-ordination of County Affairs to urgently undertake a payroll clean up with an objective of weeding out all illegal additions to the payroll. (iii) Evaluate and report to the County Assembly on the extent to which the values and principles referred to in Article 10 and 232 are complied with in the county public service. • Compliance with 30%; 70% rule, minorities, youth and women; a comparison of those who applied versus those shortlisted and the employed. Celebration of the Life of the Late Naomy Ruth Esiaba On 13th April, 2018 the Board was saddened by the sudden demise of Madam Naomy Ruth Esiaba. Naomy was sworn in as a member of the Board on 21st June, 2013 and served with passion and diligence till her death. She served as the chairperson of the Public Awareness and Sensitization Committee with vigor and dedication, was very professional and well informed. The Board will miss her and pray that God rests her soul in eternal peace. Meetings with the County Assembly The County Assembly performs an oversight role on the activities of the Vihiga County Public Service Board. The Board regularly meets the relevant County Committees to inform and update the Assembly on execution of its mandate. On the 18th January, 2018 the Board met the Committee on Public Service and Administration to give information the roles and duties of staff in the Office of the Governor. The Board appeared before an ADHOC committee on 30th January, 2018 to give information on recruitment matters at the County Executive during the electioneering period if there were any by the County Public Service Board or any department and the nature of financial transactions and expenditures during the transition period 1st April to 30th September, 2017. On 17th May, 2018 the Board met the Committee on Public Service and Administration to deliberate on staff establishment since 2014. The Chief Executive Officer of the Board met the Budget and Appropriations Committee to discuss the Vihiga County Public Service Board Budget estimates for financial year 2018/2019. On 7th June, 2018, the Board also met the Committee on Public Service and Administration over the operations of the Board and the current status of employees at the County Executive. On the 21st November, 2018 the Board met the Committee on Public Service and Administration to give information on the progress of the jobs advertised on 31st October, 2018 by the Department of Trade Industry, Tourism and Entrepreneurship. Meetings with the Governor In order to establish a harmonious working environment, the Board has had several meetings with the Governor, Dr. Wilber K. Otichillo. In October, 2017 the Board had a familiarization meeting with the Governor, Dr. Wilber K. Otichillo at the Board’s boardroom. On 9th January 2018 and 12th April, 2018, the Board met with the Governor, Dr. Wilber K. Otichillo during the presentation of the DPSM staff audit report. In the meeting held on 27th September, 2018 the issues discussed included the documents that the Board had developed and were about to be launched; the Board Charter, Curriculum for Public Awareness and Participation , Disciplinary Process Flow ,Recruitment Policy, Internship Policy and Attachment Policy. Promotions In the year 2018, the Board has promoted officers serving at the Public Service Board and Department of Agriculture, Livestock, Fisheries and Co-operatives. The requests from the department of Trade, Industry, Tourism and Entrepreneurship had gone through the due process. Reference was made to the circular from the Salaries and Remuneration Commission effective 1st July, 2018 and it was noted that this are the only salary scales acceptable in public service both at National and county level. The officers recommended for promotion were from the defunct local authority salary scale hence require more detailed information in order for the Board to take appropriate action The matter has been referred back to the Departmental Human resource committee. Board’s Documents In an effort to enhance efficiency and effectives in service delivery, the Board has developed the following documents and are ready for public participation which is scheduled for 10th to 14th January, 2019: 25th January, 2019 THE KENYA GAZETTE (a) A procedure for Administration of Part IV of the Public Officers’ Ethics Act (No. 4 of 2018).This document has already been submitted to the Government Printers for gazettement. County Public Service Board Training Manual. Board’s Office Space The Board members had identified office space within Mbale Town, the lease agreement negotiation as well as renovations were on going. Ground floor had been occupied though the Board expressed interest in leasing it because people with disabilities are likely to visit her offices. However, the owner agreed to put up a ramp for easy mobility of people with disabilities. The Nurses’ Strike In the month of December, 2017, the Department of Health Services initiated transfers of its officers to various centers. The officers redeployed felt aggrieved as they felt that the consultations made were inadequate and the notice too short to effect the said changes. They claimed that the proposed postings had created anxiety because they were to be effected over the Christmas holiday and viewed the action as victimization against them.The Kenya National Union of Nurses consequently filed a court case at the Employment and Labour Relations Court of Kenya at Kisumu against The Vihiga County Public Service Board and the Vihiga County Government. On 9th January, 2018, The Honorable Court, through Lady Justice Hellen Wasilwa made an order and directed the parties to the dispute to first explore Alternative Dispute Resolution mechanisms and involve the Public Service Board, whom the Union had ignored before filing the case. The Vihiga County Public Service Board thus took up the mantle and guided the process, bringing an amicable solution unanimously agreed on by both the Management and the unionized employees in the Health Department and in the presence of the KNUN .The agreed on Resolution was registered in the Court. This was a great milestone as it prevented a looming strike and ensured a smooth delivery of services to the citizens of Vihiga County. The First Board’s Tenure Comes to an end The Vihiga County Public Service Board was established on 21st June 2013, under Article 58 of the County Government Act, (2012) on a six years’ non- renewable contract. The Chairperson, the Vice Chairperson and the Board members term of service is lapsing in the month of June 2019.It is expected that new Board members will be recruited and inducted mid-2019. Challenges 1. The Board’s budget: (a) Has decreased significantly from KSh. 82M in 2014/2015 to the current KSh. 52.5M. This has strained its ability to deliver services and request the Honorably County Assembly to reconsider improving it upwards to Kshs.100 M in order to increase its efficiency and effectiveness. (b) Several legal suits have been placed against the Board; however the Board has a limited Budget for this and is a matter of concern to the Board. 2. Office space: The Board was allocated Kshs 2M for rent, and has identified some space that would adequately serve its needs. However, if this is enhanced, The Board can purchase land and construct offices for posterity. 3. Chapter 10 and 232 of The Constitution emphasizes the need of inclusion people living with disabilities amongst other marginalized groups. The Board in its advertisement does specifically encourage them to apply. However, few apply but lack the prerequisite competencies required for the posts applied for. 4.
