E22 OF 2024 ASSETS RECOVERY AGENCY—(Applicant) VERSUS HARRISON MWAURA NJOROGE—(Respondent) BEFORE HON. JUSTICE PROF (DR.) SIFUNA IN CHAMBERS ON 11TH JUNE, 2024 THIS MATTER coming up before Hon. Justice Prof (DR) Sifuna on 11th June, 2024 for directions of Application dated 10th June, 2024 brought by Counsel for the Applicant under Certificate of Urgency under sections 81 and 82 of the Proceeds of Crime and Anti- Money Laundering Act and Order 51 rule 1 of the Civil Procedure Rules, and upon reading the supporting affidavit of Jackson Kimani sworn on 10th June, 2024 and the annextures thereto; IT IS HEREBY ORDERED 1. THAT this application be and is hereby certified as urgent. 2. THAT a Preservation Order be and is hereby issued prohibiting the Respondent or their employees, agents or any other person acting on their behalf from prohibiting the sale, transfer, or disposal off or other dealings with the following motor vehicles; (i) KBZ 537B (ii) KBX 241J (iii) KBB 787M (iv) KCX 967Y 3. THAT the Respondent be and is hereby directed to surrender the original logbooks of the motor vehicles and the motor vehicles specified in order 2 above to the Applicant forthwith. 4. THAT in the event the Respondent fails to surrender the above motor vehicles as specified in order 2 above, the Applicant be at liberty to seize and detain the motor vehicles specified therein. 5. THAT an order be and is hereby issued directing the Director- General of National Transport and Safety Authority to register caveats against the records of the motor vehicle specified in order 2 above.
