THE CONSTITUTION

REGULATION
IT IS notified for general information of the public that pursuant to
Article 184 of the Constitution, 2010 as read with section 20 of Urban
Areas and Cities Act, 2011(amended 2019) and the Ahero-Awasi, Maseno-Holo, Kombewa Bodi, Katito-Pap Onditi and Muhoroni-
Chemelil Municipal Charters, 2023, that the County Government of
Kisumu has transferred the following initial functions currently performed by respective County Departments to the Municipalities of
Ahero-Awasi, Maseno-Holo, Kombewa Bodi, Katito-Pap Onditi and
Muhoroni-Chemelil with effect from the 1st July, 2026 as set out in the schedule below. It is further directed that all the resources currently performing the said functions including staff, budget and assets be transferred forthwith;
1. Promotion, regulation and provision of refuse collection and solid waste management services including:
(i) Solid waste management:
(ii) Dumpsite management:
(iii) Maintain general cleanliness of the municipality:
(iv) Enforcement of laws related to waste management.
2. Water and Sanitation including;
(i) Improve governance of Water providers;
(ii) Sanitation or provision of facilities and services for safe disposal of liquid waste;
(iii) Waste water management;
(iv) Supervision of county public toilets construction;
(v) Supervision of exhausting services;
(vi) Protection of water supply:
(vii) Protection of environment (Ecological, Sanitation);
(viii) Recycling, composting;
(ix) Transportation and disposal of waste.
3. Construction and maintenance of Municipal administrative offices and yards; Construction and maintenance of administrative offices;
and Ensure compliance for contracted building services
4. Design. construction and maintenance of Urban Roads and
Associated Infrastructure including Construction of Urban Roads within the Municipality including:
(i) Mapping of road reserves;
(ii) Opening of roads;
(iii) Survey works;
(iv) Installation of culverts;
(v) Installation gabions, cut off drains and;
(vi) Periodic and routine maintenance of roads including:
carpeting of roads; and Cleaning of drains. Improving of
Urban and Rural Roads within the Municipality.
5. Construction and Maintenance of Storm water drains and flood control infrastructure within the Municipality including;
(i) Design of storm water drainage structures;
(ii) Construction of storm water drains and scour checks;
(iii) Installation of Culverts;
(iv) Opening/unblocking of the drains and;
(v) Installations and construction of gulley pots.
6. Construction and maintenance of walkways and other non- motorized transport infrastructure including;
(i) Demarcation of walkways and non-motorize transport areas;
(ii) Design and construction of pavements/walkways;
(iii) Signage; and
(iv) Enforce proper use of walk-ways.
7. Design, construction and maintenance of street lighting and floodlights:
(i) Design and Installation of Street lighting and floodlights including identification of sites; Design and preparation of
BOQs; Installation of streetlights; Servicing and maintenance schedules; Contracting: Construction; Supervision;
Completion; and Commissioning.
(ii) Maintenance of street lights including: routine checks during maintenance; Management of Flood lights; and Payment of bills - logistics.
8. Development and enforcement of municipal plans and development controls including:
(i) Development Control Zoning and management of Public
Lands;
(ii) Enforcement, collection and accounting for Land rates;
(iii) Urban Planning and preparation of physical land use plans:
(iv) Survey and mapping
9. Enforcement of collection of rates, taxes levies, duties, fees and surcharges on fees where applicable including:
(i) Collection of fee
(ii) Parking fees;
(iii) Bus parking; Reserved parking; Distributors parking;
Personal parking.
(iv) Licenses including: Single business permits; Liquor licenses within the municipality
(v) Noise permit.
(vi) Outdoor advertising fees including; Wall branding; Sign boards; Bill boards Banners; Leaflets; Posters; Tent pitching;
Mobile brandings; Road shows; Umbrella branding: Neon signs; Kiosk branding etc.
(vii) All other fees and levies within the Municipality.
10. Promotion, regulation, and provision of animal control and welfare including:

(i) All aspects of animal well-being, including development of regulations, proper housing management, nutrition, disease prevention and treatment, responsible care, humane handling and, when necessary, humane euthanasia, Disposal of animal including removal of carcasses in public places;
(ii) Licensing regime for dogs
(iii) Issuance of certificates;
(iv) Picking of stray dogs; and Enforcement of animal Act.
11. Promotion, regulation, and provision of municipal sports and cultural activities:
(i) Sports development and management
(ii) Revenue collection and management of social halls including:
Revenue collection; Cleaning and Employment of staff.
12. Construction and/or Maintenance of Markets within the
Municipality and Abattoirs including; Live animal markets;
Fresh produce markets Open Air Markets. Management of markets in line with county market management policy including collection of market and trading fees.
13. Traffic control and management including; development and maintenance of parking lots; charging fees on parking;
preparation of urban mobility plans and policies; traffic flows and directing.
The county department in charge of the municipalities and urban development is hereby directed to liaise with respective departments and facilitate the transfer and operationalization of this instrument.
