THE ENVIRONMENTAL MANAGEMENT AND CO-ORDINATION (AMENDMENT) ACT

AMENDMENT

the following notice: That charcoal production and transportation for commercial purposes within ElgeyofMarakwet County is suspended indefinitely until a substantive County legislation is passed to regulate the process. That any transportation of charcoal sourced from neighbouring Counties shall only be done upon obtaining Consent from the County Environment Committee. That any person found to be producing and/or transporting charcoal for commercial purposes during the suspension period shall be deemed to have committed a general offence under the principal Act and shall be liable to the general penalty under section 144 of the Principal Act. That this Notice is informed by and a result of the following grounds. The wanton and unregulated charcoal production and transportation has resulted in gross environment degradation resulting in severe water shortage and reduced agricultural productivity. The local communities have been exploited by being paid negligible fees for their labour and compensation for their roads access and resources. Dated the 1st February, 2016. S.
