the following charges as security for the payment of monies due from Nakumatt Holdings Limited to Standard Chartered Bank Kenya Limited: 1. Charge dated 11th February, 2011 over Land Reference Number MN/I/9626 Mombasa for KSh.4,050,000 together with interest. 2. Charge dated 11th February, 2011 over Nakuru Municipality Block 9/47 for KSh.20,000,000 plus interest, costs, expenses and charges. 3. Charge dated 27th January 2012 over Land Reference Number 209/4063 for KSh.39,200,000 together with interest. 4. Charge dated 27th January 2012 over Land Reference Number 209/4058 for KSh.29,300,000 together with interest. The amounts secured by the charges created over Land Reference Number MN/I/9626 Mombasa, Nakuru Municipality Block 9/47, Land Reference Number 209/4063 Nairobi and Land Reference No. 409/4058 Nairobi (the charged properties) are collectively referred to in this notice as the “secured amounts”. Nakumatt Investments Limited is in default of its obligation to pay the amounts secured by the charges. Nakumatt Holdings Limited is indebted to Standard Chartered Bank Kenya Limited in the sum of USD 331,872.95 in respect of the Overdraft Facility, USD 6,993,052.49 for the Term Loan facility and KSh.967,173,402.82 for the Import Invoice Finance facility. Standard Chartered Bank Kenya Limited demands payment of the secured amounts. Nakumatt Investments Limited is required to rectify the default by paying the secured amounts. If Nakumatt Investments Limited has not paid the secured amounts within ninety (90) days after the date of publication of this notice, Standard Chartered Bank Kenya Limited will proceed to exercise the remedies available to it under the charges and the Land Act including proceeding to sell the charged properties. Nakumatt Investments Limited has the right to apply to court for any relief provided in the Land Act. This statutory notice is issued pursuant to section 90 of the Land Act and the judgment of the High Court in Nairobi High Court Judicial Review Application Number E249 of 2025 dated 10th November, 2025.
