THE LAND REGISTRATION ACT

REGISTRATION

Whereas Michael Musyoka Mwiwa, is registered as proprietor in absolute ownership interest of all that piece of land containing 5.29 hectares or thereabout, situated in Taita/Taveta County, registered under the Title No. Taita Taveta/Mwachabo Phase II SS/875, and whereas the Enrironment and Land Court at Voi, in ELC. Case No. 17/2023 (Formerly Mombasa ELC Appeal No. E39/2022 vide a decree dated the 23rd January, 2024, ordered and decreed that the title deed held by Michael Musyoka Mwiwa is invalid and has directed the land registrar to cancel it and register (1) Malambo Nyange Malambo and (2) Kilemba Mwamburi as the rightful proprietors in equal shares and whereas Michael Musyoka Mwiwa has refused to surrender the original land title deed for cancellation, notice is given that the land title deed held by Michael Musyoka Mwiwa, shall stand cancelled and of no effect and that I shall issue a new land title deed to (1) Malambo Nyange Malambo and (2) Kilemba Mwamburi.
