PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Ware Transport Limited, is proposing to reclaim land from the sea (Tudor Creek) and contiguous to Plot L.R. No. MNIV/2407 located at Kibarani area of Mombasa County for the purposes of light industrial activities which include the construction and commissioning of a Container Freight Station (CFS). The existing land area belonging to the proponent is 9acres and the size of the land to be reclaimed will be 3 acres making a total of I 2acres. The following are the anticipated impacts and proposed mitigation measures: Chemical disturbances • The construction of the bunds can be particularly planned to coincide with the spring low tides. • Use French drains and underground piping to ensure continued flow of fresh water into the creek area. • Decrease time frame over which the dredging operation is to take place, to avoid the daily re-suspension of sediments. • Ameliorate the impacts of the daily re- suspension of sediments by the suctioning of sediments that have resettled. • Monitor the quality storm water discharging from the reclaimed area. • Monitor the impact of the reclaimed area on ground water systems. • The materials to be used as backfill for the reclamation process will be tested for chemical loading or possible contamination. • Such materials will only be obtained from quarries or sites that are compliant with NEMA Regulations. Impacts Proposed Mitigation Measures Materials used in • Determine the appropriate quantities of reclamation at source reclamation materials required. Obtain reclamation materials from quarries that are compliant with the Environmental Management and Coordination Act, Cap 378. Impact on marine life • The key mitigating factor on marine life form during reclamation will be to ensure that reclamation activities are conducted during the low tides to minimize impact on sea dwelling organisms. Develop and implement a monitoring programme for marine life forms to determine resilience upon completion of the reclamation activities and seek the cooperation of Kenya Marine and Fisheries Institute (KMFRI) in this regard. • The rapid undertaking of the overall dredging operation to conceptually decrease the severity and range of impacts in space and time. Tidal prism change • Reduce the gradient of the slopes of the bund used in reclamation. • Continually monitor the tidal regime change of the creek. • Restore ancient adjacent reclaimed and filled areas of the creek, which are not in use as constructed areas, into salt marshes in order to compensate the loss of tidal prism and the surface of intertidal areas. • Monitor the stability of adjacent properties regarding renewed tidal erosion and provide sufficient and suitable embankments. Water quality • Obtaining and use of course gravel and rock boulders from quarries rather than fine material for creation of bonds and backfilling. • Slowing down the tipping processes and funneling backfilling materials. • Undertake construction of bunds and backfilling during low tides. Habitat alterations . Directing disposal of backfilling materials using silt curtains. . Ensure that there is no spread of backfilling materials to adjacent areas within the reclamation site i.e. sites that are not within the plot boundaries of the proponent's area that is not going to be reclaimed. Landscape changes • Ensure that dredged and filled areas are restricted to those previously established by the deed plan conditions as set out in the title deed. • Comply with the provisions of the draft zoning plan for Changamwe area and its environs. Potential instability • Use of appropriate substrate for creating bunds and backfilling. • Conducting scheduled compaction tests at defined levels of the reclamation process. • Ensure engineering integrity. • Allow adequate time for curing of reclaimed area upon completion. Shoreline alterations • Implement a specific monitoring of sedimentary processes in the creek by means of bathymetric surveys, for a minimum period of five years after construction. • The shoreline area abutting the development will be stabilized through construction of a reinforced retaining wall. • Observe the conditions of use of the land as stipulated under the title deeds for the land.
