APPOINTMENT


IN EXERCISE of the powers conferred by Article 157 (2) and section 29 (2) of the Sixth Schedule of the Constitution, I, Mwai Kibaki, President and Commander-in-Chief of the Armed Forces of the Defence of the Republic of Kenya, upon consultation with the Prime Minister— 1. Establish an Interview Panel to receive and process applications, and interview and recommend at least three (3) suitable candidates for consideration for nomination to the Office of the Director of Public Prosecutions. Members of the Interview Panel shall be as follows: (a) The Attorney-General or his representative; (b) A representative of the Office of the President; (c) A representative of the Office of the Prime Minister; (d) A representative of the Ministry of Justice, National Cohesion and Constitutional Affairs; (e) Two (2) representatives of the Law Society of Kenya; (f) A representative of the Central Organization of Trade Unions (COTU). The Interview Panel shall have the power to elect its Chairperson and regulate its own procedures. 2. Invite interested persons who meet the qualifications set out hereunder to submit their applications (supported with certificates and testimonials) to the address stated herein below. Qualifications— (a) hold a law degree from a recognized university, or be an advocate of the High Court of Kenya, or possess an equivalent qualification in a Common-law jurisdiction; (b) have at least ten years’ experience as a superior court judge or professionally qualified magistrate; or (c) have at least ten years’ experience as a distinguished academic or legal practitioner or such experience in other relevant legal field; or (d) hold the qualifications specified in paragraphs (b) and (c) for a period amounting, in the aggregate, to ten years; and (e) have a high moral character, integrity and impartiality. Applications should be received not later than 31st March, 2011, (midnight Kenya time), by electronic mail at dppapplications@kenya.go.ke or at the Ministry of State for Public Service, Harambee House, 10th Floor, Room 1012, Harambee Avenue, Nairobi, in sealed envelopes addressed to “The Interview Panel for the Nomination of Candidates to the Office of Director of Public Prosecutions.” The process is subject to public disclosure of the names of applicants.
