Box 22478, Embu in the Republic of Kenya, is registered as proprietor of that piece of land known as parcel No. Gaturi/Nembure/6972, containing 0.81 hectare or thereabouts, situate in district of Embu, and whereas the senior resident magistrate's court at Embu, in civil suit No. 23 of 2003, has ordered that the said piece of land be transferred to (I) Mercy Wawira, (2) Vincent Njue (a minor), (3) Pauline Murugi (a minor), (4) Eric Mugendi and (5) Lincoln Mukundi (a minor), all of P.O. Box 244, Embu, and whereas the executive officer of the said court has in pursuance to an order of the said court executed a transfer of the said piece of land in favour of (1) Mercy Wawira, (2) Vincent Njue minor), (3) Pauline Murugi (a minor), (4) Eric Mugendi and (5) Lincoln Mukundi (a minor), and whereas all efforts made to compel the registered proprietor to surrender the land title deed issued in respect of the said piece of land to the land registrar have failed, notice is, given that after the expiration of thirty (30) days from the date hereof provided that no valid objection has been received within that period, I intend to dispense with the production of the said land tulle deed and proceed with registration of the said instrument of transfer and issue a land title deed to the said (1) Mercy Wawira, (2) Vincent Njui (a minor), (3) Pauline Murugi (a minor), (4) Eric Mugendi and (5) Lincoln Mukundi (a minor), and upon such registration the land title deed issued earlier to the said Moses Mwaniki M'Njau, shall be deemed to be cancelled and of no effect.
