IN EXERCISE of powers conferred by section 41A of the former Constitution of Kenya, section 58 (2) of the Local Government Act and Regulations 8 (3) and 14 of the Presidential and Parliamentary Elections Regulations, the Interim Independent Electoral Commission gives notice that: (a) An election is to be held of councillors for eleven (11) civic wards as tabulated here below: Constituency Code Local Authority Ward Constituency 003 City Council of Nairobi Huruma Starehe 028 County Council of Taita Taveta Rong‘e Juu Mwatate 077 County Council of Nyandarua Tulaga/Munyaka Kinangop 083 County Council of Nyeri Ngorano Mathira 084 County Council of Nyeri Karima Othaya 110 Municipality of Kapenguria Siyoi Kapenguria 135 Municipality of Naivasha Maragishu Naivasha 170 Municipality of Webuye Webuye West Webuye 175 Municipality of Busia Matayos South Nambale 177 Township of Funyula Odiado Funyula 184 Municipality of Kisumu East Kajulu Kisumu Town East (b) Each political party wishing to participate in the by-election must finalize the nomination of its candidate on or before the 21st October, 2011. (c) The days for the nomination of the candidates for the civic wards by-elections will be on 2nd November, 2011 and 3rd November, 2011, and nomination papers may be delivered by candidates to the Returning Officer of the said constituency between the hours of eight o‘clock in the morning and one o‘clock in the afternoon and between the hours of two o‘clock and four o‘clock in the afternoon of the said days. (d) If the civic wards elections are contested, the poll will take place on the 28th November, 2011. NOTES: 1. The attention of candidates and persons submitting nomination papers is drawn to the provision of Part IV of the Presidential and Parliamentary Elections Regulations (Cap.7. Sub. Leg.). 2. A person guilty of an election offence will be liable to the penalties imposed by the Election Offences Act (Cap. 66) and to the disqualifications imposed by the National Assembly and Presidential Elections Act (Cap.7).
