GAZETTE NOTICE NO. 3582

PURSUANT to section 59 of the Environmental Management and Co-ordination Act 1999, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Highpoint Development Limited, intends to develop a 20 storey ( basement, ground plus 20 floors ) comprising a total of 336 units (two bedroom units, three bedroom units and penthouses) swimming pool, gym, management office, 320 parking spaces and other associated facilities and amenities on plot area L.R. No. Nairobi/Block 17/757 along Kilimani Road, Kilimani Area, Dagoretti North sub-county, Nairobi County. The following are the anticipated impacts and proposed mitigation measures. Impacts Proposed Mitigation Measures Soil Erosion • Control excavation works especially during rainy/wet conditions • The stockpiling of construction materials shall be properly controlled and managed. • Provide soil erosion control measures i.e., suppressing open surfaces with water or use of soil erosion control structures on soil-erosion-prone areas within the site. • Avoid unnecessary excavations and other soil disturbances that can predispose it to the agents of erosion. • Avoid unnecessary movement of soil materials from the site. • Re-surface open areas on completion of the project and introduce appropriate vegetation. Loss of Vegetation • Only area earmarked for development should be cleared. • Plant trees, shrubs and flowers on remaining open spaces. Changes in hydrology/ impended drainage/deep excavations • Proper Installation of drainage structures. • Install cascades to break the impact of water flowing in the drains. • Ensure efficiency of drainage structures through proper design and maintenance. • Provide gratings to the drainage channels. • A methodology for excavation has been generated as required by NCA. Air pollution • All trucks and any other mode of hauling soil sand and other loose materials to and from the site should be covered. • The site should be enclosed with dust- proof nets • Control speed of construction vehicles to reduce dust generation • Sprinkling of water on dry soils in excavated areas, pavements • Use of clean fuels for machines and equipment • Provide barriers such as walls and netting around site boundaries to provide some buffer against dust emissions (where applicable). • Encourage other people to either avoid or minimize coming to this site during construction works 1078 1078 Impacts Proposed Mitigation Measures Noise pollution • Comply with EMCA Noise Pollution & Excessive Vibration Regulations, 2009 • Carryout regular monitoring of noise levels during construction phase • Construction work to be confined to between 8am to 5pm • All workers shall be trained and provided with PPEs such as helmets, earmuffs, and dust mask. which will always be used when operating within the site area • Safety signage shall be erected at the construction site entrance to notify of the construction activities and timings Occupational Safety & Health • All workers and visitors on site to use mandatory protective gear • Unattended entry to the project site to be restricted • Use of efficient and well-maintained machines to lift and transfer materials • Removal of all dangerous materials that may pose a threat such as metal bars, wires, glass, and broken equipment. • Availing of fully equipped first Aid kitties to help address emergencies. • Warning signs to all users and visitors be placed at appropriate places • Educate construction workers and tenants on health and safety risks and their prevention Public health, occupational health and safety • Train staff/workers on occupational health and safety. • Provide full protective gear & workmen’s compensation cover in addition to the right tools and operational instructions & manuals during construction. • Design of sewerage system should be as provided in the plans and should be constructed to approved size and design, standard and of approved materials. • Ensure use of standard construction materials and to the specifications. Avoid undesirable, substandard, hazardous or unauthorized materials during construction & maintenance. • Sensitized staff on social/health issues such as drugs. Road traffic disruption • Ensure that the Entry/Exit to the project site is located where it will cause minimal traffic along adjacent roads • Ensure all construction vehicles to and from the construction site use the designated Entry/Exit to the project site • All transportation of construction raw materials and excavated materials are to be conducted at traffic off-peak hours only • Sensitize truck drivers to avoid unnecessary road obstruction Insecurity and social impacts • Provision of security guards, CCTV cameras, security lights and other security apparatus during the entire project cycle. • Construction work timings shall only in line with the NEMA licensing conditions. Impacts Proposed Mitigation Measures Increased Water Usage • An alternative water source shall be provided. The proponent shall drill a borehole at the proposed site. • Management of water usage. Avoid unnecessary wastage. • Recycling of water at the construction phase where possible. • Make use of roof catchments to provide water i.e. for general purpose. Increased generation of waste • Ensure that all the solid waste management during the construction and operational phases of the project comply with the (Waste Management) regulations of 2006. • Segregation of waste at the source during the project cycle. • Engage the services of registered waste handlers to collect and transport waste to designated disposal sites. • Provision of waste management rooms at strategic places within the development facility.
