PROCLAMATION


WHEREAS, Article 131(2) (e) of the Constitution of Kenya requires the President to ensure the protection of human rights and fundamental freedoms and the rule of law; WHEREAS, Kenya is a signatory to all major continental and international human rights treaties, conventions and instruments that uphold the rights to freedom of association and assembly; WHEREAS, the Kenya National Commission on Human Rights is established pursuant to Article 59 of the Constitution as the principal organ of the State responsible for ensuring compliance with obligations under treaties and conventions relating to human rights; WHEREAS, It is acknowledged that in the exercise of these rights, particularly the right to assemble, demonstrate, picket, and petition public authorities as guaranteed under Article 37 of the Constitution, there have been regrettable incidents of violence resulting in loss of life and life-altering physical injuries to both civilians and security personnel; WHEREAS, By dint of a Presidential Proclamation issued on 6th August, 2025, the Head of State and Government, acting in furtherance of the State’s constitutional mandate to promote national healing and cohesion, established a Framework for the Reparation and Compensation of Victims of Demonstrations, Public Protests, and Riots; WHEREAS, the High Court of Kenya at Kerugoya in Constitutional Petitions Nos. E10, E11 and E14 of 2025 (Consolidated) directed that the development of a suitable framework for compensation and reparations for victims of violations of human rights be undertaken by the Kenya National Commission on Human Rights; WHEREAS, Article 254 (2) of the Constitution empowers the President to require a Commission or independent office to submit a report on any particular issue within its mandate; and WHEREAS, It is expedient, in the public interest and in furtherance of the Constitution, and in compliance with the directions of the Court, that a restructured framework be developed for the provision of reparations to victims of violations of human rights, including those arising from demonstrations and public protests. NOW THEREFORE, I, William Samoei Ruto, President of the Republic of Kenya and Commander-in-Chief of the Defence Forces, in exercise of the authority conferred upon me under Article 254 (2) of the Constitution, do require the Kenya National Commission on Human Rights, to: I. DEVELOP AND SUBMIT a framework to guide the provision of compensation and reparations to victims of violations of human rights, including those arising from demonstrations and public protests; and II. SUBMIT, PUBLISH and publicise a report containing the said framework within sixty (60) days of the date of this Proclamation, in accordance with the Constitution and the applicable law. IT IS further proclaimed that this Proclamation shall supersede the Proclamation issued on the 6th August, 2025. REASONS WHEREFORE, it is directed that the Panel of Experts established pursuant to the earlier Proclamation shall be re-established as an internal administrative mechanism within the Office of the President, for the sole purpose of facilitating the implementation of the framework once developed. Provided that, the said Panel— (a) Shall not exercise supervisory authority over the work of the Kenya National Commission on Human Rights; and (b) Shall support the implementation of the framework, consistent with the Executive’s commitment to justice and accountability, and ensure that compensation to eligible victims is effected in a transparent, accountable and timely manner, in accordance with the framework developed by the Kenya National Commission on Human Rights and the Constitution of Kenya.
