PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environmental Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the implementation of the proposed construction of Ndau Seawall in Ndau/Kizingitini waterfront in Ndau Island, Lamu County for the Ministry of Public Works. The Proponent (Government of Kenya, Ministry of Public Works) of the proposed construction of Ndau Seawall in Ndau/Kizingitini waterfront in Ndau Island, Lamu County has proposed to carry out construction of 1,300 metres long Ndau Seawall, repair of Kizingitini and Lamu Seawall, extension of Kizingitini Seawall by 300 metres, repair of Kizingitini breakwater, filling up with approved materials behind the Seawall to make up levels and, construction of concrete paved walkway, staircases, mooring bollards and boat slipways along the Seawall. The following are the anticipated impacts and proposed mitigation measures: Possible Impact Mitigation measures Noise pollution • Sensitize workforce including operators of construction machines. • Install sound barriers for pile driving activity. • Install portable barriers to shield compressors and other small stationary equipment where necessary. • Put up signs to indicate construction activities. • Maintain all equipments. • Workers in the vicinity of high level. noise to wear safety and protective gear. • Adhere to the provisions of the Factories and Other Places of Work (Noise Prevention and Control) Rules, 2005 regarding workplace noise limits. • Adhere to the provisions of the Environmental Management and Coordination (Noise and Excess Vibration Pollution) (Control) Regulations, 2009 regarding environmental noise limits. Dust Generation • Spray stock piles of earth with water • Cover all trucks hauling soil, sand and other loose materials. • Provide dust screen where necessary. Exhaust Emissions • Vehicle idling time shall be minimized. • Alternatively fuelled construction equipment shall be used where feasible. • Equipment shall be properly tuned and maintained. Soil erosion • Control earthworks. • Install drainage structures properly. • Ensure management of excavation activities. Water resources • Management of water usage. • Avoid unnecessary wastage of water. • Avail storage tanks. • Harvesting of rain water. Cleanliness and sanitary facilities • Special attention shall be paid to the sanitary facilities on site. • Garbage shall be disposed off periodically. Air pollution • Stockpiles of earth should be sprayed with water or cover during dry seasons. • Provide dust masks for the personnel in dust generation areas. • Sensitize construction workers. Road safety • Road signs on main roads. • Enforce speed limits for construction vehicles. Public health and occupational safety • Ensure proper solid waste disposal and collection facilities are in place. • Proper handling and disposal of solid waste as required in the Environmental Management and Coordination (Waste Management) Regulations, 2006. • Proper handling and disposal of liquid waste as required in the Environmental Management and Coordination (Water Quality) Regulations, 2006. • Adhere to the provisions of the Occupational Safety and Health Act (OSHA), 2007 including.  Provision of suitable personal protective equipment (PPE) and ensuring their compulsory use where the task deems so.  Issuance of Permit to Work were necessary.  Report and investigate accidents at the workplace, etc. • Adhere to the provisions of the Public Health Act Biodiversity Impact • Non drilling of the sand dunes if found on site. • Flora: very limited; moved if encountered Fauna. • Best construction and drilling methods will be applied to avoid disturbance. • Appropriate design and construction of the Seawall. • Regular monitoring. • Abide by the provisions of the Merchant Shipping Act, 2009.
