INSTITUTIONAL FRAMEWORK FOR TIM JOINT NATIONAL
AND COUNTY GOVERNMENTS CAPACITY ASSESSMENT
AND RATIONALZATION OF THE PUBLIC SERVICE
PROGRAMME
IT IS notified for the general information of the public that, followrng the reorganization of the National Govemment, the end of the transition period and in order to comply with the legal provisions, the Cabinet' Secretary responsible fot Public Service has, in furtherance of the decrsion of the Summit to implement a joint capaclty assessment and rationalization programme for the public service at the National and County levels of Govemment, establishes the following Institutional Framework for the Joint National and
County Govemments Programme.
INTER-GOVERNMENTAL STEERING COMMITTEE l. There is established the Inter-Govemmental Steering
Committee.
2. The Inter-Governmental Steerrng Committee comprises of-
(a) the Cabrnet Secretary responsible for Public Service;
(0,) the Cabinet Secretary resPonsible for Devolution and Planmng;
(c) the Cabinet Secretary responsible for the National Trqasury;
(d) thc Cabinet Secretary responsible for Inrcrior and Co- ordination of National Govemment;
(e) the Cabinet Secr€tary rcsponsible for Labour;
(fl the Chairperson of the Councrl of Governors;
(g) the Chairperson of the Public Service Commission;
(h) the Chairperson of the Salaries and Remuneration
Commission;
(i) the Chairperson of the Commission foi Revenue Allocation;
f) the Chairperson of the Human Resources, Labour and Social
Welfare Commrttee of the Council of Govemors;
(ft) three members of the Human Resources, [.abour and Social
Welfare Committee of the Council of Governors;
(/) the Chairperson of Inter-Govemmental Relations Technical
Committee;
(m)the Chaftperson of Kenya Law Reform Commission; and
(n) the ABomey-General
3. The Cabinet Secretary responsrble fot Pubhc Service and the
Chairperson of the Council of Govemors shall be the Co{hairpersons of the Inter-Govemmental Steering Committee.
4. The functions of the Inter-Governmental Steering Committee ane-

(a) to provide vision, leadership and policy direction for the
Capacity Assessment and Rationalization of the Public Service.
Programme;
(6) to oversee the Jornt Capacity Assessment and Rationalization of the Public Servrce Programme; and i

(c) to report on the implementation of the Capaciry Assessment and Rationalization of the Public Service Programme to the
Summit established under section 7 of the Inter-Govemmental
Relations Act,2ol2.
5. The Inter-Govemmental Steering Commitbe may co-opt other members as may be required to better perform its functions.
6. The Inter-Govemmental Steering Committee shall meet at least two times in a year at such times and places as may be appropriate.
INTER-AGENCY TECHNICAL COMMITTEE
7. There is established the Inter-Agency Technical Committee.
8. The Intcr-Agency Technical Committee comprises of-
(a) the hincipal Secretary responsible for Public Servicel
(D) the Principal Secretary responsible for Devolution;
(c) the Principal Secretary responsiblc for Planning;
(d) the Prircipal Secretary responsible for Labour;
(e) the Principal Secretary responsible for Interior;
(/J the Principal Secretary responsible for the National Treasury;
(9) the Sol.icitor-General;
(ft) the Secretary to the Public Service Commission;
(i) the Principal Administrative Secretary, Dircctorate of Public
Service Management;
f) the Pensions Secretary in the National Treasury;
(*) the Secretary to the Salaries and Remuneration Commission;
(/.) a representative of the Council of Govemors;
(rz)a rcpresentative of County Public Service Boards;
(n) a representative ofCounty Assembly Service Boards;
(o,) a representative of the Kenya lnstitute of Public Policy
Research and Analysis;
(p.) a representative of the Union of Kenya Civrl Servants;
(4) a representative of theKenya County Govemment Workers
Union;
(r) a representative of the Iiler-Govemmental Relations Technical
Committee;
(s) a reprcsentative of the Kenya I-aw Reform Commission;
(r) a representative of the Trade Unions Congress of Kenya;
(u) two persons representing the Private Sector in Kenya appointed, by the Cabinet Secretary Public Service, Youth-and Gender
Affairs; and
(v) three persons with expertise and experience in public sector rcstructuriilg appointed by the Cabinet Secretary responsible for Public Service.
9. The functions of the Inter-Agency Technical Committce are-
(a) to provide overall management ofthe Capacity Asscssment and
Rationalization of the Public Service Programme;
(6) to implement the policy dtrections of the Inter-Govemmental
Steering Committee;
(c) to provide technical assistance to Ministries, Departrnents and
County Governmenb;
(d) to faclitae consultation with Ministries, Departmens, County
Govemments and Administratorc of Schemcs of Service for public officers affected by the Capacity Assessment and
Rationalization of the Public Service Programme;
(e) to approve activities for the implementation of the Capacity
Assessment and Rationalization of the Public Service
Programme;
(fl to monitor and evaluate the Capaciry - Assessment and
Rationalization of the Public Scrvice Programme;
(gl to oversee preparation of the framework for the Capacity
Assessment and Rationalization of thc Rrblic Service
Programme which includes
-
(i) policy guidelines:
(iD principles of capacity assessment and rationalization;
(rii) criteria for capacity assessment and rationalization;
(iv) appealmechanisms;
(v) institutional arrangements for the implementation of the framework for the Capacity Assessment and

Rationalization of the Public Service Programrhe; and
(vi) monitoring and evaluation strategies.
(i) to develop a communications strategy for, the Capacity
Assessment and Rationalization of the Public Service
Programme;
(i) to develop kaining and sensitization materials for the implementation of the programme;
(J) to develop an implementation plan for the Capaciry
Assessment and Rationalizarion of the Public Service
Programmei
(t) oversee Ere appointment of a consultant where necessary and supervise consultant in the execution of the consultant's duties;
and
(/) mainstream gender, youth and prsons with disability concems in the implementation of the Capacity Assessment and
Rationalization of the Public Service Progr4mme.
10. The Inter-Agency Technical Committee shall-
(a) hold meetings as may be necessary for the discharge of its functions and in any case, at least once in a month, at places and times that it shall consider proper;
(b) regulate its own procedure; and
(c) co-opt other persons as shall be required by the Inter-Agency
Technical Committee for the performance of its functions.
I 1. (1) The Principal Secretary responsible for Public Service; and the representative of the Inter-Governmental Relations Techntcal
Committee shall be the co-chairpersons of the Inter-Agency Technical
Committee.
(2) The Principal Administrative Secietary, Directorate of Public
Scrvice Management shall be the alternate Co-Chairperson !o the
Principal Secretary.
INTER-AGENCY SECRETARIAT l2.Therc is established an Inter-Agency Secretariat which comprises of representatives from-
(a) the State Department of Public Service;
(6) the State Department of Planning;
(c) the State Departrnent of Devolution;
(d) the State Department of Labour;
(e) the State Department of Interior;
(/J the National Treasury;
(g) the Pensions Department of the National Trcasury;
(ft) the Public Service Commission;
(i) the Office of the Attomey-General and Department of Justice;
f) the Salaries and Remuneration Commission;
(k,) the Council of Govemors; and
(/) the Inter-Govemmental Relations Technrcal Committee.
13. The functions of the Inter-Agency Secretariat shall be to-
(a) co-ordrnab the implementation of tre decisions and directions of the Inter-Agency Technical Committee;
(D) provide technical assistance and support to thc rationalization technical comrnittees of ministrics and departments and the rationalization steering and technical committees of County
Governments;
(c) faclhtab the work ofa consultant;
(d) co-ordinate and facilitate the sensitization and training activities;
(e) receive analyzed rcports and submit to Inter-Agency Technical
Committee;
(fl bnsure compliance with the guidelines; and
(9) monitor and evaluate the Capacity Assessment and
Rationalization of the Public Service kogramme and submit rcports.
14. The Inter-Agency Secrctariat shall-
(a) hold meetings as often as is necessary for the discharge of its functions:
(b) regulate its own procedure; and
(c) co-opt other persons as shall be required for the Inter-Agency
Sgcretariat for the performance of its functions.
15.The Inter Agency Secretariat shall be chaired by the representative from the State Depanment of Public Service, Directorate of Public Service Management.
MINISTERIAL OR DEPARTMENTAL RATIONALIZATION
TECHNICAL COMMMTEES
16. Each ministry or departmefit shall establish a rationalization technical committee.
lT.Erch rationalization technical committee shall be responsible to the Inter-Agency Technical Committee for the overall implementation of the Capacity Assessment and Rationalization of the

Service kogramme in the ministry or department and as such shall-
(a) undcnake institutional review of the Ministry or Department;
(D) assess skills and competencies required including det€rmining optimal Stafflrtg;
(c) establish existing human resource capacity in the Ministry or
Dcpartment in terms of numbers ahd skills;
(d/ idcftify staffeligiblc for re-dcployment, hansfer or separation;
(e) sensitize afld train on thc implemenution of thc programmei
(/ submit repons to thc Inter-agency Technical Committee; and
(g/ generally implement the programme in their reepeetive
Ministry or Department.
lE. Each Rationalization TeehnicBl Committee comprises of:

19. A Rationalization Technical Committee shall-
(a) hold meetings as may be necessary for the discharge of its functions and in any casg, at least once in a month, at places and times that it shall consider propei;
(D) regulate its own procedure; and
(c) co-opt other persens as shall be required by the Technical
Committee for the perforrrance of its funetions.
COUNTY RATIONALZATION STEERING COMMITTEES
20. Each County Govemment shall establish a County
Rafionalization Steering Comrnittee to be chaired by the respecttve
Governor and comprising of the following-
(a) Executive Committee Members;
(D) Chairperson of the Counfy Public Service Board;
(c) Chairperson County Assembly Service Board;
(d/ Union Representarive;
(e) County Commissioner;
(/J Representative, State Department of Labour;
(g) Representative of Inter-Govemmental Relations Technical
Committee;
(ft) County Attomey; and
(l) County Secretary, who shall be Secretary to the Committee.
21. The functions of the County Rationalizatron Steering
Committees shall be to-
(a) provide yision, leadership and policy direction for the Capacity
Assessment and Rationalization of the Public Service
Programme in the County;
(b) oversee the implementation of the Capacity Assessment and
Rationalization of the Pubhc Service Programme in the
County;
- (c) work in consultation with Inter-Agency Techhical Committee and'prepare periodical reports to thc Inter-Agency Technical
Committee;
(d) approve and implement sensitization and training programs;
and
(e) veify the lists of the staff identified for re-deployment, tmnsfer or separation, if any.
22. The County Rationalization Ste€ring Committee shall-
(a) hold meetings at least once in a month for the discharge of its functions and, at places and times that it shall consider proper;
(b) rcgulate its own procedure; and
(c) co-opt other persons as shall be required by the Counry
Rationalization Steering Committee for the performance of its functions.

COUNTY RATIONALIZATION TECHMCAL TEAM
23.Each County Govemment shall establish a Rationalizaiion
Technical Tcam which shall be chaked by thc mcmber of thc nlevant

(i) implement the Capacity Assessment and Rationalization of the
Pubhc Service Programme in the County.

A Rationalization Technical Team shall-
(a) hold at least two meetings in a year at places and times that it shall consider proper;
(b) regulate its own procedure; and
(c) co-opt other persons as shall be required by the Technical
Team for the performance of its-functions.
