Subjcct to the constitution and any othcr law, a State Offrcer shall takc pcrsonal rcsponsibility for thc reasonably forcsecabb consequenccs ofany actions or omissions arising from ttre discharge of the duties of his or her office. Performance ofduties I 0. A State Oflicer shall, to the bcst ofhis or her ability- (o,) carry out the dutics ofthe offrce cfhciently and honcstly; (b) cany out thc dutics of the oflicc in a transparcnt and accoutable manner; (c) keep accurate records rnd documcnts relating to tlre functionr of the officc; and (d/ report tsuthfully on all matters of the officc. Professionalism I l. Confidentialiry 12. A State Offtcer shall- (a) subject to Article 35 ofthe Constitution and any othcr relcvant law, not disclosc or causc to bc disclosctl any information in his or her custody to any rmauthorized person. (D) not directly or indirectly usc or allow any pcrson under the officcr's authority to use any information obtained through or in conncction with thc ollice which is not available in thc public domain for the furthering of any privarc intcrest' whcther financial or otherwise. Financial integrity 13. (l) A Statc Oflicer shall not usc his or hcr office to unlawfully orwrongfully enrich himsclf or hcrsclf or any other pcnon. (2) Subjcct to articlc 76(2 (b) of thc Constitution a Statc Offrccr shall not rcccpt a pcrsonal loan or benefit which may conrpromisc the Statc Ofiiccr in carrying out his or her dutics. (3)A Statc Officcr shall submit an initial declaration of income, assets and liabilitics within thiay days of assurning ofEcc and thcreafter make biennial declarations to thc of6cc, and r final dcclaration within (30) days of ceasing to bc a Statc Officer. (4)The lhclaration undcr subaaragreph (3) shall bc submitted to the Kakamcga County Asscmbly Servicc Board. Gifls or benetits in kind 15. (l) A gift or donation givcn to e Strrc Officcr on a public or oflicial occesion shall be treatcd rs e gift or donation to thc omc€. (2) Notwithstmding subparagrryh (l) I State OffIccr may rcccive a gift givcn to thc Strtc Officcr inhis or hcr offrcial crpacity, providcd that- (a) he gift is within the ordinery bounds of propriay, r usual cxprcssion of courtesy or prctocol md within thc ordinary sundards of hospiality; @/ the gift is not monctary; (c) the gift docs not excced the valuc of Kenya Shillings hrenty thousand or such other amount as may bc prescribcd by the Commission through Regulations. (3.) Participation in tenders invited by the ofice 18. (l) A State Officer shall not participate in a tender for the supply ofgoods or services to the office. (2)Notwithstanding subparagraph (l) a company or entiry associated with the State Officer shall not be construed as rading witir the offrce, unless- (a/ the State Officer has a controlling shareholding in the company or entity, or (D/ the State Olficer is a director of the company; or (c) the State Officer is a managing partrrer in a law f,rm providing services to the oflice. Public Collections 19. (l) A State Oflicer shall not solicit for contributions from the oIfice or any other person or, public entity for a public purpose unless the President has, by notice in the Gazette, declared a national disaster and allowed a public collection for the purpose of the national disaster in accordance with the law. (2) A State Offrcer shall not participate in a public collection of funds in a way that reflects adversely on the State Offrcer's integnty, impartiality or interferes with the Performance of the oflicial duties. (3) Nothing in this clause shall be constructed as prohibiting a State Officer from making voluntary contribution. Bank accounts outuide Kenya 20. (1) Subject to Article 76(2) of the Constitution or any other writtan law, a State Officer shall not opgn or continue to opcratc a bank account outsile Kenya without the approval ofthe Commission. (2) A State Oflicer who has rcasonable grounds for opening or operating a bank account outside Kenya shall apply to the commisiion for approval to open or operate a bank account ouSide Kenya. (3) A State Officer who operates or controls the opcration of a bank account outside Kenya shall submit statements oi the account annually to tle commission and authorize the commission to veri! the {atemgltf and any other relevant information from the foieign financial institution in which the account is held. () SuUjqcl to subparagraph (l) and (2), a p€rson who is appointed as a State Officer in the office and has a bank account outside Kenya shall, upon such appointnent close the bank account within 3 montirs or such other period as the Commission may prescribe by notice in the Gazette. (5) Subject to subparagraph (4) a Stat€ Oflicer may open or continue to operate a bank account outside Kanya as may be authorized by the Commission in writing. Acting for foreigners 21. (l) A State Officcr shall not be an agent of, or further the interests of a foreign govemment, organization or individual in a manner that may be dekimental to the security interests of Kenya, except when acting in the course ofofticial duty. (2) For the purposes ofthis paragraph- (a,) an individual is a foreigner if the individual is not a citizcn of Kenya; and (b) an organization is foreign if it is established outside Kenya or is owned or contolled by a foreign govemm€nt, organization or individual. Core ofproperty 22 (l) A State Officer shall take all reasonable steps to cnsurc that public property in his or her custody, possession oriontol is taken care ofand is in good repair and condition. (2) A State Offrcer shall not use public property, funds or services that are acquired in the course ofor as a result ofthe offrcial duties, for private activities that are not related to the offrcial work of the State Officer. (3) A State Ofticer shall retum to the office all thc public pmpcrty in his or her custody, possession or control at the end ofthe election or contract term. (4) A Stat€ Officer who conEavencs subparagraph (2) or (3) shall, in addition to any other penalties provided for under the Constitution, the Act or any other law, be personally liablc for any loss or damage to the public property. Misuse of offrcial information 23. (l) A State Officer shall not dircctly or indirectly us€ or allow any percon under the officer's authority to usc any Information obtained thmugh or in connection with the oflice, which is not available in the public domain, for the furthering of any private interest, whether financial or otherwise. (2) A State Officer shall not be deemed to have violated the requirements ofsubparagraph (l), ifthe information given is- (a) pursuant to a court order @ for purposes of educational, r€s€arch, lircrary, scicntific or other purposes not prohibited by law; or (c) in compliance with Article 35 of the Constitution and the relevant law. lmpartiality 24. A State OIIicer shall, at all times, carry out the dutics of thc Office with impartiality and objectivity in accordance with principles and values set out in Articles 10, 27, 73 (2')(b) and 232 of the Constitution and shall not practice favouritism, ncpotism, tribalism, cronyism, religious bias or engage in other prefercntial treatrnent of another State Officer, Public Officer or a member of thc public. Giving of advice 25. A State Officer who has a duty to give advice shall give honest, accurate and impartial advice without fear or favour. Offers offunre Employment 26. (l) A State Officer shall not allow himsclf or hersclf to be influenced in thc performance of his or her duties by plans or expcctations for or offers of future employment or benefits. (2) A Stale Officer shall disclosc, in writing, !o the Commission, {!_offers of funre employmatt or bencfits that could place thc State Officer in a situation of conflict of intcrest. Former State fficer acting in a governmenr or public ofrce 27. A former Stale OIIicer shall not be engagcd by thc Office in a matter inwhich the State Oflicer was originally engagcd in as a State Officer, for at least two years after lcaving the ofiici. (l) A State Officer shall not- (a) cause anything to be done through another person that would constitute a contravention of this Code, the Constitution or any other law if done by the State Officer, or 'ft) allow or direct a person under their supervision or control to do anything that is in contravention ofthis Code, the Constitution or any other law; (c) paragnph (6) shall not apply where anything is done without the State Officer's knowledge or consent or if the State Officer has taken reasonable steps to prevent it. Reporting impro pe r o rde rs 3 3 . If a State O{Iicer considers that anything required of him or her is in contravention ofthe Code or is otherwise improper or unelhical; (l) The State Oflicer shall report the matter to the Commission. (2) The Commission shall investigate the report and takc appropriate action within ninety days ofreceiving the report. Duty to prevenl Occurrence of corntplion or unethical practice in the ofice 34. A State Officer who believes or has reason to believe conupt act or unethical malpractice has occurred or is about to occur in the office shall take all necessary measures to prevent it from continuing or materializing in addition to any other appmpriate action. Use of Social Media 35. A State Oflicer shall not use social media in a manner that is prejudicial to public interest, national cohesion or that otherwise constitut€s a breach ofany law Dress code 36. A Statc Officer shall maintain appropriate standard of dress and personal hygiene at all times. Political and other Influence 37. (l)A State Oflicer shall exercise independence in the discharge of his or her duties and shall not allow himself or herself to bc subjectcd to political or any other intemal or extemal influence that is dctimental to public interest. (2) A State Offrcer shall not itrfluence or att€mpt to influence fte decision of any other State or Public Officer or public entity on any matler. (3) A State Oflicer shall not in any way interfere with the duties ofany other State Officer, Public Oflicer, or public entity. Provisions relaling lo implemenlation of projects 38. (l) A State Officer shall in the exercise of oversight over implementation of projects not interfere with such implementation in any way (3)A State Officer shall not influence the undertaking of any project without prior planning or budgeting. (4)A State Oflicer shall not dcmand or accept any kickbacks, gifts, bcnefits or other favours from contractors or other persons or entities who are engaged in implementation pmjects. (5)A State Offrcer shall not compromise or abet compromising of standards of any project. (6) A State Oflicer shall, subject to the law, disclose all relevant information regarding any project to any person requiring such information. P r efe r e n t ia I tr e a tme n t 39. A State Officer shall ensure equal and equitable distribution of resources to all persons and any section of the population in his or her area ofjurisdiction and shall not confer any undue advantage to any person or section ofthe population. PART IV-ENFORCEMENT OF THE CODE 40. (l) Any penon may lodge a complaint alleging a breach of this code by a State Offrcer to the Oflice or to the commission. (2) Breach of this Code amounts to misconduct for which tlrc State Officer may be subjected to disciplinary proceedings including removal from ollice. (3) Where a breach of this code amounts to violation of tre Constitution, the State Officer may be removed from the oIlice in accordance with the applicable laws. (4) Where an allegation of breach is made to the Oflicc, the person allcging the breach shall submit a petition setting out the grounds and facts ofthe allegcd violation to the Authorizcd Ofticer of the Office. (5) Upon receipt of the Complain! the Oflice shall registcr and carry out investigations into the complaint, and may take action against thc State Offrcer in accordance with the Ac! Standing Orders of the Assembly, any Regulations made by thc Commission under the Act or other law that for the time being govems the conduct of State Oflicers in the Assembly. (6) Ifupon investigation into the alleged breach ofthe Code, the Office is of the opinion that civil or criminal proceedings ought to be prcferred against the respective State Offrcer, it shall refcr the matter to- (a,) the Commission, with respect to civil matters; and @) the Director of Public hosecutions with respect to criminal matters. (7) Where the complaint is made to the Commission, the Commission shall take such action against tre State Offrcer as it deems necessary in accordance with its mandate under the law (8) Notwithstanding sub-paragraph (5), the Commission may, subject to the law, take any additional action it deems appropriate in relation to any breach of the Code or require thc Oflice to take any action against a State Offrcer who has breachcd the Codc. Yictimization 41. A State Officer shall not in any way victimize any othcr State Officer or Public Oflicer or any other person for any lawful action or omission Duty of Authorized Oficer and Accounling Oflicer to comply with directives of the Commission in implementation of the Code 42. The Authorized Offrcer or Accounting Officer of the Oflice shall at all times comply with such orders or directives as may bc issued by thc Commission from time to time towards the implementation and enforcement of this Code. PART V-CENERAL PROVISIONS Advisory opinion 43. A State 0fticer or the oflice may request the Commission to give an advisory opinion on any issue relating to, but not limited to - (a,) the application ofchapter six of; @/ thc constitution; (c,) the application of the Act or any other applicablc law or regulations dealing with the ethics and integrity of State Officers; (d/ the application of the Public Officer Ethics Act 2fi)3, or any othcr law or regulations dealing with the ethics and integrity of public ofticers; (e,) the application of this Code; (/ an ethical dilemma; or (g) any othcr mattcr incidental to thc promotion of the ethics and intcgnty of State Officers and public oflicers generally. Troining on Leadership and Integri|t 44. The Office shall collaborate with the Commission !o cnsur that the State Oflicers and public officers serving in the Oflice are sensitized on leadership and integrity issues at least once a ycar. Personal Respons ib ility for Compliance 45. Each State Ofiicer shall take personal responsibility or compliance with the provisions of this Code Annual Report 46. Govemancc, Financial Managcmcnt, Tcchnical Operations rnd Human Resourcc shall bc wholly undcr thc contnol of TWSB end it shall consult with thc County Govcrnment of Kirinyaga so that- (a) therr is a positivc omaround in the govemancc of the wercr supply opcrations; (b) 0re constent watcr shortages due to indusfial unrest ar€ stopped as soon as Possible; .
