THE COMPETITION ACT
REGISTRATION
PURSUANT to provrsions of sectron 25 (3) of the Competitron
Act, 2010, the Competition Authority of Kenya wishes to notify the public that the East African Tea Trade Association (EATTA) has made an application under section 25(1) of the Competition Act, 2010 for an exemption from the application of Part III A and B of the Act for an indefiute period.
The East African Tea Trade Associatron ls a voluntary non-profit making umbrclla body representing the interests of the tea industry rn
Africa. The East African Tea Trade Association was regrsrcred in 1956 and has two hundred members drawn from ten countnes all actively engaged in growing, buying, brokering and warehousrng tea. The
Association's principal mandate is to run the weekly Mombasa Tea
Auction Centre, currently one of the largest Tea Auction Centres in the world and the only one dealing with tea from more than'one country.
The excmption application seeks exemphon from the provrsions relating to-
(a) the unjustifiable exclusron from a trade a.ssociatron of any person intending to carry on in good farth the trade rn which the association is formed, such as-
(i) tradrng only permitted amongst members;
(rr) broker members tr) be the only ones to offer tea tbr sale, and thus being the only ones to produce auction catalogues Similarly. producer members not to act as broker members;
(iii) broker members to only deal with producer members and buyer members and those represenhng non-members to provide a bank guarantee that is renewable annuallyi
(iv) members not allowcd to deal wtth brokers who are not membersl
(v) producer members not to act as brokers;
(vi) members not to dcal with non-mernbers or else a financial penalty will be rmposed on them as if they were applying for membershrp afresh; and
(vir) buyer members not allowed deaLng with brokers who are not members.
(b) the direct or Indlrect making of a recommendation by a trade association or its members or any class of its members in relation to prices or the terms of trade such as-
0) setting broker fees and commissrons;
(ii) joint determination of penalties;
(iii) prohibiting brokers from offering discounts;
(iv) broker members to collect from both buyers and producers the full brokerage commissiorr and charges, (v) charge per lot to be paid to the bnrker to defray catalogurng expenses; and
(vi) settrng of warehouse fees.
All interested partres may, withrn thrrty (30) days of the publication of this notrce, submit any written representatrons regarding the application.
