THE ENVIRONMENTAL MANAGEMENT AND CO - ORDINATION ACT

PURSUANT to section 59 of the Environmental Management and Coordination Act, 1999, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Azure Horizon Limited, Golden Vista Investment Limited, proposes to construct a commercial mall and 5No. residential blocks (A, B, C,D and E). Commercial mall will comprise of ground floor and 9no. floors, first to fourth floor will comprise of commercial spaces, 5th floor will comprise of (hotel and restaurant, recreation and reception), 6th to 9th floor comprising of (hotel guest rooms), water storage tanks, fire assembly area, firefighting systems service systems, service corridors, waste collection bay, loading and offloading zone, emergency exits, power backup room elevator lift and landscaped frontage. Residential block will comprise of ground, mezzanine and 16 floors, 711No. Parking spaces,1st to 16th floor comprising (264No. studio apartments, 248No. one-bedroom units, 256 No two bedroom units, 31No. 3 bedroom units and 32No. 4 bedroom units), swimming pool, generator room, other associated facilities and amenities o plot L.R No. Block 26/4, 26/5 and 26/6, Syokimau, Mavoko Sub-county, Machakos County. The following are the anticipated impacts and proposed mitigation measures: Impacts Mitigation Measures Land disturbance  Limit site clearance strictly to approved development footprints.  Implement erosion and sediment control measures including silt traps, sediment fences, and temporary bunds.  Stabilize exposed surfaces promptly through compaction, mulching, or temporary surfacing.  Schedule earthworks during dry weather where practicable and progressively rehabilitate completed sections. Storm-water runoff • Design a hydraulically adequate stormwater drainage system capable of managing extreme rainfall events and future climate variability. • Integrate on-site attenuation, infiltration trenches, permeable paving, and landscaped swales. • Construct lined drains and energy dissipation structures to reduce runoff velocity. • Conduct routine inspection and desilting to prevent blockage and localized flooding. Increased traffic, access  Develop and enforce a Construction Traffic Management Plan. Constraints and road safety risks  Schedule delivery of materials and equipment during off-peak hours.  Deploy trained traffic marshals at access points and install advance warning signage.  Enforce speed limits, axle load compliance, and use of licensed drivers.  Maintain safe pedestrian interfaces around the site perimeter. Air quality  Erect dust screens and hoardings around active work zones.  Undertake regular water sprinkling on exposed surfaces and haul roads.  Cover stockpiles and transport trucks carrying friable materials.  Prohibit open burning of waste.  Maintain machinery to minimize exhaust emissions in accordance with manufacturers’ specifications. Noise and vibration  Restrict noisy construction activities to approved daytime hours.  Use noise-attenuated equipment and temporary acoustic barriers where necessary.  Schedule high-noise activities concurrently to reduce exposure duration.  Provide and enforce use of hearing protection PPE for workers. 6th February, 2026 THE KENYA GAZETTE Impacts Mitigation Measures  Monitor noise levels to ensure compliance with applicable standards. Occupational health and safety risks • Implement a Site -Specific Occupational Health and Safety Management Plan (OHSMP) compliant with OSHA, 2007. • Conduct safety inductions, toolbox talks, and task-specific risk assessments. • Provide appropriate PPE and enforce its use at all times. • Install safety signage, barricades, and controlled access to hazardous areas. • Maintain first-aid facilities and trained first responders on site. Fire hazards and emergency situations  Provide portable fire extinguishers and firefighting equipment at strategic locations.  Store flammable materials in designated, ventilated areas away from ignition sources.  Prohibit smoking and uncontrolled ignition sources on site.  Ensure all electrical installations are undertaken by licensed professionals.  Designate fire assembly points and conduct emergency response drills. Solid waste generation  Implement a Solid Waste Management Plan (SWMP) aligned with EMCA Waste Management Regulations, 2006.  Segregate waste at source into recyclable, inert, hazardous and organic streams. • Engage NEMA -licensed waste transporters and disposal facilities. • Apply the waste hierarchy: reduce, reuse, recycle, recover, and dispose responsibly. • Provide designated waste storage and segregation areas within the development. Liquid waste and sewage generation  Connect to the approved public sewer system upon acquisition of relevant permits.  Design internal sewer lines with inspection chambers and rodding eyes for maintenance.  Conduct routine inspection and preventive maintenance of sewer infrastructure.  Provide adequate sanitary facilities for construction workers and decommission them after construction. Increased water demand and resource pressure • Connect to the public water supply and supplement through licensed vendors as needed • Install water-efficient plumbing fixtures and appliances. Impacts Mitigation Measures • Provide adequate underground and rooftop water storage tanks. • Incorporate rainwater harvesting systems for non-potable uses. • Monitor water consumption and promptly repair leakages. Increased energy demand and carbon footprint  Integrate renewable energy solutions, including solar photovoltaic systems for common areas.  Install energy-efficient lighting, equipment, and motion sensors.  Promote energy conservation practices during construction and operation.  Conduct regular maintenance of electrical and solar installations. Visual and urban landscape impacts • Apply architectural articulation and façade treatment to reduce visual massing. • Incorporate soft and hard landscaping to enhance visual integration with surrounding developments. • Maintain orderly signage, lighting, and external finishes. • Implement a long-term landscaping and façade maintenance plan. Community health, safety and social interaction impacts • Maintain secure site boundaries and controlled access points. • Implement grievance redress mechanisms for neighboring communities. • Minimize nuisance impacts (noise, dust, traffic) through proactive management. • Promote local employment opportunities where feasible. • Ensure adequate lighting, surveillance, and security measures during operation.
