Pursuant to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Beech Properties LLP, is proposing to develop a Purpose Built Student accommodation comprising two blocks: Block A consisting 14 floors and Block B consisting 16 floors. The blocks will contain student accommodation studios (residential units), manager’s office, reading rooms, lift lobby, water feature, refuse holding room, laundry, generator section and associated amenities. The following are the anticipated impacts and proposed mitigation measures: Impacts Proposed Mitigation Measures Noise pollution • Ensure that all vehicles and construction machinery are kept in good condition all the time to avoid excessive noise generation. • Ensure that all workers wear ear muffs and other personal protective gear/equipment when working in noisy sections. • Undertake loud noise and vibration level activities during off-peak hours during the day (i.e. preferably between 12.00 noon and 2.00 p.m.). • Comply with conditions provided by the Environment Management and Co- ordination, Noise and Excessive Vibrations Pollution Control Regulations, 2009. Air pollution • Dust control measures should be adopted by providing adequate PPE to staffs, canopying loading points and erecting dust screens around buildings under construction. • Sprinkling water on earth surfaces within the project site. • Slowing the speed of traffic by using clearly marked road signs. • Covering heaps and berms of soil. • Adhere to the Environmental Management and Co-ordination (Air Quality) Regulations, 2014. Increased solid waste generation) • Use of an integrated solid waste management system through a hierarchy of options: source reduction; segregation to encourage reuse and recycling; composting and land filling. • Provision of bottle and can trash disposal receptacles at parking lots to avoid littering. • Composting of vegetation waste for reuse as a landscaping fertilizer. • Management of all removed paint materials suspected or confirmed of containing lead as a hazardous waste. • Sub-contract a licensed waste handling firm to collect solid waste on regular basis and dispose of in approved dumping sites. • Comply with provisions of the Environmental Management and Co- ordination, Waste Management Regulations, 2006. Increased wastewater generation • Use sediment traps and drainage to control the flow and velocity of runoff from work sites. • Potential pollutants of any kind and form, shall be kept, stored and used in such a manner that any escape can be contained. • Promote recycling of treated wastewater and storm water. • Install meters to monitor consumption rates of water. • Ensure regular maintenance of plumbing systems to avoid spillage of raw sewage. • Comply with the Environment Management and Coordination, Water Quality Regulations, 2006. Increased water abstraction and consumption • Use of water efficient technologies such as automatic taps and dual toilet flush cisterns. • Rainwater harvesting through installation of gutters on the roofs. THE KENYA GAZETTE 23rd November, 2018 4184 4184 Impacts Proposed Mitigation Measures • Construct underground reservoir for storage of harvested rain water. • Drilling of borehole for use to reduce over reliance on water from existing sources. • Adhere to water quality regulations described in Legal Notice No. 120 of the Kenya Gazette Supplement No. 68 and Water Act, 2016. Social ills including immorality and drugs and substance abuse • Have a counsellor to offer guidance and counselling as part of the PBSA management team. • Partner with surrounding institutions of learning / Universities and relevant government bodies to offer / support short courses on social interaction and social studies in general. • Support surrounding institutions of learning with sensitization programs such as alcohol and substance abuse during calendar events such as cultural weeks. • Support HIV/AIDS Awareness and education. This can be done by educative posters, offering free HIV/AIDS testing services, HIV/AIDS counselling and issuing of condoms within the PBSA and neighboring institutions of higher learning. • Ensure hostels are drug free zones as per respective legislations including Tobacco Control Act, 2007 and Alcoholic Drinks Control Act, 2010. • Implement the developed code of conduct for students Occupational safety and health risks • Enforcing adherence to safety procedures and preparing contingency plan for accident response in addition to safety education and training. • Ensure that machinery, equipment, personal protective equipment, appliances and hand tools used in construction do comply with safety and health standards and be appropriately installed, maintained and safeguarded. • Ensure there are adequate and serviced firefighting equipment such as fire extinguishers. • Design suitable documented emergency preparedness and evacuation procedures to be used in case of an emergency. • Comply with the relevant legal provisions as per Occupational Safety and Health Act, 2007.
