IT IS notified for general information that I, Mwai Kibaki, President and Commander-in-Chief of the Armed Forces of the Republic of Kenya, establishes a Board to be known as the National Urban and Metropolitan Areas Development Board. 2.The overall objective of the Board shall he to develop an integrated spatial framework for the implementation of growth and development strategies for urban and metropolitan areas of Kenya with a view to providing a high quality of life to the inhabitants, visitors, and investors in such areas and the people of Kenya in general. 3.The Board shall provide a mechanism for compliance by local authorities with all physical development plans and planning standards specified under the relevant laws. 4.For the purpose of this notice, urban and metropolitan areas shall comprise such areas as may be specified by the Minister for Local Government and which may be more particularly described by the Director of Physical Planning. 5.) The National Urban and Metropolitan Areas Development Board shall consist of a chairman appointed by the President and the following members: — (a)The Permanent Secretaries in the Ministries responsible for- Provincial Administration and Internal Security; Finance; Local Government; Lands; Roads and Public Works, and Transport. (b)The Chief executive officer of the Association of Local Government Authorities of Kenya (ALGAK); and (c)Four eminent persons, not being public servants appointed by the President by virtue of their competence, integrity and proven ability to derive results. (2)In absence of the Chairman from a meeting of the Board the members present shall appoint one of the persons specified under sub- paragraph (1) (c) to act as chairman. (3)The Board may from time to time co-opt other persons whose knowledge and expertise is necessary for the performance of its functions. (4)The Chairman and members of the Board appointed under paragraph 4 (1) (c) shall hold office for a period of three (3) years, but shall be eligible for appointment for one further term. 6. The Board may determine its own procedure for the conduct of its meetings and modalities for the performance of its stated functions. 7. (1) There shall be a Chief Executive Officer of the Board, who shall be appointed by the President by virtue of competence and integrity and experience in matters relating to physical planning and urban development. (2) The Chief Executive Officer shall hold office in accordance with the conditions specified in the instrument of appointment. 8. The function of the_Board shall be to advise the Government on the following matters with regard to urban and metropolitan areas— (a) the implementation of national spatial growth and development strategies; (h) identification and promotion of areas that will spur regional growth and equity; (c)promotion of effective and efficient governance and regulation within the areas; (d)promotion of Nairobi as a regional and global services centre for financial, information and communication technology, health, education, business, tourism and other services; (e)the development of effective and efficient integrated mass transport systems for the areas; (J) effective monitoring and enforcement of compliance with planning and zoning requirements in such areas throughout the country; (g)measures to ensure that physical plans and denlopmed strategies cater for sustainable utilization of natural resources and foster environmental conservation; (h)the identification and acquisition of adequate land for use in the development activities and also for public utilities, adequate public parks, community institutions and recreational facilities; (i)• the development of an integrated national infrastructure for the purpose of improving national productivity and promotion of equitable growth; (j)the development of a sustainable funding framework for the development of identified urban and metropolitan areas; (k)the development of a strategy for consultative communication with all stakeholders and cooperation with the private sector; (1) the development and implementation of such other measures as may be necessary for utilization of such areas to achieve long term development objectives. 9. The Board shall be funded from the exchequer and shall be allowed to receive funds from any other source, subject to applicable government financial regulations, for the execution of its mandate. 10. (1) The Secretariat to the Board shall comprise — (a) The Chief Executive Officer, who shall be the secretary to the Board and head of the secretariat; and (h) Such number of staff as shall be deemed appropriate by the Board, who shall be provided by the Public Service Commission. (2) The Secretariat shall have the function of supporting the Board in the effective and efficient delivery of it's mandate. Dated the 1st April, 2008.
