GAZETTE NOTICE NO. 5272

PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Four Forty Utawala Development Limited, is proposing to construct a Residential Apartments Scheme- 440 on L.R. No. 6845/167 at Utawala in Nairobi City County. The project shall be developed on nine acre piece of land in Utawala. The project shall consist of twenty two (22) blocks of apartments; each will have 5 floors and 20 units of houses within the apartment and 42 parking spaces between two apartments. There will be a total of 160 two bedroom units and 280 three bedroom units. The project shall also include commercial centre with 24 shop.s at the main entrance; recreational facilities which will include swimming pool with changing rooms and other facilities; a basketball court and green space to provide multipurpose recreational space. The following are the anticipated impacts and proposed mitigation measures: Impacts Proposed Mitigation Measures Habitat and vegetation Minimize area of clearance. disturbance • Reintroduce the vegetation that coexist with the site. Land degradation/soil • Silt fence should be established where erosion erosion is predetermined. Introduce vegetation in already mined areas. * Introduce physical barriers such as rocks to intercept soil material from being carried away by the run-off. Air pollution • Constant sprinkling of water to the bare areas. Identify wind direction during operation to avoid exposure to emission. Minimize the generation of bad emission from trucks used by assessing and evaluating whether they contain toxic by products. All the workers should be provided with masks to avoid inhaling such gases. • Adherence to Air Quality Regulations, 2014. Noise and resulting The operation should only be done vibrations during the day time. • Planning the trips of the vehicles can reduce such impacts. • Screening using baffle molds material e.g. soil and wastes that has already been remove to access the rock. • Locate screening baffle molds on site boundary to reduce noise. • The workers to be provided with earmuffs during operation hours. • Correct stemming will aid the control of ground vibration. • Adherence to Noise and Excessive Vibration Pollution (Control) Regulations, 2009. Solid and effluent wastes • Soil and earth excavated wastes to be (oil and other spills) used for backfilling excavated pits Surface run-off from waste tips should be captured and treated to remove suspended solids prior to discharge. • Safe disposal of oil spills and filters from machineries. • Adherence to Waste Management Regulations, 2006. Water pollution • Harmonize and design drainage ditches with the natural drainage to avoid affecting nearby land. • Divert run-off around working area. • Install sedimentation traps or screen next to the silt fence by arranging a layer of stone chips and gravel to trap any loose soil to nearby water bodies • Adherence to Water Quality Regulations, 2006. Land restoration and • Filling in the depressions to prevent landscaping ponding. • Landscaping and replanting of trees and other similar vegetation. • All pits where water may collect to form ponds should be filled. • A layer of top soil should be introduced so as to achieve vegetation growth.
