PURSUANT !o section 37 of ttre kadership and Integrity Act, 2012 tlrc County Assembly of Kitui establishes this Leadership and
Integrity Code to be observed by and binding upon State Officers in the County Assembly of Krrui.
PART I-STATEI{ENT OF INTENT
A kadership and Integrity Code for State Officers in the County
Assembly of Kitui made pursuant to the provisions of section 37 of the
Leadership and Integrity Act,2O12 and to give effect to Chapter Six of the Constitution of Kenya. The Code is intended to establish standards of integrity and ethical conduct in the leadership and management of public affairs of the County Assembly by ensuring that the State
Officers respect the values, principles and provisions of the
Constitution and other applicable laws or policies on the standards of conduct and performance expected of holders of public office in the discharge of their duties.
PART II -- PRELIMINARY PROVIS IONS
Ciation

5. (l) A State Officer elected to the County Assembly shall sign and commit to this Code at the time of taking oath of office or within seven days of assuming office.
(2) A serving State Officer shall sign and commit to this Code within seveo days of the publication of the Code in the Gazette.
(3) The declaration of commitrnent to the Code shall take the form and structure set out in the First Schedule to this Code.
PART II-REQUIREMENTS
Rule oJ Law
6. (!) A State Gffiaer shall rcsnect end abide by.the Constinrtion and all other laws.
(2) A Stat€ Officer shall carry out thc duties of his or her offrce in accordance with the law.
(3) In cerrying out the duties of his or her ofFrce, a State Offrcer shall not violate the rights and fundamental freedoms of any person.
Public trust
7. 4 State Office is a position of public trust and the authority and responsibility vested in a State Officer shall be exercised by the State
Officer in the best interest of the offrce and the people of Kenya.
Re sp o n ub ility and du tie s
8. Subject to the Constitution and any other law, a State Officer shall take personal responsibility for the reasonably foreseeable consequences of any actbns or omissions arising from the discharge of the duties of his or her office.
Performance ofduties
9. A State Officer shall, to the best of his or her ability-
(a) cdrry out the duties of the offrce efhcienfly and honestly;
(b) carry out the duties of the offrce in a transparent and accountable manner;
(c) keep accumte records and documents relating to the functions of the office; and
(d) report truthfully on all matters of the office.
Professionalism
10. A Stare Officer shall-
(a) catry out the duties of hb or her office in a manner that maintains public confidence in the integrity of the offrce;
(b) veat members of the public, staff and other state and public officers with courtesy and respect;
(c) to the extent.pprqpriate to the office, maintain high standards of performance and lovel of pmfessionalism within the officc and;
(d) if the State Officer is a member of a prcfessional body, observe and subscribe to the ethical and professional requirements of that body in so far as the rcquirements do not contravene the
Constitution, any other law or this Code.
Confidentiality
11. A State Officer shall subject to Article 35 of the Constitution and any other relevant law, a State Officer shall not disclose or cause to be disclosed any information in his or her custody conceming his or her office to any unauthorized person.
Financial integrity
12. (l) A Statc Officer shall not use his or hcr office to unlawfully or wrongfully enrich himsplf or herself or any other porson.
(2) Subject to Article 76 (2) (b) of the Constitution, a State Officer shall not aocept a personal loan or bonefit which may compromise thc ability of the State Officer in carrying out his or her duties.
(3) a State Offrcer shall submit an initial declaration of income, assets and liabilities within thirry days of assuming office and thereafter make biennial declarations to the ofFrce, and a find declaration within (30) days of ceasing to be a State Officer.
(4) The Declaration under suLparagraph (3) shall be submittcd !o the County Assembly Service Board.
(5) A declaration filed by a State Offrcer in accordance with the provisions of sub-paragraph (3) shall be accessible to the Commission and any other person, subject to the provisions of Section 30 of thc
Public Off,rcer Ethics Act, 2003.
(6) A State Officer shall pay any taxes, loans or other debts duc from him or her within the prescribed period.
(7) A State Offrcer shall not neglect their financial, family or other legal obligations.
Moral and ethical requirements
13. (1) A State Officcr shall observe and maintain the following ethical and moral requirements-
(a,) demonstrate honesty in the conduct of hrs or her public and private affeirs;
(D/ not b engage in activitics that amouflt to abuse of off,rcc;
(c) accurately and honesty repreeent information to the public;
(d) tot engage in wrongful conduct in fi.rrtherance of pcrsond benefit;
{e) not misuse public resources;
(/) not falsify any records;
(g) not sexua.lly harass or have inappropriate s€xual relations with other State Offrcers, staff of the office or any other person;
(ft) not engage in actions which would lead to the State Office6 removal from the membership of a professional body in accordance with the law;

(i) not commit offences and in particular, any of the offences under parts XV and XVI of the Penal Code, Sexual Offences
Act,2006, the Counter-Trafficking in Persons Act, 2008, and the Children Act;
(/) not engage in fighting or physical confrontation with any person whether withrn or outside the precincts of the county assembly;
(k) maintain high standards of etrquette at all times.
(2) A person who wishes to be elected or nominated to office shall or the purpose of this Code, submit to the Independence and
Boundaries Commission a self-declaration in the Form set out in the
First Schedule to the Act.
(3) A state officer shall maintain high standards of etiqueite at all times.
Gifis or benefits in kind
14. (l) A gift or donation given to a State Officer on a public or official occasion shall be treated as a gift of donation to the office.
(2) Notwithstanding subparagraph (1) a State Officer may receive a gift given to the State Officer in official capacity, provided that-
(a) the gift is within the ordinary bounds of propriety, a usual expression of courtesy or protocol and within the ordinary standards of hospitality.
(b) the gift is not monetary.
(c) the gift does not exceed the value of Kenya Shillings twenty thousand or such other amount as may be prescribed by the
Commission through Regulafions.
(3) A State Officer shall not accept or sohcit gifts, hospitality or other benefits from a person who-
(a) has an interest in any matter under consideration by the County
Assembly;
(b) has a contractual relationship with the office;
(c) has any interest that is directly or indirectly connected with the
State Officer's duttes;
(d) rcceive a gift whrch has the potential of compromisrng his or her integrity, objectivity or impartiality; or
(e) apcept any type of gift expressly prohibited under the Act;
(4) A State Officer who receives a gift or donation shall declare the gift or donation to the Authorized Officer within seven days of receipt of such gift.
(5) The Office shall maintain a register of all gifts received by the state Officers serving in the Office and another register of all gifts given by the office to other State or Public Officers.
Wrong;fu1 or unlawful acquisitnn of property
15. A State Officer shall not use the office to wrongfully or unlawfully acquire or influence the acquisition of public or other proPerty.
Conflict of interest
16. (l) A State Officer shall use the best efforts to avoid being in a conflict of interest a situation where his or her personal interests conflict or appear to conflict with the State Officers official duties.
(2) Without limiting the generality of subparagraph (1) a State
Officer shall not hold shares or have any other interest in a corporation, partnership or other body, directly or through another person, if holding those shares or having that interest would result in a conflict of the State Officers and the officers officral duties.
(3) A State Officer whose personal interest's conflrct wrth therr official duties shall declare the personal rnterest to the office.
(4) The Office may give drrections on the appropriate actton to be taken by the State Officer to avoid the conflict of interest and the State
Officer shall comply with the directions, and refrain from participating in any deliberations with respect to the matter.
(5) Any direction issued by the office under sub paragraph (4) shall be in writrng
(6) Notwithstanding any directions to the contrary under subparagraph (4), a State Officer shall not influence the award of a contract to-
(a/ himself or herself;
(b) the State Officer's spouse or child;
(c.) a business associate or agent; or
(d) a corporatron, private company, partnership or other body in which the officer has a substantial or controlling interest.
(7) Where a State Officer ls present at a meetlng, and an issue which is likely to result in a conflict of interest is to be discussed, the
State Officer shall declare the interest at the beginning of the meeting or before the issue is dehberated upon.
(8) A declaration of a conflict of rnterest under subparagraph (7) shall be recorded in the minutes of that meeting.
(9) The Office shall maintarn a register of conflicts of rnterest in the prescribed form in which an affected State Officer shall register the particulars of the registrable interests, stating the nature and extent of the conflict.
(10) For purposes of subparagraph (9), the registrable interests shall include-
(a) the interests set out ln the second schedule of the Act;
(b) any connection with a person. firm or a company, whether by relation, friendship, holding of shares or otherwise, which is subject of an investigation by the Constitution;
(c) any application for employment or other form of engagement with the ofhce by a family member or friend of the State
Officer or by a law firm or corporation associated wilh the
State Officer:
(d) any application to the office, by a family member or friend of the State Officer, for clearance with respect to appointment or election to any public office;
(e) any other matter which. in the opinion of the State Officer, taking into account the circumstances thereof, is necessary for registration as a conflict of rnterest.
(1 l) The Ofhce shall keep the register of conflicts of interest for five years after the last entry in each volume of the register.
(12) The Office shall prepare a report of the registered interests within thirty days after the close of a financial year.
(13) A State Officer shall ensure that an entry of registrable interests under subparagraph (9) is updated and to notrfy the office of any changes in the registrable lnterests, wtthrn one month of each change occurring.
Participation in tenders invited b1- the office
17 (l) A State Officer shall not participate in a tender for the supply of goods or services to the office.
(2) Notwithstanding subparagraph (1) a company or entrty associated with the State Officer shall not be construed as tradlng wlth the office, unless-
(d/ the State Officer has a controlling shareholding in the company or entity or
(b) the State Officer is a director of the company; or
(c) the State Officer is a managrng partner in a law firm providing services to the office.
Public collecnons
18. (1) A State Officer shall not solicit for contributions from the office or any other person or, public entrty for a public purpose unless the President has, by notice in the Gazette, declared a nahonal dtsaster and allowed a public collechon for the purpose of the national disaster in accordance with the law.
(2) A State Officer shall not participate rn a public collection of funds in a way that reflects adversely on the State Officers' integrity, imparfialrty or interferes with the Performance of the official duties
(3) Nothing in thrs section shall be constructed as prohibiting a
State Officer from makrng voluntary contnbution.
Bank accounts outstde Kenya
19. (1) Subject to Article 76(2) ot the Constrtution or any other wrrtten law, a State Officer shall not open or contlnue to operate a bank account outside Kenya without the approval of the Commission
(2) A State Officer who has reasonable grounds for opening or operating a bank account outside Kenya shall apply to the Commission for approval to open or operate a bank account outside Kenya.
(3) A State Officer who operates or controls the operation of a bank account outside Kenya shall submit statements of the account annually to the commlssion and authorize the cornmissron to verify the statements and any other relevant information from the foreign frnancial institution in which the account is held.
(4) Subject to subparagraph (l) and (2), a person who is appointed as a State Officer in the offrce and has a bank account outside Kenya shall, upon such appointment close the bank account within three (3) months or such other period as the Commission may prescribe by notice in the Gazette
(5) Subject to subparagraph (4) a State Offrcer may open or continue to operate a bank account outside Kenya as may be authorized by the Commission in writing.
Acting for foreigners
20. (l) A State Officer shall not be an agent of, or further the interests of a foreign govemment, organization or individual in a manner that may be detrimental to the security interests of Kenya, except when acting in the course of offrcial duty.
(2) For the purposes of this paragraph-
(a) an individual is a foreigner if the indivrdual is not a crtizen of
Kenya; and
(b) an organizanon is foreign if it is established outside Kenya or is owned or controlled by a foreign govemment, organlzation or individual
Care ofpropertv
21. (1) A State Officer shall take all reasonable steps to ensure that public property rn his or her custody, possession or control is taken care of and rs m good repair and condition.
(2) A State Officer shall not use public property, funds or services that are acquired in the course of or as a result of the official duties, for private activities of activities that are not related to the official work of the State Officer.
(3) A State Officer shall retum to the office all the pubhc propeny in his or her custody, possession or control at the end of the election or contract term.
(4) A State Officer who contravenes subparagraph (2) or (3) shall, in addition to any other penalties provided for under the Constitution, the Act or any other law, be personally liable for any loss or damage to the public property.
Misuse of fficrul inJormauon
22. (l) A State Officer shall not directly or indirectly use or allow any person under the officers authority to use any lnformation obtained through or in connection with the office, which is not available in the public domain, for the furthering of any private interest, whether financial or otherwise.
(2) A State Officer shall not be deemed to have violated the requirements of subparagraph ( I ), if the information given-
(a) pursuant to a court order;
(D) for purposes of educational, research, literary, scientific or other purposes not prohibited by law; or
(c) in compliance with Article 35 of the Constitution and the relevant law.
Intpartiality
23. A State Officer shall, at all times, carry out the duties of the
Office wrth impartiality and objectivity in accordance with principles and values set out rn Articles 10, 27, 73 (2)(b) and 232 of the
Constitution and shall not practrce favouritism, nepotism, tribalism, cronyism, religious bias or engage in other preferential treatment of another State Officer, Public Officer or a member of the public.
Giving oJ advice
24. A State Officer who has a duty to give advice shall give honest, accurate and impartial advice without fear or favour.
Offe r s oJ fu ture e mp loyme nt
25. (l) A State Officer shall not allow himself or herself to be influenced in the performance of his or her duties by plans or expectations for or offers of future employment or benefits.
(2) A State Officer shall disclose, in writing, to the Commission, all offers of future employrirent or benefits that could place the State
Officer in a situation of conflict of interest.
Former state Oficer acting in a government or public ofice
25. A former State Officer shall not be engaged by the Office in a matter in which the State Officer was origrnally engaged in as a Sttte
Officer, for at least two years after leaving the office.
Misleading t,rc public
27. A State Offircer shall not kno$ rngly give falsc or misleading information ro any person.
Falsificatbn of records
28. A Str.te Officer shall not falsify any records or misreprescnt information to the public

29. A State Officer shall conduct their private affairs in a mantrcr that maintains public confidence in the integrity of the Offrce.
Bullying
30. (l) A State Officer shall not bully another State or Public
Officer or any other person.
(2) For purposes of subparagraph (1) "bullying" inclu&s blackmail, co€rcion, threats, intimidation or repeated offcnsivc behaviour which is vindictive, cruel, malicious or humiliating whethcr or not is intended to undermine a person and includcs physical assault
Acting through others
31. (l) A State Officer shall not-
(a) cause anything to be done through another percon that wqrld constitute a contravention of this Code, the Constitution or uy other law if done by the State Offrcer; or
(b) allow or direct a penron under thcir supervision or control to do anything that is in contravention of this Code, the Constitution or any other law.
(2) Subparagraph (l) (b) shall not apply wherc anything is donc without the State Officer's knowlcdge or consent or if the Statc Officcr has taken reasonable steps tro prevent it.
Re portin g imprope r orde r s
32. If a State Offrcer considers that anything rEquhed of him or h€r is in contravention of the Codc or is othcrwise impropcr or unethical, the State Officer shall report the matter to the Commission.
(2) The Commission shall investigatc thc rcpo( and tekc appropriate action within ninety days of receiving the report.
Duty to prevent occurrence oJ corruption or unelhical practice in thc ofice
33. A State Offrcer who believes or has reason to believe comrpt act or unethical malpractice has occurred or is about to occur in 6c office shall take all necessary measures to prevent it from continuing or materializing in addition to any other appropriate action.
Use oJ social media
34. A Stat€ Offrcer shall not use social media in a manner thlt is prejudicial to public interest, national cohesion or that othcrwisc constitutes a breach of any law.
Dress code
35. A State Officer shall maintain appropriate standard of drcss and personal hygiene at all times.
Political and other inJluence
36. (1) A Statc Officer shall exercise independence in th discharge of his duties and shall not allow himself o be subjectod o political or any other intemal or external influence that is detrimentd to public interest.
(2) a State Officer shall not influencc or attempt to influcncc th decision of any other State or Public Offrccr or public entity on my matter.
(3) A State Officcr shall not in any way interfere with thc duticr of any other State Officcr or Public Officcr or public entity.
Provisions relating to implementation ol projects
37. (l) A State Officer shall in thc exercise of oversight ovcr implementation of projects not interfer€ with such implcmentatioo in any way.
(2) A State Officer shall not influence thc undcrtaking of rny project without prior planning or budgeting.

(3) A State Officer shall not demand or accept any kickbacks, gifrs, benefits or other favours from contractors or other persons or entrtles who are engaged in implementation of prcjects.
(4) A State Officer shall not compromise or abet comprising of standards of any project.
(5) A State Officer shall, subject to the law, disclose all relevant information regarding any pro1ect to any person requiring such information.
P r efe r e ntia I tr e atme nt
38. A State Offrcer shall ensure equal and equitable disfibution of resources to all persons and any section of the population in his area of jurisdiction and shall not confer any undue advantage to any person or section of the population.
Dual citiTenship
39. (1) Subject to Article 78 (3) of the Constitution, a Statc Officer who acquired dual citizenship shall lose her or his position as a state officer.
(2) a person who holds dual citizenship shall , upon election or appointment to a state office, not take office before officially renouncing their othcr citizenship in accordance with the provisions of the Kenya Citizcnship and Immigration Act, 201 1 (No. 1 2 of 201 1 ).
PART M-ENFORCEMENT OF THE CODE
40. (l) any person may lodge a complaint alleging a breach of this code by a State Officer to the Office or to the Commission.
(2) Brcach of this Code amounts to misconduct for which the State
Offrcer may be subjected to disciplinary proceedings including removal from office.
(3) Where a Breach of this Code amounts to violation of the
Constitution, the State Officer may be removed from the office in accordance with the apphcable laws.
(4) Where an allegation of breach is made to the Office, the p€rson alleging the breach shall submit a petition setting out the grounds and facts of the alleged violation to the Authonzed Officer of the Office.
(5) Upon receipt of the Complaint, the Office shall register and carry out investigatrons into the complaint, and may take action against the State Officer in accordance with the Act, Standing Orders of the Assembly, any Regulations made by the Commission under the
Act or other law that for the time being govems the conduct of State
Officers in the Assembly.
(6) If upon investigation into the alleged breach of the Code, the
Office is of the opinion that civil or criminal proceedings out to be preferred against the respective State Officer, it shall refer the matter to-
(a) the Commrssion, with respect to crvil matters; and
(D) the Director of Public Prosecutions, with respect to crimrnal matters.
(7) Where the complaint is made to the Commission, the
Commission shall take such action against the State Officer as it deems necessary in accordance with its mandate under the law
(8) Notwrthstanding sub-paragraph (5), the Commission may.
subject to the law, take any addrtional action it deems appropriate in relation to any breach of the Code or require the Office to take any action against a State Office who has breached the Code.
Victimization
41. A State Ofhcer shall not rn any way victlmrze any other State
Officer or Public Officer or any other person for my lawful action or omission.
Duty of Authorized Officer and Accounting Oficer to comply with directives of the Commission in implementation of the Code
42. The Authorized Officer or Accounting Officer of the Office shall at all times comply with such orders or directrves as may be issued by the Commission from time to time towards the implementation and enforcement of this Code.
PART IV-GENERAL PROVISIONS
Advisory opinion
43. A State Officer or the office may request the Commission to give an advisory opinion on any issue relating to, but not hmited to-
(c) the application of Chapter Six of the Constitutton;
/&) the apphcatron of the Act or any other applrcable larv or regulatrons dealing wrth the ethics and integrrty of State
Offrcers;
(c) the apphcatron of the Pubhc Officer Ethrcs Act 2003, or any other law or regulations dealing with the ethics and integnty of publrc officers
(d) the application of thrs Codel
(e) an ethical drlemma; or
(fl any other matter incrdental to the promotion of the ethrcs and integrity of State Officers and pubhc offrcers generally.

44. The office shall collaborate with the Commission to ensure that the State Officers and public officers servrng in the Office are sensitized on leadership and rntegrity issues at least oncc a year.

45. Each State Officer shall take personal responsrbihty of compliance with the provisions of this Code.
Annual Report
46. The Authonzed Officer or his designate shall cause to be prepared and submitted to the Commrssion an Annual Reporl on the progress made in rmplementation and enforcement of the Code in a prescribed format by the Commission.

PART I_STATEMENT OF INTENT
A Leadership and Integrity Code for State Officers in the County
Executive of County Govemment of Narok made pursuant to the provrsrons of section 37 of the Leadership and Integrity Act,2012 and to give effect to Chapter Stx of the Constltution of Kenya. The Code is rntended to establish standards of integrity and ethical conduct in the leadership and management of public affairs of the County
Govemment of Narok by ensurrng that the State Officers respect the values, principles and provrsrons of the Consutution and other apphcable laws or policies on the standards of conduct and performance expected of holders of public offrce in the drscharge of their duties.
PART I]

PRELIMINARY PROVISIONS
Preantble
The County Govemment of Narok establishes the following Code of Conduct and Ethics for State Officers in County Executive.
The Code references other policy and legal instruments which are itemrzed in the Mrscellaneous Section of this Code.
Citatnn
1. This Code may be cited as the kadership and lntegrrty Code for
State Officers in the County Executive of Narok.
Commencement
2. This Code shall come lnto operatlon wlthrn seven days of its publication inthe Kenya Gazette
Interpretation
3. In this code, unless the context otherwrse requires-
"Act" means the Leadershrp and Integrity Act,20l2;
"Accounting Officer" means the County Secretary of the County
Govemmenti
"Authorized Officer" Means the Governor of the County of Narok and includes his/her designate;
"Bank Account" has the meaning assigned to it under sectron 2 of the Act; Conduct and Ethics for State officers;.
"Code" means the Leadership and integrity Code for State Officers in the County Executrve of Narok, "Confidential inlbrmation" is the County Government information that a State officer comes into contact with, and is restricted to him/her
"Comrption" has the meaning assigned to it under section 2 of the
Anti- Comrption and Economic Crimes Act;
"Commission" means the Ethrcs and Anti-Comrption Commission estabhshed under sectron 3 of the Ethics and Anti-corruption commission Act, No. 2Zof 2011;
"Gazette" means the Kenya Gazette;
"Hrs" includes the expressron "her"
"Office" means the office the County Executive of County
Govemment Narok:
"Ethrcs" A set of morally accepted norms or standards how we ought to behave;
"Innovation" Seekrng solutions based on needs and abilities, and showrng rnitiatrve to find new ways to improve service delivery;
"Integrity" Is the sum of positive qualities or virtues such as honesty, trustworthiness, goodness, loyalty, truthfulness, courage, impartiality, firmness and steadfastness of principled behavior;
"Personal Interest" means a matter in which a Public Officer has a duect or rndrrect pecuniary or non-pecuniary interest and includes thc interest of this or her spouse. child, business associate or agent;
"State officer" Means a public officer whom this code of applies to and has the same meaning as assigned to it under Article 260 of thc
Constitution;
"Respect" Treating clients and colleagues with courtesy and tolerance and making the workplace an inclusive, productive, and healthy environment.;
4. The provisions of Chapter Six of the Constitution and thc kadership and Integnty Act shall form part of the Code.
Commitment to the Code
5. (l) A State Officer elected or appointed to the County
Executive shall sign and commil to this Code as per the frst schedulc to this Code at the time of taking oath of office or within seven days of assuming office.
(2) A serving State OfFrcer shall sign and commit to this Codc withrn seven days of the publication of the Code in the Gazette.
(3) The declaration of commitment to the Code shall take the form and structure set out in the First Schedule to this Code.
PART III_REQUIREMENTS
6. In exercise of the power conferred by Section 37 of thc l,eadership and Integrity Act,2013, the County Government of Narok establishes this specific Code of Conduct for its State Officers.
7. This Code applies to all State Officers in the County
Government of Narok. All State Officers in the County Govemment of
Narok are obliged to familiarize themselves with this code of conduct and observe is principles. The provisions of this code shall bc mainstreamed into sectoray Departmental activities, committees and functions.
8. Unless otherwise provided in this code, the provisions of the
Public Officer Ethics Act shall form part of this code in so far as they conform to the provisions of the Lradership and Integrity Act.
Performance ofduties
9. State Offrcers shall, to the best of their ability;
(1) Carry out their duties in an efficient and honest rnanner and avoid behaviors which might impair their effectiveness.
(2) Carry out their duties in a transparent and accountable manner and keep accurate records and documents relaung to the functions of the office.
(3) Report truthfully on all matters of the departments they represent.
10. A State Officer shall obey all lawful orders of his/her immediate supervisor and other senior offrcers. All official communications should be channeled through the immediatc supervisors.
ll. State Officers are required to use official language whilc performing their dutres while in their places of work.
Professionalism
12. A State Officer should-
(a) carry out his duties in a way that maintains public confidence in the integrity of his offrce conduct hrm/herself in a professional manner at all times and to apply high professional standards in carrying out his/her duties including promotion and application of best practices and procedures that upholds public confidence and the integrity of the office;
(b) portray a positive image before the public at all times by respecting him/trerself and conducting him/herself in a manner that upholds the dignity of the offrce;
(c) |.Ieat members of public and other State officers with courtesy and respect;
(d) lt the state officer is a membel of a professional body shall observe and subscribe to the Ethical and professional requirements of that body in so far as the requirements do not contravene the constitution or the lradership and integrity Act.
Confidentiality
13. A State Officer subject to Article 35 of the Constitution and any other relevant law shall not disclose or cause to b€ disclosed any information in his/her custody to any unauthorized person.

Financial Integrity
14. (1) A State Officer shall not use hrs or her office to unlawfully or wrongfully enrich himself or herself or any other person.
(2) Subject to article 76 (2) (b) of the Constitution a State Officer shall not accept a personal loan or benefit whrch may compromise the
State Officer in carrying out his or her duties.
(3) a State Officer shall submit an initial declaratron of income, assets and liabilities within thirty days of assumrng office and thereafter make biennial declarations to the office, and a final declaration within thirty (30) days of ceasing to be a State Officer.
(4) The Declaration under sub-paragraph (3) shall be submitted to the County Public Service Board
(5) A declaration frled by a State Offrcer in accordance with the provisions of sub-paragraph (3) shall be accessible to the Commission and any other person, subject to the provisions of Section 30 of the
Public Officer Ethics Act, 2003.
(6) A State Officer shall pay any taxes, loans or other debts due from him within the prescribed period.
(7) A State Officer shall not neglect their financial or legal obligations.
Reporting Corruption
15. All State Officer of the County Govemment of Narok are expected
-
(a) to report any acts of comrption or suspicious practices to immediate supervisors or Ethics and Integrity prevention committees in the County.
(b) continuously conduct risk assessment at the work place to determine the scale and scope of the vrce with vrew of devising effective counter measures.
(c) in situations where comrption has taken place, a recurrence shall be stopped, evidence safeguarded and system weaknesses reviewed to strengthen integrity.
Moral and Ethical requirements
16. (l) A State Officer shall observe and maintain the following ethical and moral requiremens-
(a) demonstrate honesty in the conduct of his or her public and private affairs;
(b) notto engage in activrties that amount to abuse of office;
(c) accuratcly and honesty represent information to the pubhc;
(d) not engage in wrongful conduct in furtherance of penonal benefit;
(e,) not mrsuse public resources;
(fl not falsify any recordsl
(g) not sexually harass or have inappropriate sexual relatrons with other State Officers, staff of the office or any other person;
(h) not engage in actions which would lead to the State Offrcers removal from the membership of a professronal body in accordaflce with the law;
(l) not commit offences and in particular, any of the offences under parts XV and XVI of the Penal Code, Sexual offences act,2006, the Counter- Trafficking in Persons Act, 20O8, and the Children Act;
(j) not engage in fighting or physical confrontation with any p€rson;
(i<,) maintain high standards of etiquette at all times.
Public trust
17. A Public Office is a position of pubhc trust and the authority and responsibility vested in a State Officer shall be exercised by the
Public Officer in the best interest of the office and the people of
Kenya.
Re s p o ns ib ility and dutie s
18. Subject to the Constitution and any other law, a Public Officer shall take personal responsibility for the reasonably foreseeable consequences of any actions or omissions arising from the discharge of the duties of his or her office.
Gifts or benefits in kind
19. (l) A gift or donatron given to a State Officer on a pubhc or official occasion shall be treated as a gift of donation to the office.
(2) Notwithstanding subparagraph (1) a State Officer may receive a gift given to the State Officer in official capacity, provrded that-
(a) the gift is within the ordinary bounds of propriety, a usual expression of courtesy or protocol and withrn the ordrnary standards of hospitality;
(6) the gift is not monetary:
(c) the gift does not exceed the value of Kenya Shillings twenty thousand or such other amount as may be prescribed by the
Commission through Regulations.
(3) A State Officer shall not accept or solicit gifts, hospitality or other benefits from a person who-
(a,) has an interest in any matter under consideration by the Offrce
(D) has a contractual relationship with the office;
(c) has any lnterest that is directly or indirectly connected with the
State Officers duties;
(d) receive a gift which has the potential of compromising his or her integnty, objectivity or rmpartialityl or
(e) accept any type of gift expressly prohibited under the law;
(4) A State Officer who receives a gift or donation shall declare the gift or donation to the Authorized Officer within seven days of receipt of the gift.
(5) The Otrice shall maintain a register of all gifts received by the
State Officers serving in the Offrce and another register of all gifts given by the office to other State or Public Officers.
Care of property
20. (l) State Officers are required to take reasonable care of public property and other resources entrusted in their custody. Further he/she should not incur any liability on the part of the employer without proper authorization.
(2) A State Officer who contravenes subsection 1 shall in additron to any other penalties provided for under the Constitution, the Act or any other law be personally liable for any loss or damage to the public property.
Rule of law
21. (l) A State Officer shall respect and abide by the constltutlon and the law.
(2) A State Officer shall carry out the duties of his/her office in accordance with the law.
(3) In carrying out the duties of his/her office, a State Officer shall not violate the rights and fundamental freedoms of any person unless otherwise expressly provided for in the law and in accordance with
Adcle 24 of the Constitution.
(4) In carrying out his/her duties, a State Officer shall respect, protect and promote the fundamental rights and freedoms of other persons without discnminatron on the basis of race, tnbe, political opinions, language, color, creed, sex, disability, social status or culture.
ConJlict of interest
22. (l) A State Officer shall use the best efforts to avoid being in a conflict of interest a situation where his or her personal interests conflict or appear to conflict with the State OfFrcers offrcial duties.
(2) Without limiting the generality of subparagraph (l) a State
Officer shall not hold shares or have any other interest in a corporation, partnership or other body, directly or through another person, if holding those shares or having that interest would result in a conflict of the State Officers and the officers official duties.
(3) A State Officer whose personal interest's conflict with their official duties shall declare the personal interest to the office.
(4) The Offrce may give directions on the appropnate action to the taken by the State Officer to avoid the conflict of interest and fte State
Officer shall comply with the directions, and refrain from participating in any deliberations with respect to the matter.
(5) Any direction issued by the office under sub paragraph (4) shall be in writing.

50. The Authorized Office or his designate shall cause to be prepared and submitted to the Commrssion an Annual Report on the progress made in implementation and enforcement of the Code in a prescribed format by the Commission.
Amendment of the Code
51. The Ofhce may rvith approval of the Commrssron amend this
Code to keep it cunent and reflective of emerging laws, regulations, pohcies and best practices.
PART V_MISCELLANEOUS
52. (l) This code should be treated as a county policy on ethics and integrity for State officers.
(2) It is therefore imperative that all State officers of the county read and familiarize themselves with this Code.

PURSUANT to section 37 of the l.eadership and Integnty Act, 2O12 the County Executive of Krsii Counry Govemment establishes this l.eadership and Integrity Code to be observed by and binding upon
State Officers in the County Executive.
PART I-STATEMENT OF INTENT
A lradership and Integrity Code for State Officers in the County
Executive Comittee of Kisii madc pursuant to the provisions of
Sectron 37 of the Leadership and Intcgriry Act,20l2 and to give effect to Chapter Six of the Constitution of Kenya. The Code is intended !o establish standards of integrity and ethical conduct in the leadership and management of public affairs of the County Executive Committec by ensuring that the State Officers respect the values, principles and provisions of the Constitution and other applicable laws or policies on the standards of conduct and performance expected of holders of public office in the discharge of their duties.
PART II _ PRELIMINARY PROVISIONS
Citation
1. This code may be cited as the l.eadership and Integrity Code for
State Officers in the County Executive Committee of Kisii.
Commencement
2. This Code shall come into operation upon its publication in thc
Kenya Gazette.
Interpretation
3. In this code, unless the context otherwise requires-
"Act" means the kadership and Integrity Act,2O12; (No. 19 of
2012);
"Accounting Officer" means the County Secretary of the County
Government;
"Authorized Officer" means the Governor of the County of Kisii and includes his or her designate;
"Bank Account" has the meanrng assrgned to it under section 2 of the Act;
"Code" means the [radership and Integrity Code for State Officers in the County Executive Committee of Kisii;
"Commission" means the Ethics and Anti-Comrption Commission established under section 3 of the Ethics and Anti-comrption commission Act, No. 22 of 2Ol l;
"Gazette" means the Kenya Gazette;
"His" includes the expression "her";
"Offrce" means the office the Counry Executive Committee of
Kisii County Government;
"Personal Interest" means a matter in which a State Officer has e direct or indirect pecuniary or non-pecuniary interest and includes thc interest of his or her spouse, child, business associate or agent;
"Public Offrcer" has the meaning assigned to it under Article 2fl) of the Constitution;
"Regulations" mean the Regulations made by the Ethics and Anti-
Comrption commission pursuant to section 54 of the Act;
"Serving State Officer" means a State Officer who is in office at the time of commencement of this Code;
"State Officer" means a Member of the County Executivc
Committee of Kisii County Government;
Application of Chapter Six of the Constitution, the Leadership and
Inteqrity Act,2012 and the Publrc Officer Ethics Act,2003
_ 4. The provisions of Chapter Six of the Constitution, the kadership and Integrity Act, the Public Officer Ethics Act 2003 and shall form part of the code.

Commitmeilt to the Code
5. (l) A State Officer elected or appointed to the County Executive
Committee shall srgn and commit to this Code at the time of taking oath of office or within seven days of assuming office.
(2) A serving State Officer shall sign and commit to this Code within seven days of the pubhcation of the Code in the Gazefte.
(3) The declaration of commitment to the Code shall take the form and structure set out in the First Schedule to this Code
PART II_REQUIREMENTS
Rule of law
6. (l) A State Offioer shall respect and abide by the Constitution and all other laws.
(2) A State Officer shall carry out the dutiis of his or her office in accordance with the law.
(3) In carying out the duties of his or her office, a State Officer shall not violate the rights and fundamental freedoms of any person.
Public trusl
7. A State Office is a positron of public trust and the authonty and responsibility vested in a State Officer shall be exercised by the State
Officer rn the best lnterest of the office and the people of Kenya.
Responsibthty and duties
8. Subject to the Constitution and any other law. a State Officer shall take personal responsibility for the reasonably foreseeable consequences of any actions or omissions arising from the discharge of the duties of his or her office.
Performance ofduties
9. A State Officer shall, to the best of his or her ability
-
(a) carry out the duties of the office efficiently and honestly;
(b) carry out the duties of the office in a transparent and accountable manner:
(c) keep accurate records and documents relating to the functions of the office; and
@ report truthfully on all matters of the office.

10. A State Officer shall-
(a) cary out the duties of his or her office in a manner that maintains public confidence in the integrity of the office;
(b) treat members of the public, staff and other state ard pubhc ofFrcers with courtesy and respect;
(c) to the extent appropriate to the office, maintain high standards of performance and level of professionalism withrn the office and;
(d) rf the State Officer is a member of a professronal body, observe and subscribe to the ethical and professional requirements of that body in so far as the requirements do not contravene the Constitution, any other law or this Code.
Confidentiality ll. A State Officer shall subject to Article 35 of the Constitutron and ary other relevant law, not disclose or cause to be disclosed any information in his or her custody to any unauthorized person.
Financial integrity
12. (l) A State Officer shall not use his or her office to unlawfully or wrongfully enrich himself or herself or any other person.
(2) Sublect to article 76 (2) (b) of the Constitution a State Officer shall not accept a personal loan or benefit which may compromise hrm or her rn carrylng out his or her duties.
(3) a State Officer shall submit an initial declaration of rncome, assets and liabilities within thirty days of assumlng office and thereafter make biennial declarations to the office. and a frnal declaration within (30) days of ceasing to be a State Officer.
(4) The Declaration under sub-paragraph (3) shall be submitted to the County Public Service Board.
(5) A declaration filed by a State Officer in accordarce with the provisions of sub-paragraph (3) shall be accessible to the Commission and any other person, subject to the provisions of Section 30 of the
Public Officers Ethics Act, 2003.
(6) A State Officer shall pay any taxes, loans or other debts due from hrm wrthrn the prescrrbed perrod.
(7) A State Officer shall not neglect therr financial or legal obhgations.
Moral and ethical requtremettts
13. (1) A State Officer shall observe and marntain the following ethical and moral requirements-
(a) demonstrate horiesty in the conduct of hrs or her public and private affairs;
(b) not to engage in activitres that amount to abuse of office;
(c) accurately and honesty represent information to the public;
(d) not engage in wrongful conduct in furtherance of personal benefit;
(e) not misuse public resources;
A notfalsify any records;
(il not sexually harass or have inapproprrate sexual relattons with other State Officers, staff of the office or any other person;
(h) not engage in actions which would lead to the State Officers removal fiom the membership of a professronal body rn accordance wrth the law:
(i) not commlt offences and rn partrcular, any of the offences under parts XV and XVI of the Penal Code, Sexual offences
Act, 2006, the Counter- Traffickrng in Persons Act, 2008, and the Chrldren Act;
(j) not engage in fighting or physrcal confrontatron with any person; and
( k) maintain high standards of etlquette at all hmcs.
(2) A person who wishes to be appornted to a State Office shall for the purposes of this Code, submit to the Commission a self-declaration rn the form set out in the First Schedule to the Act.
(3) In respect to a person wishing to be elected to the offioe, the
Declaratron under sub-paragraph (2) shall be submitted to the
Independent Electoral and Boundaries Commission.
Gifis or benefits in kind
14. (l) A gift or donation giyen to a State Officer on a public or official occasron shall be treated as a gift or donahon to the office.
(2) Notwithstandrng subparagraph (l) a State Offrcer may recetve a gift grven to the State Officer rn officral capacity, provrded that-
(a) the grft rs wtthrn the ordrnary bounds of propnety, a usual expresslon of courtesy or protocol and wrthrn the ordrnary standards of hospitality;
(b) the gift is not monetary;
(c) the gift does not exceed the value of Kenya Shrllings twenty thousand or such other amount as may be prescribed by the
Commissron through Regulations
(3) A State Officer shall not-
(a) Accepl or solicit gifts, hospitality or other benefits from a person who-
(i) has an interest in any matter under consideratron by the
Office;
(ii) has a contractual relationship with the office;
(iir) has any interest that is directly or rndrrectly connected with the State Officers duties
(b) Recerve a gift which has the potential of compromrsing hrs or her integflty, objectivity or rmpartiality, or
(c) Accept any type of gift expressly prohibited under the Act.
(4) A State Officer who recelves a gift or donation shall declare the gift or donation to the Authorized Officer within seven days of receipt of the grft.
(5) The Office shall marntain a register of all gifts recerved by the
State Officers serving in the Office and another regrster of all grfts given by the office to other State or Pubhc Officers.
Wrongfiil or unlawful acquisition ofproperD, 15. A State Officer shall not use the offrce to wrongfully or unlawfully acquire or influence the acquisition of public or other property.
Confltct of mterest
16. (1) A State OfTrcer shall use the best efforts to avold being in a conflrct of interest sltuation where his or her personal interests conflict or appear to conflict wrth the State Officer's official dutres.
(2) Wrthout hmrtrng the generalrty of subparagraph (1), a State
Officer shall not hold shares or have any other interest in a corporatron, partnershrp or other body, directly or through another person, ifholdrng those shares or having that interest would result in a conflict of the State Officers and the officers official duties.
(3) A State Officer whose personal interests' conflict with their official dutres shall declare the personal interest to the office.
(4) The Office may give directions on the appropriate action to the taken by the State Officer to avoid the conflict of interest and the State
Offrcer shall comply with the directions. and refrain from participating in any deliberations with respect to the matter.
(5) Any direction issued by the office under sub paragraph (4) shall be in writing.
(6) Notwithstanding any directions to the contrary under subparagraph (4) a State Officer shall not influence the award of a contract to-
(a) himself or herself;
(b) the State Officer's spouse or chrld;
(c) a business associate or agent; or
(d) a corporation, private company, partnership or other body rn which the officer has a substantial or controlling interest.
(7) Where a State Officer is present at a meeting, and an issue which is likely to result in a conflict of interest is to be discussed, the
State Officer shall declare the interest at the beginning of the meeting or before the issue is deliberated upon.
(8) A declaration of a conflict of interest under subparagraph (7) shall be recorded in the minutes of that meeting.
(9) The Office shall marntain a register of conflrcts of interest in the prescribed form in whrch an affected State Ofhcer shall register the particulars of the registrable interests, statrng the nahrre and extent of the conflict.
(10) For purposes of subparagraph (9), the registrable intercsts shall include-
(a) the intercsts set out in the second schedule of the Act;
( b) any connection with a person, firm or a company, whether by relatron, friendship, holding of shares or otherwise, which is subject of an rnvestigation by the Constitunon;
(c) any apphcation for employment or other form of engagement with the office by a family member or friend of the State
Offrcer or by a law firm or corporation associated with the
State Officer;
(d) any application to the office, by a family member or friend of the State Officer, for clearance with respect to appointsnent or election to any public office;
(e) any other matter which, in the opinion of the State Officer, takmg mto account the circumstances thereof, is necessary for registration as a conflict of interest.
(11) The OfFrce shall keep the register of conflicts of int€rest for five years after the last entry in each volume of the register.
(12) The Office shall preparc a report of ttre rcgistered interests within thirty days after the close of a financial year.
(13) A State Officer shall ensure that an entry of registrable interests under subparagraph (9) is updated and to notify the offrce of any changes in the registrable interests, within one month of each change occurring.
Particryation in tenders invtted by the ffice
17. (l) A State Officer shall not particlpate in a tender for the supply of goods or services to the office.
(2) Nonpithstanding subparagraph (1) a company or entity associated with the State Officer shall not be construed as trading with the office, unless-
(a) the Starc Ofhcer has a controlling shareholding in the company or entity; or
(b) fte State Officer is a director of the company, or
(c) the State Officer is a managing partner in a law firm providing services to the office.
Public Collections
18. (1) A State Officer shall not solicit for contributions from the office or any other person or, public entity for a public purpose unless the President has, by notice in the Gazette, declared a national disrstcr and allowed a public collection for the purpose of the national disrstcr in accordance with the law.
(2) A State Officer shall not participate in a public collection of funds in a way that reflects adversely on the State Officers' integrity, impartiality or interferrs with the Performance of the official duties.
(3) Nothing in this clause shall be constructed as prohibiting a
State Officer from making voluntary contribution.
Bank accounts outside Kenya
19. (1) Subject to Article 16 (2) of the Constitution or any other written law, a State Officer shall not open or continue to opents a bank account outside Kenya wrthout the approval of the Commission.
(2) A State Officer who has reasonable grounds for opening or operating a bank account outside Kenya shall apply to the commission for approval to open or operate a bank account outside Kenya.
(3) A State Officer who operates or controls the operation of e bank account outside Kenya shall submit statements of thc account annually to the commission and authorize the commission to verify thc statements and any other relevant information from the foreign financial instrtution in which the account is held.
(4) Subject to subparagraph (l) and (2), a person who is appointcd as a State Officer in the office and has a bank account outside Kanya shall, upon such appointment close the bank account within 3 mmtts or such other period as the Commission may prescribe by notice in the
Gazette
(5) Subject to subparagraph (4) a State Officer may opcn or continue to operate a bank account outside Kenya as may bc authorized by the Commission in writing.
Acting for foreigners
20.(l) A State Officer shall not be an agent of, or further the interests of a foreign govemment, organization or individual in e manger that may be detrimental to the security interests of Kenye, except when acting in the course of official duty.
(2) For the purposcs of this paragraph-
(a) an individual is a forcigner if the individual is not a citizcn of
Kenya; and
(b) an organization is foreign ifit is established outsidc Kenyr or is owned or controlled by a foreign govemment, organizdion or individual
Care of property
21 (1) A State Officer shall take all reasonable steps to cnsura thrt public property in his or her custody, possession or control is trken care of and is in good repair and Condition.
(2) A State Officer shall not use public property, funds or scrviccs that are acquired in the course of or as a result of the official dutier, for private activities of activities that are not related to the official wort of the State Officer.
(3) A State Officer shall retum to the office all the public ptopcrty in his or her custody, possession or control at the end of the election or contract term.
(4) A State Officer who contravenes subparagraph (2) or (3) rhrlt, in addition to any other pcnalties providcd for under the Constitutim, the Act or any other law, bc personally liablc for any loss or damagc to the public property.
Misuse of oficial information
22. (l) A State Offrcer shall not directly or indirectly use or allow any person under the offrcer's authority !o use any Informrtiou obtained thmugh or in connection with the office, which is mt available in the public domain, for the furttrcring of any privae interest, whether financial or otherwise.

-
(a) pursuant to a court ordcr;
(b) for purposes of educational, res€arch, literary, scientific or other purposcs not prohibitcd by law; or

I lmpartiality
24. A State Officer shall, at all times, carry out the duties of the
Offrce with impartiality and objectivrty in accordance with principles and values set out in Articles 10, 27,'13 (2) (b) and 232 of the
Constitution and shall not practice favouritism, nepotism, tribalism, cronyism, religious bias or engage in other preferential freatrnent of another State Officer, Public Officer or a member of the public.
Giving of advice
25. A State Officer who has a duty to give advice shall give honest, accurate and impartial advice without fear or favour.
Offers of furure Employment
27. (l) A State Officer shall not allow himself of herself to be influenccd in the performance of his or her duties by plans or expeclations for or offers of future employment or benefits.
(2) A State Officer shall disclose, in writing, to the Commission, all offers of future employment or benefits that could place the State
Officer in a situation of conflict of interest.
Former state Oficer acting in a Bovernment or public ofice
28. A former State Offlicer shall not be engaged by the Offrce in a matter in which the State Officer was originally engagcd in as a State
Ofircer, for at least two years after leaving the off,rce.
Misleading the public
29. A State Officer shall not knowingly give false or misleading information to any person.
Fals ification of Re c ords
30. A Statc Officer shall not falsify any records or misrepresent information to the public.
Conduct of private ,4ffalrs
31. A State Officer shall conduct their private affairs in a manner that maintains public confidence in the integrity of the Office.
Bullying
32. (1) A State Officer shall not bully another State or hrblic
Officer or any other person.
(2) For purposes of subparagraph (l) "bullying" includes blackmail, coercion, thrpats, intimidation or repeated offensive behaviour which is vindictive, cruel, malicious or humiliating whether or not is intended to undermine a pennn and includes physical assault
Acting through others
33. (l) A State Officer shall not-
(a) cause anything to b€ done through anotherperson that would constitutc a contravention of tlis Code, the Constinrtion or any othcr law if done by the State Officer; or
(b) allow or direct a person under their supervision or control to do anything that is in contravcntion of this Code, the
Constitution or any other law.
(2) Subparagraph (1) (b) shall not apply where anything is donc without the Starc Offrcer's knowledgc or consent or if the State Officcr has taken reasonable Etcps to prevent it.

39. (1)A State Offrcer shall exercise independence in the discharge of his duties and shall not allow himself to be subjected to political or any other intemal or extemal influence that is defimental to public interest.
(2) A Statc Officer shall not influence of attempt to influcncc the decision of any other State or Public Officer or public entity on any matter.
(3) A State Officer shall not in any way interfere with the duties of any other State Officer Public OfFrcer or public entity.
Imple mentation of deve lopment projecls
,10. (l) A State Officer shall exercise prudence in thc undertaking of development projecs and shall at times prioritize projccts that arc most urgent for the public.
(2) For the purposes of sub-paragraph (1), a State Offrcer shall, bcfore planning for any project, !o the extent applicable, undertake and facilitate public and stakeholder participation in the determination of the projects to be implemented at any given time.
(3) A State Officer shall not undertake any project without prior planning or budgeting.
(4) A State OfFrcer shall not demand or accept any kickbacks, gifts, benefits or other favours from contractors-
(5) A State Offrccr shall not compromis€ or abet compromising of standards of any project implemented for the ofFrce.
(6) A State Officer shall, subject !o the law, disclose all relevant information regarding any project to any pcrson requiring such information.

PROVISIONS
Advisory opinion
45. A State Officer or the Office may request the Commission to give an advisory opinion on any rssue relating to, but not limited to-
(a) the application of chapter six of the Constitution;
(b) the application of the Act or anv other applicable law or rcgulations dealing wrth the ethics and integrity of State
Officers;
(c) the application of the Public Officer Ethics Act 2003, or any other law or regulations dealing with the ethics and integrity of Public Officers;
(d) the applicationof this Code;
(e) an ethical dilemma; or
(fi any other matter incidental to the promotion of the ethics and integrity of State Officers and Public Officers generally.
Training on Leadership and Integrity
46. The Office shall collaborate with the Commission to ensure that the State Officers and Public Officers serving in the Office are sensitized on leadership and integrity issues at least once a year.
Personal responsibility for compliance
47. EzLch State Officer shall take personal responsrbility or compliance with the provisions of this Code.
CitiTenship
48. (1) Subject to Article 78 (3) ofthe Constitution, a State officer who acquires dual citrzenship shall lose his or her position as a State officer.
(2) A person who holds dual citizenship shall, upon election or appointment to a State office, not take office before officially renouncing their other citizenship in accordance with the provisions of the Kenya Citizenship and Immigration Act, 201l, (No. l2 of 201 l.)
Annual Report
49. fie Authorized Ofhce or his designate shall cause to be prepared and submitted to the Commission an Annual Report on the progress made in implementation and enforcement of the Code in a prescribed format by the Commission.
Antendment of the Code
50. The Offrce may with approval of the Commission amend this
Code.
PART-MISCELLANEOUS
Application of the Code
51. In exercise of the power conferred by Sechon 37 of the kadership and Integrity Act, 2013, the Kisii County Govemment establishes this code of conduct and ethics for its state officers.
52. This Code applies to all State officers serving in Kisii County
Executive Committee. All State Officers of the county are obliged to familiarize themselves with this Code of conduct and commit themselves to observe its principles.
53. This Code will be used alongside other existing statutory provisions and instruments of good govemance, Integrity, ethics and anti-comrption including the following;

PURSUANT to section 37 of the I-eadership and Integrity Act, 2012the County Assembly of Baringo establishes this Leadership and
Integrity Code to be observed by and binding upon State Officers in the County Assembly.
PART I_STATEMENT OF INTENT
A Iradership and Integrity Code for State Officers in the County
Assembly of Baringo made pursuant to the provisions of Section 37 of the lradership and Integrity Act,2Ol2 and to give effect to Chapter
Six of the Constitution of Kenya. The Code is intended 0o establish standards of integrity and etrical conduct in the leadership and management of public affairs of the County Assembly by ensuring that the State Officers respect the values, principles and provisions of the
Constitution and other applicable laws or policies on the standards of conduct and performance expected of holders of public office in thc discharge of their duties.
PART II_PRELIMINARY PROVISIONS
Citation l. This Code may be cited as the Leadership and Integrity Code for
State Officers in the County Assembly of Baringo.
Commencement
2. This Code shall come into operation upon its publication in thc
Kenya Gazette.
Interpretation
3. In this code, unless the context otherwise requrres-
"Act" means the l,eadership and Integrity Act,20l2: (No. 19 of
20t2);
"Accounting OfficeC' means the Clerk of the County Assembly;
"Assembly" means the County Assembly of Baringo or a
Committee of the County Assembly;

"Authorized Officer" means the Speaker of the County Assembly or his designate;
"Bank Account" has the meaning assigned to it under section 2 of the Act;
"Business Associate" has the meaning assigned to it under section
2 of the Act;
"Code" means the [radership and Integrity Code for State
Officers in the County Assembly of Baringo.
"Commission" means the Ethics and Anti-Comrption Commission established under section 3 of thc Ethics and Anti-comrption commission Act, No. 22 of 20ll;
"Office" means the office held by a Member of County Assembly;
"Personal Interest" means a matter in which a Statc Officer has a direct or indirect pecuniary or non-pecuniary intercst and includes the interest of his or her spouse, child, business associate or agent;
"Public Officer" has the mcaning assigned to it under Article 260 of the Constitution;
"Regulations" means the Regulations made by thc Ethics and
Anti-Comrption commission pursuant to section 54 of the Act;
"Serving State Officer" means a State Officer who is in offtce at the time of commencement of this Code.
"State Officer" means a Member of the County Assembly of
Baringo, Application oJ Chapter Six of the Constitution, the Leadership and
Integrity Act,2012 and the Public Officer Ethics Act,2003
4. (l) The provisions of Chapter Six of the Constitution, the kadership and Integrity Act, the Public Officer Ethics Act 2003 and shall form part of the code.
Commitment to the Code
5. (1) A State Officer elected to the Assembly shall sign and commit !o this Code at the time of taking oath of office or within seven days of assuming office.
(2) A serving State Officer shall sign and commit to this Code seven days after the publication of the Code in the gazette.
(3) The declaration of commitment to the Code shall take the form and structure set out in the First Schedule to this Code.
PART III_ REQUIREMENTS
Rule ofLaw
6. (l) A State Officer shall respect and abide by the Constitution and all other laws.
(2) A State Officer shall carry out the duties of his or her office in accordance with the law.
(3) In carrying out the duties of his or her office, a State Offrcer shall not violate the rights and fundamental freedoms of any person.
Public trust
7. A State Office is a position of public trust and the authority and responsibiliry vested in a State Officer shall be exercised by th€ State
Officer in the best interest of the office and the people of Kenya.

8. Subject to the Constitution and any other law, a State Officer shall take personal responsibility for the rcasonably foreseeable consequences of any actions or omissions arising from the discharge of the duties of his or her office.
Performance oJ duties
9. A State Officer shall, to the best of his or her ability
-
(a) carry out the duties of the office efficiently and honestly;
(b) carry out the duties of the office in a transparent and accountable manner;
(c) keep accurate records and documents relating to the functions of the offrce; and
(d) repoft truthfully on all matters of the office.
ProJessionahsm
10. A State Officer shall-
(a) carry out the duties of his or her offrce in a manner that maintains public confidence in the integrity of the office;
(b) |aeal members of the public, staff and other state and public officers with courtesy and respect;
(c) to the extent appropriate to the office, maintain high standards of performance and level of professionalism within the office and;
(d) it the State Officer is a member of a professional body, observe and subscribe to the ethical and professional requirements of that body in so far as the requirements do not contravene the
Constitution, any other law or this Code.
Financial integrity

) A State Officer shall not use his or her office to unlawfully or wrongfully enrich himself or herself or any other person.
(2) Subject !o article 76 (2) b) of the Constitution a State Officer shall not accept a personal loan or benefit which may compromise the
State Officer in carrying out his or her duties.
(3) A State Offrcer shall submit an initial declaration of income, assets and liabilities within thirty days of assuming office to the
Accounting offrcer of the office, and to any other office or body as prescribed by law, and thereafter make biennial declarations to the ofFrce, and a final declaration within (30) days of ceasing to be a State
Officer.
(4) Thc Declaration under sub-paragraph (3) shall be submitted to thc County Assembly Service Board.
(5) A declaration filed by a State Officer in accordance with the provisions of sub-paragraph (3) shall be accessible to the Commission and any other person, subject to the provisions of Section 30 of the
Public Officer Ethics Act,2003.
(6) A State Officer shall pay any taxes, loans or other debts due from him within thc prescribed period.
(7) A State Officer shall not neglect their financial, family or other legal obligations.
Moral and ethical requirements
12. (l) A State Officer shall observe and maintain the following ethical and moral requirements-
(a,) demonstrate honesty in the conduct of his or her public and private affairs;
(D) not to engage in activities that amount to abuse of office;
(c) accurately and honesty represent information to the public;
(d) not engage in wrongful conduct in furtherance of personal benefit;
(e) not misuse public resources;
(/) not falsify any records;
(g) not sexually harass or have inappropriate sexual relations with other State Officers, staff of the office or any other person;
(h) not engage in actions which would lead o the State Officers removal from the membership of a professional body in accordance with the law;
(l) not commit offences and in particular, any of the offences under parts XV and XVI of the Penal Code, Sexual offences act,2006, the Counter- Trafficking in Persons Act,2008, and the Children Act;
ff) not engage in fighting or physical confrontation with any penron.
(2) A person who wishes to be elected or nominated to office shall, for the purposes of this section, submit to the Independent
Electoral and Boundaries Commission a self-declaration in the form set out in the First Schedule to the Act.
GiJts or benefts in kind
13. (l) A gift or donation given to a State Offrcer on a public or official occasion shall be treated as a gift of donation to the office.
(2) Notwithstanding subparagraph (l) a State Officer may receive a gift given to the State Officer in official capacity, provided that
-
(a) the gift is within the ordinary bounds of propriety, a usual expression of courtesy or protocol and within the ordinary standards of hospitality;
(b) the gift is not monetary;
(c) the gift does not exceed the value of Kcnya Shillings twenty thousand or such other amount as may be prescribed by the
Commission through Regulations.
(3) A StBte Officer shall not-
(a) Accept or solicit gifts, hospitality or ofher benefits from a person who-
(i) has an interest in any matter under consideration by the
Assembly;
(ii) has a contrachral relationship with the office;
(iii) has any interest tlrat is directly or indirectly connected with the Strte Officers duties.
( b ) Receive a gift which has the potential of compromising his or her integrity, objectivity or impartiality or
(c) Acccpt any type of gift exprcssly prohibited under the Act;
(4) A Statc Officer who receives a gift or donaiion shall declare firc gift or donation to the Authorizcd Officer within seven days of rccoip of thc gifr
(5) Thc Office shall maintain a rcgister of all giffc rcccived by the state Offrcers serving in the OfFrcc and another register of all gifts givcn by thc officc to other Strte or Public OfFrcers.

Care of property
20 (1) A State Officcr shall takc all reasonable steps to ensure that public property in his or her custody, posscssion or control is taken care of and is in good repair and Condition.
(2) A State Offrcer shall not use public property, funds or scrvices that are acguired in the coursc of ot as a result of the offrcial dutics, for activitics that are not relatcd to the official work of the State Officcr.
(3) A Statc Officer shall retum to the office all the public property in his or hcr custody, possession or eontrol at the cnd of the election or contract tcnn.
(4) A Stet€ Officer who cofltravenes subparagraph (2) or (3) shall, in addition to any other penalties provided for under thc Constitution, the Act or any other law, be personally liable for any loss or damegc to the public
Foperty.
Misuse of oficial inlormation
21. (l) A State Offrccr shall not directly or indircctly usc or allow any pcrsoil under the officers authority to use any Information obtained through or in connection with the officc, which is not availablc in thc prblic domain, for the furthcring of any private intereet, whetfter financial or otherwise.
(2) A SBte Officer shall not be deemcd to havc violated the requirements of subparagraph (l), if thc information givcn-
(a) pursuant to a court order;
(b) tor gtttpo*,s of cducational, rcsearch, literary, scientific or othcr purposes not prohibircd by law; or
(c) in compliance with Articlc 35 of thc Constitution and the relevant law.
Impartiality
22. A Statg officer shall, at all times, carry out the duties of the
OfFrce widr impartiality and objectivity in accordance with principlcs and values sct out in Articles 10, 27,73 (2) (b) and 232 of thc
Constitution and shall not practice favouritism, nepotism, tribalism, cronyism, religious bias or engege in other prefercntial treatment of anothcr State Officer, Public Offrcer or a member of the public.
Giving of advice
23. A State Officer who has a duty to give advice shall give honest, accurate and impartial advice without fear or favour.
Offe r s oJ fu tu re Emp loy ment
24. (l) A State Officer shall not allow himself or herself to bc influenced in the performance of his or her duties by plans or expectations for or offcrs of futurc employment or benefits.
(2) A State Officer shall disclose, in writing, to the Commission, all offers of futurc employnrent or bencfits that could place the Statc
Officer in a situation of conflict of interest.
Former state Oficcr acting in a government or public ofice
25. A former Statc Offrcer shall not be engaged by the Offrce in a matter in which the Statc Officer was originally engaged in as a State
Officer, for at lcast two years after leaving the office.
Misleading the public
26. A State Officer shall not knowingly give false or misleading information to any person.

27. A Slate Officer shall not falsify any records or misrepresent information to the public.
Citizenship
28. (1) subject to Article 78 (3) of the Constitution, a state off,icer who acquires dual citizenship shall lose his or her position as a state officer.
(2) A person who holds dual citizenship shall, upon election or appointment to a state ofFrce, not take office before officially renouncing their other citizenship in accordance with the provisions of the Kenya Citizenship and Immigration Act, Z) I I , (No. I 2 of 201 I .)
Conduct of private Mdirs
29. A State Officer shall conduct their private affairs in a manner that maintains public confidence in the integrity of the Office.
Bullying
30. (l) A State Officer shall not bully another State Officer, a member of staff or any other person.
(2) For purposes ofsubparagraph (l) "bullying" includes repcated offensive behaviour which is vindictive, cruel, malicious or humiliating whethcr or not is intended to undermine a person and includes physical assault.
Acting through others
31. (l) A State Officer shall not-
(a) cause anything to be done through another person that would constitute a contravention of this Code, the Constitution or any other law if done by the State Offrcer; or
(b) allow or dircct a person under their supervision or control to do anything that is in contravention of this Code, the Constitution or any other law.
(2) Subparagraph (l) (b) shall not apply whcre anything is done without thc State Officer's knowledge or consent or if the State Officer has taken reasonable steps to prevent it.
Reporting improper orders
32. If a Statc Officer considers that anything required of him or her is in contravcntion of the Code or is otherwisc improper or uncthical, the State Officer shall report the matter to the Commission.
(2) The Commission shall investigate dre report and take appropriatc action within ninety days of receiving the report.
Duty to preveat occurrence oJ corruption or unethical practice in the ffice
33. A State Offrcer who believcs or has reason to believe comrpt act or unethical malpractice has occurred or is about to occur in the office shall takc all necessary measures to prcvent it from continuing or materializing in addition to any other appropriate action.
Use of Social media
34. A Strte Officer shall not use social media in a manner that is prejudicial to public inter€st, national cohesion or that otherwise constitutes a breach of any law.
Dress code
35. A State Officer shall maintain appropriate staldard of dress and personal hygiene at all times.
Political and other Inlluence
36. (l) A Statc Offrcer shall exercise independence in the discharge of his duties and shall not allow himself to be subjected to political or any other intemal or cxtcrnal influencc that is detrimental to public interesL
(2) A Statc Offrcer shall not influence or attempt to influence the decision of any other State or Public Officer or public entity on any matter.
(3) A State Officer shall not in any way inerfere with thc duties of any other Starc Officer, Public Officer or public entity.
Provisions relating to implcmentarton of projects
37. (1) A State Officer shall in the exercise of oversight over implementation of projects not interfere with such implenrentation in any way.
(2) A State OfFrcer shall not influence the undertaking of any project without prior planning or budgeting.
(3) A State OfFlccr shall not dcmand or accept any kickbacks, gifts, benefis or other favours from contractors or other persons or entities who are engaged in implementation projects.
(4) A State Officer shall not compmmise or abet comprising of standards of any projcct.
(5) A State Officer shall, subject to the law, disclose all rel,evant information regarding any project to any p€rson requiring such information.
PART IV_ENFORCEMENT OF THE CODE
38. (1) any person may lodge a complaint alleging a breach of this code by a State Officer to the Authorized Officer or to the commission.
(2) Breach of this Code amounts to misconduct for which the State
Officer may be subjected to disciplinary proceedings.
(3) Wherc a Breach of this code amounts to violation of the
Constitution, the State Officer may be removed from the office in accordance with the applicable laws.
(4) Where an allegation of breach is made to the Office, the person alleging the breach shall submit a petition setting out the grounds and facts of the alleged violation to the Authorized Officer of the Offrce.
(5) I rpon receipt of thc Complaint, the Office shall register and carD/ our investigations into the complaint, and may take action against t, e State Officer in accordancc with thc Standing Orders of the
Assembly, the Act and any Regulations made by the Commission under the Act.
(6) If upon investigation into the alleged breach of the Code, the
Offrce is of the opinion that civil or criminal proceedings out to be preferred against the respective State Officer, it shall rcfer the matter to-
(a) the Commission, with respect to civil matters; and
(b) the director of Public Prosecutions with respect to criminal matters.
(7) Where the complaint is made to the Commission, the
Commission shall oke such action against the State Offrcer as it deems necessary in accordance with its mandarc under the law.
(8) Notwithstanding sub-paragraph (5), the Commission may, subject to the law, take any additional action it deems appropriate in relation to any brcach of the Code or require the Office to take any action against a State Offrce who has breached the Code.
Victimization
39. A State OfFlcer shall not in any way victimize any other State
Officer or Public Officer or any other person for any lawful action or omission.
Duty of Authorized Officer and Accounting Oficer to comply with direcrtves oJ the Commission in implementation of the Code
40. The Authorized Offrcer or Accounting Officcr of the Office shall at all times comply with such orders or directives as may be issued by the Commission from time to time towards the implementation and enforcement of this Code.
PART V _ GENERAL PROVISIONS
Advisory opinion
41. A State Officer or the ofFrce may requcst the Commission to give an advisory opinion on any issue relating to, but not limited to-
(a) the application of chapter six of the constitutiou
(b) the application of the Act or any other applicable law or regulations dealing with the ethics and integrity of Starc
Officers;
(c) the application of the Public Offrcer Ethics Act 2003, or any other law or regulations dealing with the ethics and integrity of public officers;
(/) thc application ofthis Code;
(e) an cthical dilemma; or
(f) any other matter incidcntal to the promotion of the ethics and inrcgrity of Starc Offiicers and public officers generally.
Training on lzadership atrd Integrity
42. The office shall collaborate with the C-ommission to ensure that the State Officers and public officers serving in the Officc are sensitized on leadership and integrity issues at lcast once a year.
Pe rsonal responubility fo r comp liance
43. Each State Officer shall take personal responsibility or compliance with the prr visions of this Code.
Annual Report
44. The Authorized Officer or his designate shall cause to be prepared and submitted to the Commission an Annual Report on the progress made in implementation and enforcement of the Code in a prescribed format by the Commissron.
