IT IS notified for the information of the general public that the Cabinet Secretary for Labour and Social Protection has, for the purpose of protection of orphans and other vulnerable children in line with Article 53 of the Constitution of Kenya 2010, establishes a Steering Committee to review the existing legal, policy and institutional framework for child protection in Kenya. 1. Terms of reference of the Steering Committee The terms of reference of the Steering Committee are to— (a) review the existing legal, policy and institutional framework for child adoption, foster care and guardianship in Kenya and assess its effectiveness in ensuring the protection of children; (b) identify gaps in the existing legal, policy and institutional framework governing adoptions,foster care and guardianship in the country and recommend the best practices for child adoption, foster care and guardianship to ensure adherence with internationally recognized standards, the Hague Convention and the Children Act, 2001; (c) establish the extent to which adoption, foster care and guardianship in Kenya are linked to child trafficking, including the trends, agencies or persons involved in child trafficking and recommend appropriate measures to curb the problem; (d) recommend mechanisms for the prevention of the sale and trafficking of children in local and inter-country adoptions, foster care and guardianship and for the effective monitoring and evaluation of adoption, foster care and guardianship services in the country : (e) make recommendations on a comprehensive policy on the adoption, foster care and guardianship of children; (f) establish the status of Orphans and other Vulnerable Children (OVCs) in Kenya and make recommendations on their protection; and (g) advise the Cabinet Secretary on the implementation of the Report of the Steering Committee on Child adoption in Kenya. 3. Mode of operation In the performance of its functions, the Steering Committee— (a) shall report to the Cabinet Secretary for Labour and Social Protection and shall regularly keep the Cabinet Secretary apprised on its progress; (b) shall hold such number of meetings in such places and at such times as it may consider necessary for the proper discharge of its function; (c) may receive and consider views from members of the public; (d) shall regulate its own procedure; (e) shall submit a final report to the Cabinet Secretary within one year of its appointment; and (f) may undertake any other activities required for the proper performance of its functions. 4. Duration The term of office of the Steering Committee shall be twelve (12) months with effect from the date of this notice. 5. Costs The costs incurred by the Steering Committee including but not limited to facilitation and payment of allowances in respect of the Secretariat and members of the Committee, shall be defrayed from the voted funds of the Ministry of Labour and Social Protection. 6. Secretariat The Secretariat of the Steering Committee shall be based at Child Welfare Society of Kenya. Dated the 19th October, 2018.
