PURSUANT to the provisions of. section 46 (6) (a) (ii) of the Competition Act, 2010, it is notified for general information that the Competition Authority of Kenya has authorized the proposed transfer GAZaTTEN0I10ENO. 1307 THE COMPETITION ACT (No. 12 of 2010) PROPOSED TRANSFER APPLICATION FOR EXEMPTION OF THE PROPOSED JOINT, VENTURE AGREEMENT BETWEEN KENYA AIRWAYS LIMITED AND PRECISION AIR SERVICES PLC PURSUANT to the provisions of section 25 (3) the Competition Act, 2010, it is notified for general information that the Kenya Airways Limited and Precision Air Services PLC have made an application under section 25 (1) of the Competition Act, 2010 for exemption of their joint venture agreement from the provisions of section A of Part III of the Act. In the joint venture agreement, the parties intend to align and co- ordinate— network management activities with respect to the joint venture including terms of routes, schedules, capacity and designation; pricing of ticket fares on the joint ventures routes; the management of any and all revenues attributable to the performance of the joint venture by either Kenya Airways or Precision Air including setting up joint revenue management systems and joint revenue analysis systems; 17th February, 2017 THE KENYA GAZETTE 753 joint marketing and sales activities with respect to the joint venture; and reciprocal code sharing on the joint venture routes. All interested parties must, within thirty (30) days of the publication of this notice, submit any written representations regarding the application.
