GAZETTE NOTICE NO. 8204

IN EXERCISE of the powers conferred by Articles 83 (3), 88 (4) of the Constitution of Kenya, Sections 4 and 31 (2) (g) of the Independent Electoral and Boundaries Commission Act, 2011, sections 38 and 39 of the Elections Act, 2011 and Regulations 79, 83, 86, 98 (1) and (2) of the Elections (General) Regulations, 2012, the Independent Electoral and Boundaries Commission makes the following directives on the conduct of election as per the Schedule hereinbelow: SCHEDULE Opening of Ballot Box at the Constituency Tallying Centre to retrieve materials wrongly put in the Ballot Box. Where upon arrival at the Constituency Tallying Centre, the Presiding Officer is found to have wrongly put materials in the sealed ballot box- 1. Materials to be retrieved: (a) KIEMS Kit; (b) Statutory Forms; (c) Polling Station Diary; or (d) Mobile Phones for election officials. 2. The Presiding Officer shall inform the Constituency Returning Officer; 3. Presiding Officer will be required to summon his/her polling station agents to the Constituency Tallying Centre; and 4. In the presence of the Constituency Returning Officer, the Constituency Tallying Center Agents, and polling station agents the Presiding Officer opens the ballot box and retrieves the required materials and then seal accordingly and record the new seal serial numbers in the Polling Station Diary. 5. There shall be no recount or change of already announced results at the polling station. The Polling Station Agents and Tallying Centre Agents will be required to sign as witnesses to the process and RO will record in the Returning Officer Incident Report. In the event that the Polling Station Agents are unreachable, the Constituency Returning Officer will inform the Commission who will give further guidance. Dated the 26th May, 2026.
