GAZETTE NOTICE NO. 12740

PURSUANT to the provisions of section 23 (1), (2) and (3) of the Physical Planning Act, all that area of land measuring approximately 30,690.586 ha. (75,838.44 acres) covering parts of Makueni, Machakos and Kajiado Counties and bordered by Konza Railway Station, Waami Hill, Katumani, Ngiini Market, Kimutwa/Bondeni River, Konza Ranch Settelement Office, Makuyuni River, Konza Settlement Scheme, Kima Kiu, Aimi ma Kilungu and Mangush River is declared a special planning area. Consequently, all developments in the area have been suspended for a period of six (6) months from the date of this notice. The purpose of this declaration is to facilitate the preparation of Konza/Malili Technocity Zoning Plan whose purpose is to provide a spatial framework for the use and orderly development of land within the general area defined as above. For the purposes of this section notice, development refers to: (a) The making of any material change in the use or density of any buildings or land or the subdivision of any land which for the purpose of this Act is classified as class ―A‖ development. (b) The erection of such buildings or works and the carrying out of such building operations as the Minister may from time to time determine which for purposes of the Act is classified as class ‗B‖ development. The following shall not constitute development for purposes of this Act— (a) The carrying out of works for the maintenance of improvement or other alteration of, or addition to, any building where such alteration or addition does not exceed 10 per cent of the floor area of the building. (b) The carrying out by a competent authority of any works required for the construction, maintenance or improved of a road, if the works is carried out on land within the road reserves. (c) The carrying out of any Local Authority or Statutory Body of any works for the purpose of inspecting, repairing or renewing any sewers, mains, pipes, cables or other apparatus, including breaking open or any street for purpose of installation or services by such Local Authority or Statutory Body. A map of the affected area will be posted at the offices of the Director of Physical Planning, 5th Floor, Ardhi House, Nairobi, County Physical Planning Offices, Machakos, Makueni and Kajiado, Local Authorities offices, Masaku County Council, Machakos Municipal Council, Makueni County Council, Ol Kejuado County Council and at the Sub-Chief‘s office, Malili.
