IT IS notified for the general information of the public that the Cabinet Secretary for Tourism and Wildlife has appointed the Work Permit Vetting Committee for the Tourism and Hospitality Sector, to vet expatriates seeking employment in the Sector in Kenya which shall comprise of: The Principal Secretary for Tourism —Chairperson Members: • representative of the State Department of Tourism A representative of the State Department of Immigration • representative of theTourism Fund • representative, of the Kenya Hotel Owners and Catering Association • representative of the Kenya Association of Tour Operators Secretariat: Four (4), representatives from the State Department of Tourism One representative from the Tourism Fund The Terms of Reference of the Vetting Committee shall be to- vet and recommend expatriates seeking employment in the tourism and hospitality sector; encourage foreign exchange programs for Kenyans and vice versa for exposure with the expatriates; ensure that employers in the tourism and hospitality sector have submitted up-to-date returns on expatriates employed by their respective establishments; with respect to any vacancy other than a vacancy ieser'ed for an investor in the tourism and hospitality sector to protect the investor's interests, ensure that employers have 'made all reasonable efforts to employ Kenyans without success; ensure that applicants seeking work permits for employment in the tourism and hospitality sector possess unique competencies, qualificatioqs and skills that are not available in Kenya; (fl ensure that employers have identified suitable qualified Kenyans to undergo the necessary training or to understudy the expatriates with the aim of taki'ng over the position occupied by the expatriate within the period specified in the guidelines and criteria; exercise any due diligence necessary to ensure compliance of the yetting requirements by all parties; and any other function as may be directed in writing by the 'Cabinet Secretary. 2. For the purpose of performing its functions, the Committee- shall hold its meetings once in each month at such places and at such times as the Committee shall consider favourable; may co-opt such other persons as it considers necessary for the performance of its functions; and shall , subject to the Act, regulate its own procedure.
