GAZETTE NOTICE NO. 12011

PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environmental Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the implementation of the proposed Juja Estate Development on plot L.R. No. 17564/255 and 17564/256, Thika, Kiambu County. The Proponent (Juja South Estate Limited) of the proposed Juja Estate development is proposing to carry on construction of residential apartments, shopping facilities and a public school. The development will comprise of ground, first, second and third floors. The following are the anticipated impacts and proposed mitigation measures: Possible Impact Mitigation measures Vegetation clearing  Minimal clearing of vegetation.  The Project Manager in collaboration should ensure that those trees that are to be protected insitu should be protected, clearly identified on the construction plan.  Removal of vegetation to take place only within demarcated construction site.  Non-essential removal of vegetation to be avoided.  No development on slopes with a gradient > 16%. Re-vegetation should incorporate natural vegetation. Solid waste management  Efficient use, re-use and re-cycling of materials to minimise on solid waste.  Segregation of waste before appropriate disposal.  The contractor should provide disposal bin around the site.  Paper and glass to be sent for reuse/ recycling.  The contractor should prepare a waste management plan for management of solid waste. Liquid waste  Concrete batching and mixing should occur at one particular point and the site should be bunded or paved.  Contaminated water from construction works should be directed to a containment area where it could be reused at the construction site.  Portable toilets should be provide on site so as to mitigate pollution of subsurface water in case where pit latrine are used Noise and vibration pollution and visual intrusion  Schedule noisy activities during the normal working hours of between 8am to 5pm.  Ensure that the operation of the existing quarrying do not exceed 0.5 centimetres per second beyond any source, property boundary or 30 metres from any moving source.  Asses the risk of the quarry to the development and liase with the qurry owner and the authority to ensure that the risk of the quarry are asseded and an informed decision taken.  Put off machines and equipments when not in use.  Ensure machinery is well maintained to reduce noise emitted;  The contractor should adhere to the provision in the Environmental Management and Coordination (Noise and Excessive Vibration pollution) (control) regulations, 2009.  Provide worker with appropriate PPEs when working under noisy environment e.g. ear plugs  Site vegetation correctly according to rehabilitation guidelines stated in the EMP; and Air/dust pollution  Practice dust management techniques, including watering spraying to suppress dust.  Move earth and sand in covered vehicles/ transport.  All plant to be of good condition with acceptable smoke emissions.  Practice selective clearing of vegetation.  Set up dust barriers/ screens at strategic locations.  Provide and enforce the appropriate use of Personal Protective Equipment (PPE) 24th August, 2012 THE KENYA GAZETTE against dust. Soil erosion and sedimentation  Practice selective vegetation clearing where necessary.  Install adequate storm water management measures such as sand filters, wet ponds.  Replant cleared vegetation as soon as possible and landscape the cleared areas.  Avoid vegetation clearing especially on steep slopes during the rainy season.  Schedule earth moving activities during the dry season. Increased water demand due to construction works  The contractor should sensitize construction workers on the importance of proper water management.  Replace or repair leaking pipes supplying water to the construction sites to minimized wastage from leakages or pipe burst.  The Contractor should ensure provision of adequate water storage facilities on the construction site.  Reuse of waste water from the construction activities for curing of concrete surfaces and cleaning of equipment.  Direct construction water runoff to areas where it can soak into the ground or be collected and reused.  Lock water tank valves to prevent unauthorized use.  Repair water equipment as needed to prevent unintended discharges. Occupational health and safety  Provide Personal Protective Equipment  Train workers on personal safety and how to handle  equipments and machines  Contractor should contract a qualified Health and Safety advisor to conduct training and monitoring of construction works;  The Contractor should train several workers in First  Aid;  Workers should be inducted with training on health  and safety by DOSHS certified health and safety  advisor;  Report any accidents / incidences and treat and  compensate affected workers  Provide sufficient and suitable sanitary conveniences which should be kept clean  Provide and enforce the use of Personal Protective Equipment (PPE);  The contractor should provide install fire fighting equipment;  The Contractor should erect safety and informative signages;  The contractor should develop site Health and Safety guidelines;  Maintain an incident/ accident register; Fire risk and management  Place portable fire extinguishers at suitable locations;  Smoking on site or burning of waste should be prohibited;  Electrical works such as electrical wiring should be done by qualified technicians or engineers  Train and induct workers on the use of fire extinguishers and other fire fighting equipments;  Allocate a fire assembly point;  Ensure fire safety warnings are prominently displayed at appropriate locations where fires are likely to occur;  Develop a Fire Safety Plan through a qualified specialist and implement the provision of the plan at the workplace Loss of biodiversity  vegetation within the drainage lines is not to be cleared;  modifications to the design of the development to ensure spaces are left to allow for regeneration of loss biodiversity;  Post project restoration of loss habitat through re-vegetation of affected areas Ground and surface water quality  No water abstraction for construction from streams or river;  No construction activities to occur in any wetlands;  No concrete batching to occur directly on the ground. Concrete batching area should be bunded to prevent contamination of soils and surface water features;  Plant to have drip trays to contain any potential leakages of fuels and oils; and Electricity usage  Erect a meter in the premises to check on total kilowatts used and for billing purposes.  Switch off light that are not in use.  Use of energy conserving bulbs/ tubes.  Use of natural light for lighting purposes  Use natural ventilation from windows and doors and avoid using Air Con that use electricity.  Provide a standby generator in the premises in cases power goes out.
