GAZETTE NOTICE NO. 5974

PURSUANT to Legal Notice No. 16 of 2008, the Minister for Agriculture has formulated the Rules set out in the schedule hereto, which shall apply in relation to the importation of the quantities of wheat flour specified under the mutual tariff concessions for the Common Market for Eastern and Southern Africa (COMESA) arrangement, as more particularly set out in the schedule to Legal Notice aforesaid. SCHEDULE 1.The auction on rights to import wheat flour under the mutual tariff concessions for the Common Market for Eastern and Southern Africa (COMESA) arrangement shall be open to all interested persons for the expression of interest. 2.Participation at the auction shall be by catalogue only. 3.To be issued with a catalogue, a person shall pay, at the Ministry of Agriculture's cash office, and by a banker's cheque clearly marked "The Permanent Secretary, Ministry of Agriculture, P.O. Box 30028, Nairobi" a deposit amount of two hundred thousand shillings (KSh. 200,000), upon payment of which a receipt shall be issued, before the date of the auction. 4.The rights to import shall be sold in lots of one thousand tonnes each. 5.The bid price of each shall be determined by the difference between ex-warehouse price of a given quality of domestic wheat flour and the cost of insurance and freight plus port handling charges for an even quantity of imported wheat flour. r Ei 1 b NOTICE NO. 5973 11th July, 2008 THE KENYA GAZETTE 1669 6. The highest bidder shall be she person offering the largest margin. 7. A successful bidder shall be required to pay the full amount of the bid price, less the deposit paid, within fourteen days of winning the bid, failure to which the bidder- shall forfeit both the bid and the deposit paid. 8.
