PURSUANT to section 37 of the Leadershtp and Integrity Act, 2012 the County Assembly of Kirinyaga prescribes the following Code. PART I-PRELIMINARY Citatiort l. This Code may be crted as the kadership and Integrity Code for State Officers rn the County Assembly of Ktnnyaga. Commencement 2. This Code shall come into operation wrthin seven (7) days of its publication. Interpretation 3. In this Code, unless the context otherwise requires- "Act" means the kadership and Inrcgnty Act.20l2; "Clerk" means the Clerk of the County Assembly, or. rf the Clerk is absent. or if the office is vacant, such other person as is for the time being performing the duties of the Clerk; "Assembly" means the County Assembly of Krrinyaga and includes its Committeesi "Speaker" means the Speaker of the County Assembly elected under Artrcle 178 of the Constitution and includes the Deputy Speaker or any other Member when presiding over the Assembly pursuant to Article 178(2)(b) of the Constitution; "bank account" has the meaning assigned to it under section 2 of the Act; "Code" means the Leadership and [ntegrity Code f<rr State OfTicers in the County Assembly of Kirinyaga; "Commission" means the Ethics and Anti-Coruption Commission established under section 3 of ttre Ethrcs and Anti-Comrption Commission Act. 201 I . "personal interest" means a matter rn rvhich a State Officer has a direct or indirect pecuniary or non-pecuntary interest and tncludes the interest of his or her spouse, child, business associate or agent; "public officer" has the meaning assigned to lt under Article 260 of the Constitution; "Regulations" means the Regulations made by the Commission pursuant to section 54 of the Act. "serving State Officer" means a State Officer rvho ts in office at the tlme of commencement of this Code; "State Officer" means a Member of the Coullty Assembiy of Kirinyaga; Application oJ the Code 4. This Code applies to all State Officers in the Assembly. Application of the Constitution and other law's 5. (1) The provisions of Chapter Srx of the Constitution shall form part of this Code. (2) Unless otherwrse provrded in this Code, the provisions of the Public Officer Ethics Act and any other relevant law shall form part of this Code in so far as they conform to the provtstons of the Act. State Officer to sign Code 6. (1) A State Ofllcer shall sign a declarahon of commitment to this Code at the time of taking oath of office or wrthia seven (7) days of assumrng office. (2) A serving State Officer shall sign a declaratton of commttment to this Code within seven (7) days of its pubhcation. (3) The declaration of commitment to the Code shalltake the form and structure set out in the First Schedule. PART II-R.EQUIREMENTS Rule of ktw 7. (1) A State Officer shall at all times rcspect and abide by the Constitution and all other laws. (2) A State Officer shalt carry out the duties of his or her office in accordance with the larv. (3) In carrying out the duties of his u her office, a state officer shall not violate the rights and fundamentarl freedoms of any person. Public trust. ti A State Office is a position ofpublic trust and tle authority and responsibility vested in a State Officer shall be exercised by the State Officer in the best interest of the office and the people of Kenya. Pe rson a I re sponsbili4' fo r c onse quence s 9. Subject to the constitution and any other [aw. a State Officer shall take personal responsibility, for the reasonably foreseeable cohsequences of any actions or omssions aristng from the discharge df the duties of his or her office. Perfttrnnnce of duties. I 0. A State Officer shall, td the best of his or her ability - (a) carry out the duties of,the office efficiently and honestly: (b) carry out the duhes of the office in a transparent and accountable manner; (c) keep accurate records and documents relating to the functions ofthe office; and (d ) report truthfully on all malters of the office. Pntfessionolism I l. A Stare Officer shall- (a) carry out the dutres of his or her office in a manner that maintains public confidencc in the integrity of the off,tce: (b) treat members of the public, staff and other state and public officers with courtesy and respect; (c) to the extent appropriate to the offloe, marntain high standards of performance and professronahsm within the Assembly; and (d) if the state officer is a member of a professional body, observe and subscnbe to the ethical and professional requirements of that body in so far as the requirements do not contravene Constiution,any other law or this Code. Confidentiality 12. Subject to Article 35 of the Constitution and any other relevant law. State Officer shall not disclose or cause to be disclosed any information in his or her custody to any unauthorised person. Financial integrity 13. (l) A State Offlcer shall not use his or her office to unlawfully or wrongfully enrrch himself or herself or any other person. (2) SubJect to Article 76 of the Constitution, a State Officer shall not accept a personal loan or benefrt which may compromise the State Officer in carrying out his or her duties. (3) A State Officer shall submit an initial declaration of income, assets and habrlities within thrrty days of assuming office and thereafter make biennial declaratrons to the Assembly, and a final declaration wlthrn thirty (30.1 days of ceasing to be a state Officer. (5) The declaration in paragraph (3) shall be accessible to the Commrssron and any other person, subject to the provrsions of section 30 of the Pubhc Officer Ethics Act, 2003. (6) A State Officer shall pay any iaxes, loans or other debts due from him within the prescribed period. (7) A State Officer shall not neglect their financial, family or other Iegal obligatrons. Moral and etltical requirements 14 (1) A State Offrcer shall- (a) demonstrate honesty in the conduct of hrs or her public and private affairs; (b) not engage in activities that amount to abuse of office; ^i I lst September,2OlT t-h-q--+ THEKENYA GAZETTE 5039 (e) U) G) (h) tt) accurately and honestly represent information to the public; not engage in wrongful conduct in furthcrance of personal benefit; not misuse public rcsources; not falsify any records; not sexually harass or have in4propriate sexual relations with other State Officers, staff of the Assembly or any othcr person; not engage in actions which would lead to the State Officers removal fircm the membership of a professional body in accordance with the law; not engage in fighting or physical confrontation with any person; and (j) maintain high standards of euquette at all times (k) not commit offences and in particular. any of the offences under Parts XV and XVI of the knal Codc (Cap. 63), thc Sexual Offences Act (No. 3 of 2N6), the Counter- Trafficking in Persons Act (No. 8 of 2010), and the Children Act(Cap.141). Gifts or beneftts in kind 15. (l) A gift or donatirm given !o a Stala Offrcer on a public or offrcial occasion shall be treated as a gift or donation to the Assembly. (2) Notwithstanding subsection (l) a State Officer may receive a gift given to the State Officer in official capacity, provided that- (a) the gift is within the ordinary bounds of pnrpriety, a usual expression of courtesy or protocol and within the ordinary standards of hospitality ; (b) the gift is not monetary; or (c) the gift does not exceed the value ofKenya Shillings twenty thousand or such other amount as may be prescribed by the Commission through Regulations. (3) A State Officer shall not- (a) accept or solicit gifts, hospitality or other benefits from a person who- (i) has an interest in any matter under consideration by the Assembly; (ii) has a contractual relationship with the Assembly; (iii) has any interest that is directly or rndirectly connected with the State Officer's duties. (b) receive a gift which has the potential of compromising his or her integrity, objectivity or impartiality or; ( c ) accept any type of gift expressly prohibitcd under the Act. (4) A State Officer who receives a gift or donation shall declare the gift or donation to the Speaker within seven (7) days of rcceipt of the gift ln the form provided in the second schedule. (5) The Clerk shall maintain a register of all gifts received by the State Officers serving in the Assembly and another register of all gifts given by the Assembly to other State or Public Officers. Wrongfiil or unlawful acquisition oJ property 16. A State Officer shall not use his or her position to wrcngfully or unlawfirlly acquire or influence the acquisition of public or other prop€rty. Conflict oJ interest 17 . ( 1) A State Officer shall use the best efforts to avoid being in a situation where his or her personal intercsts conflict or appear !o conflict with his or her official duties. (2) Without prejudice to the genoraliry of subsection (l) a StaE Officer shall not hold shares or have any other interpst in a corporation, pannership or other body, directly or through another person, if holding those shares or having that interest would rosult in a conflict with his or her official duties. (c) (d) (3) A State Officer whose personal interests conflict with his or her official duties shall dcclarc the personal interest to thc Spcakor or thc Chairperson of a Committee ac the case may be in thc form provided in thc third schedulc. (4) Wherc a State Officer is prcsent at a mecting, and an issue which is likely to result in a conflict of int€rest is to be discussed, the Stae Offrccr shall declare thc inerest at the beginning of the meeting or bcforc the issue is deliberatcd upon aad thc declaration shall be recordcd in lhe minutes of that meeting. (5) Thc Speaker may give directions on the approprietc action to b€ takcn by the State Officer to avoid the conflict of intcIest and the Starc Officer shall comply with the directions, and refrain from participating in any deliberations with rcspcct @ dre mattff. (6) dny direction given under subparagaph (5) shall be in writing. (7) Notwithstanding any directions to the contrary under subparagraph (5) a State Officer shall not influence the award of a contrrct to- (a) (b) (c) (d) himself or herself; the State Officer's spouse or child; a business associate or agent; or a corporation, privaE company, partnership or othcr body in which he or her has a substantial or controlling intcrcst. (8) The Clerk shall maintain a register of conflicts of interest in thc pescribed form in which an affected State Officer shall rcgiser thc particulars of the registrable intorests, stating the naturc and oxEnt of thc conflict. (9) For purpo8es of paragraph (8), the registrablc intcrcsts include - (a) the intercsts set out in thc second schedule of the Acq (b) any connection with a person, finn or a company, whcthcr by nelation, friendship, holding of shares or otherwisc, which is subject of an investigation by the Constihrtion; (c) any application for employment or other form of elgagemcnt with the Assembly by a family member or friend of drc State OfFrcer or by a firm or corporation associated with the State Offrcer; (d) any application to the Assembly, by a family mcmber or friend of the State Officer, for clearance with rcspect !o appointment or election to any public officc; and (e) any other matter which, in the opinion of thc StaE Officer, taking into account the cireumstances thcrtof, is nocessary for registration as a conflict of interest. (10) The register ofconflicts of interest shall bc rttaincd for hve years after the last enory in each volumc of tlte rcgistcr. (11) The Clerk shall preparc a report of thc rcgistercd interEsts within thirty (30) days after the close of a financi'al year. (12) A State Officer shall ensure that an entry of registrable interests under paragraph (8) is updated and to not'rry the Clerk of any changes in the registrable interests, within onq month of each change occuning. Participation in tenders invired by the Asscmbly 18. (1) A State Officer shall not participBt€ in a tender for the supply of goods or services to the Assembly. (2) Notwithstanding subsection (l) a company or entity associatcd with the State OfFrcer shall not bc construcd as trading wift the office, unless - (a) the State Ofhcer has a controlling shareholding in the company or entity; (b) tho SlaE Officor is a director of the company; or (c) 6c State Officer is a managing partner in a law firm providing services to the Assembly. Public collections I 9 . ( I ) A State Officer shall not solicit for contributions from the Assembly or any other person or, public entity for a public purpose ( <4d--Ga unless the President has, by notice in the Gazette, declared a national disaster and allowed a public collecti,on for the purpose of the national disaster in accordance with the law. (2) A Stat€ Officer shall not participate in a public collection of funds in a way that reflects adversely on the State Officer's integrity. impartiality or interferes with the performance of his or her official duties. (3) Nothing in this clause shall be construed as prohibiting a State Officer from making a voluntary contribution. Bank accounts outside Kenya 20. (1) Subject to Anicle 76(2) of the Constitution or any other written law, a Statc Offrcer shall not open or continue to operate a bank account outside Kenya without thc approval of the Commission. (2) A Stat€ Officer who has reasonable grounds for opening or operating a bank account outside Kenya shall apply to the Commission for approval to open or operate a bank account outside Kenya. (3) A State Officer who operates or controls fte o,peration of a bank account outsidc Kenya shall submit statements of the account annually to the Commission and authorize the Commission to verify the statements and any other rclevant information from the foreign financial institution in which the account is held. (4) Subject !o subsections (l)and (2), a State Officer who prior to his or her assumption of officc in the Asscmbly, had a bank account outside Kenya, shall upon assumption of office close the bank account within 3 months or such other period as the Commission may prescribe by notice in the Gazette (5) Subject to subsection (4) a State Officer may open or continue to operate a bank account outside Kenya as may bc authorized by the Commission in writing. Acting for foreigners 21. (l) A State Officer shall not be an agent of, or further the interests of a foreign govemment, organization or individual in a manner that may be defimental to the security interests of Kenya, except when acting in thc course of official duty. (2) For the purposes of this section- (a) an individual is a foreigner ifthe individual is not a citizen of Kenya; and (b) an organization is foreign if it is estabtshed outside Kenya or is owncd or controlled by a foreign govemment, organisation or individual. Care oJ property 22. (l) A Stat€ Offtcer shall take all reasonable steps to ensurc that public prop€rty in his or her custody, possession or control is taken care of and is in good repair and condition. (2) A Stat€ Offrcer shall not usc public property, firnds or services that arc acquired in the course of or as a result of his or her official duties, for privarc activities or activities that are not related to the official work of the State Officer. (3) A Stat€ Officcr shall retum to the Assembly all the public prop€rty in his or her custody, possession or conEol at the end of his or her tcrrn. (4) A Starc Officcr who confiavcncs subsections (2) or (3) shall, in addition to any other pcnalties provided for under the Constitution, the Act or any other law, bc personally liable for any loss or damage to public property. Misuse oJ ffic ial information 23. (l) A Statc Officcr shall not directly or indirectly use or allow any pcrson undcr the officer's authority to use any information obtaincd through or in connection with the Assembly, which is not availablc in thc public domain, for the furthering of any private intcrcst, whcthcr financial or otherwise. (2) A Statc Officcr shall not bc dcemcd to have violated the rcquirements of subscction (l), if thc information is given- (a) puBuanttoacourtordcr; (b) for purposcs of cducational, rcscarch, literary, scicntific or othcr purposcs not prohibitcd by law; or (c) in complirncc with Article 35 of the Constitution rnd the rclcvent lew. Impartiality 24. A State Offrcer shall, at all times, carry out his or her duties with impartiality and objcctivity in accordance with principlcs and values set out in Articles 10, 27,'13 (2) (b) afi232 of the Constitution and shall not practice favouritism, ncpotism, tibalism, cronyism, religious bias or engage in other preferential reatmcnt of another State Officer, Public Officer or a member of the public. Giving oJadvice 25. A State Officer who has a duty to givc advice shall give honest, accuratr and impafiial advice without fear or favour. Offe r s oJ fu tur e e mp loyme nt 26. (1) A State Officer shall not allow him or hersclf to be influenced in the performance of his or her duties by plans or expectations for or offers of future employment or benefits. (2) A State Officer shall disclose, in writing, to the Commission, all offers of future employment or bcncfits that could place the State Officer in a situation of conflict of interest. Formcr State Olfrcer in the Assembly 27. A former State Officer shall not be engaged by the Assembly in a matter in which the State Officer was originally engaged in as a State officer, for at least two (2) years after leaving thc Assembly. Misleading the public 28. A State Offrcer shall not knowingly give false or misleading information to any person. Falsifi c ation of r e c ords 29. A State Officer shall not falsify any records or misrepresent information to ttre public. Conduct of private affairs 30. A State Officer shall conduct his or her privarc affairs in a manner that maintains public confidcnce in the integriry of the offrce. Bullying 31. (1) A State Officer shall not bully another State or Public Officer or any other person. (2) For purposes of subsection (1), "bullying" includes repeated offensive behavior which is vindictive, cruel, malicious or humiliating and is intended to undermine a p€rson. Acting through others 32. (1) A State Offrcer shall not- (a) cause anything to be done through another pcrson that would constitute a contravention of this Code, the Constitution or any other law if done by the State Officer; or (b) allow or direct a person under their supervision or control to do anything that is in contravention of this Code, the Constitution or any other law. (2) Section (1) (D) shall not apply whcre anything is done without the State Officer's knowledge or conscnt or if the State OfFrcer has taken reasonable steps to prevent it. Reporting improper orders 33. If a State Officer considcrs that anything requircd of them is in contavention of the Code or is otherwise improper or unethical, the State Offrcer shall report the matter to thc Commission who will take appropriate action. Duty to prevent occurrence oJ corruption or unethical practice in the Assembly 34. A State Officcr who bclieves or has reason to bclicvc comrpt act or unethical malpractice has occurrcd or is about !o occur in the office shall take all necessary measures to prevent it from continuing or materializing in addition to any other appropriate action. Use of social media 35. A State Officer shall not use social media in a manner that is prejudicial to public interest, national cohcsion or that otherwise constitutes a breach of any law. (1) A State Officer shall not unduly influence or attempt to unduly influence the decision of any other State Officer, Public Officer or public entity on any matter. (2) A State Officer shall not in any way interfere with the dutics of any other State Officer, Public Offrcer or public entity. Provisions relating to the implementation oJ projects 38. (1) A State Officer shall in the exercise of oversight over implementation of projects not interfere with such implementation in any way. (2) A State Officer shall not demand or accept any kickbacks, gifts, benefits or other favours from contractors or other persons or entities who are engaged in the implementation of projects. Enforcement of the Code 39. (l) Any person may lodge a complaint alleging a breach of this Code by a State Officer to the Assembly or to the Commission. (2) Breach of this Code amounts to misconduct for which the State Officer may be subjected to disciplinary proceedings including removal from office; (3) Where a Breach of this Code amounts to violation of the Constitution, the State Offrcer may be removed from the office in accordance with the applicable laws. (4) Where an allegation of breach is made to the Assembly, the person alleging the breach shall submit a petition setting out the grounds and facts of the alleged violation to the Clerk. (5) Upon rcceipt of the Complaint, the Assembly shall register and carry out investigations into the complaint, and rpay take action against the State Officer in accordance with the Act, Standing Orders ,any Regulations made by the Commission under the Act or the law that for the time being govems the conduct of State Officers in the Assembly. (6) If upon investigation inlo the alleged breach of the Code, the Assembly is of the opinion that civil or criminal proceedings ought to be preferred against the respective State Officer, it shall rcfer the matter to- (a) the Commission, with respect to civil matters; and (b) the director of Public Prosecutions with respect to criminal matters, (7) Where the complaint is made to the Commission, the Commission shall take such action against the State Officer as it deems necessary in accordance with its mandate under the law. (8) Notwithstanding subsection (5), the Commission may, subject to the law, take any additional action it deems appropriate in relation to any breach of the Code. (9) The Speaker may, in accordance with the law for the time being goveming the powers and privileges of Members of the County Assembly, issue further guidelines for the enforcement of this Code. , PART IV_GENERAL PROVISONS Advisory opinion &. (l) A State Offrcer or the Assembly may rcquest the Commission to give an advisory opinion on any issue relating to, but not limited to- (a) the application of Chapter Six of the Constitution; (b) the application of the Act or any other applicable law or regulations dealing with thc ethics and integrity of State Offrcers; (c) the application of the Public Officer Ethics Act, 2003 or any other law or regulations dealing with the ethics and intcgrity ofpublic officers; (d) theapplicationofthisCode; (e) an ethical dilemma; or ff) any other matter incidental to the promotion of the ethics and integrity of State Offrcers and public officers generally. funzndment of the Code 41. The Assembly may with the approval of the Commission amend this Code.
