THE LAND REGISTRATION ACT

(Cap. 300)

REGISTRATION

WHEREAS Elizabeth Kavindu Makau (deceased), is registered as proprietor of all that piece of land known as Athiriver/Athiriver Block 5/204, containing 2.023 hectares or thereabout, situate in the county of Machakos, and whereas in the Senior Magistrates Court at Kangundo in Succession Cause No. E24 of 2022, has issued grant of letters of administration and certificate of confirmation of grant to (1) Bernard Muisyo Makau and (2) Janet Waeni Mutisya, and whereas the said (1) Bernard Muisyo Makau and (2) Janet Waeni Mutisya have executed L.R.A. 39 for registration, and whereas all efforts made to recover the land title deed for the said parcel of land have failed, notice is given that after the expiration of thirty (30) days from the date hereof, provided no valid objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with registration of the said instruments of L.R.A. 39 and issue land title deed to the said (1) Bernard Muisyo Makau and (2) Janet Waeni Mutisya, and upon such registration the land title deed issued earlier to the said Elizabeth Kavindu Makau (deceased), shall be deemed to be cancelled and of no effect.
