WHEREAS Jeremiah Muviku Kyalo, of P.O. Box 1727-90100, Machakos in the Republic of Kenya, is registered as proprietor of all that piece of land known as Kalama/NziuniI341, situate in the district of Machakos, and whereas the senior resident magistrates' court at Machakos in succession cause No. 354 of 2017, has ordered that the said piece of land be transferred to Susan Mbithe Kyalo, of P.O. Box 1727-90100, Machakos, and whereas the said court has in pursuance to an order of the said court executed the grant and confirmation of the said piece of land in favour of Susan Mbithe Kyalo, and whereas all efforts made to compel the registered proprietor to surrender the land title certificate issued in respect of the said piece of land to the land registrar have failed, notice is given that after the expiration of thirty (30) days from the date hereof, provided no valid objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with the registration of the said instrument of transfer and issue a land certificate issued to Susan Mbithe Kyalo, and upon such registration the land title deed issued earlier to the said Jeremiah Muviku Kyalo, shall be deemed to be cancelled and of no effect.
